Yesterday we noted that the MPAA and movie theater owners were whini ng about how much people coming in an taping movies was hurting their business. The obvious response, we pointed out, is to recognize that going to the movies is a social experience. It's not just about the content (though, that is important), but the overall experience. If they improved that, then people would want to go -- even if they could score the same movie off the internet or a cheap DVD bought off the street. While the folks in Hollywood refuse to entertain this idea, someone (anonymously) in the comments to that story pointed to an article in China noting that this is exactly what Chinese movie theaters have done. After years of declining attendance, they finally shaped up and made going to the movies cool again. They improved the overall experience, putting in better equipment and more comfortable seats. They improved the sound and the lighting as well. It sounds like they also made some theaters to be more like bars, to help attract young adults away from traditional bars. Yet the supposedly "creative" movie people in Hollywood insist "nothing can be done" to get people into the theater.

[This is an edited version of the talk I gave last fall at the State of Play conference.] I'm sort of odd-man-out in a Games and Law conference, in that my primary area of inquiry isn't games but social software. Not only am I not a lawyer, I don't even spend most of my time thinking about game problems. I spend my time thinking about software that supports group interaction across a fairly wide range of social patterns. So, instead of working from case law out, which has been a theme here (and here's where I insert the "I am not a lawyer" disclaimer) I'm going to propose a thought experiment looking from the outside in. And I want to pick up on something that Julian [Dibbell] said earlier about game worlds: 'users are the state.' The thought experiment I want to propose is to agree with that sentiment, and to ask "How far can we go in that direction?" Instead of looking for the places where game users are currently suing or fighting one another, forcing the owners of various virtual worlds to deal with these things one crisis at a time, I want to ask the question "What would happen if we wanted to build a world where we maximized the amount of user control? What would that look like?" I'm going to make that argument in three pieces. First, I'm going to do a little background on group structure and the tension between the individual and the group. Then I want to contrast briefly governance in real and virtual worlds. Major League Baseball made news last year for claim ing to own all in-progress game data - saying they were going to go after websites that reported what was happening at a game in real-time. It didn't matter that the law is pretty clear that you can't copyright facts - MLB believes that just presenting the data is a "rebroadcast" of the game. That said, I guess it's no surprise to hear that they now believe that web audio and video broadcasts of games should work the same way as television broadcasts with a content provider paying a huge upfront fee for the rights to the games, and then telling them they can make it back in ad revenue and subscription fees. Of course, the various internet sites they've approached with this plan have been laughing them out the door, and pointing out that they're not television stations, and they just want to provide something useful to their users - but aren't going to lose money to do so. While MLB has been at the forefront of offering streaming video and audio, it appears they still look on this as a broadcast medium, and not the interactive medium it actually is. They're doing their best to squeeze more money out of existing fans, rather than attract new fans, which is dangerous for the future of the sport. Not only do you anger your biggest fans, you also make it less likely that you're going to pick up new fans.
