Government trying to use hostage crisis
to squash NGO's in Japan
05/11/2004 10:54 AMThe Japan Times
Kidnap crisis poses a new risk
In Japan's case, laws are being proposed to punish those entering
designated "danger zones" without an official reason.
Victims -- or their families -- will foot the bill for their
rescue, which will amount to airfare, if not more. "This is standard
practice for mountain rescues," one line of reasoning goes.
But consider two things: One is that an aid mission to a danger
zone is not a forest stroll gone astray. The very comparison indicates
a misunderstanding of what aid missions do.
The second is policy overstretch and political abuse. This law
would place a degree of government control over aid organizations,
something many don't want. Particularly NGOs (by very the nature of
their title) eschew government support, especially when they take on
problems governments would rather avoid.
Under this law, they would effectively need official permission to
work in some places overseas. Those "unsponsored" who get unlucky will
face a "rescue fine" -- which could bankrupt the person or the
organization. Thus this new system of rents will curtail Japanese
volunteerism.
The Japanese government is taking this way
too far and totally agree with the author of this article that this is
a bad bad thing.
As I've said before,
legislation during emotionally charged times often ends up being
stupid and poorly thought through. The ramifications of such a law
would be devastating for NGO's and aid workers from Japan, just when
such activity is becoming recognized. It almost feels like some stupid
conspiracy to use this incident to squash the NGO's in Japan. Bah. I
have less and less respect for the Japanese government every day.

climate change models...
02/01/2005 08:53 PMClimate change is still a contentious issue in some parts of the
world. Despite widespread acceptance in the scientific community and
by the general public in most of the industrialized world, it remains
a divisive topic in the United States, rejected by conservative
politicians armed with studies from industry-funded think-tanks and a
healthy dose of congnitive dissonance.
This week's Science.Ars looks at the results of a distributed
computing project focused on climate change modeling. In addition,
we've got news of the sex life of the Hawaiian Cricket, stem cell
contamination, and more.

We Don't Need No Stinking Constitution
06/03/2004 07:01 PMDahlia Lithwick (Slate): Proof, Negative: The Justice
Department's triumphant victory over the Constitution. The
evidence in thi
s document was collected during a two-year detention, in which
Padilla was in solitary confinement, never charged with a crime, and
only given access to his attorney this spring. Certainly his
confessions might still be reliable, along with the confessions of Abu
Zubaydah and other confederates being interrogated in secret. Or they
might not. Without a trial we can never know, and as Phil Carter
recently observed, there can now be no trial on the strength of this
evidence since it was obtained unconstitutionally.Jonathan
Turley (LA Times): You Have Rights -- if
Bush Says You Do. In a moment of extraordinary and chilling
honesty, (Dep. Attorney General) Comey explained that Padilla had to
be stripped of his civil liberties because, if he used them (including
his right to remain silent or his right to a lawyer), he might have
been able to win his freedom. Thus, the government had to keep him
away from lawyers and judges at all costs. Gone was the pretense of
legality or principle. The Justice Department had finally found its
natural moral resting point: Civil liberties are tolerated only to the
extent that they will not interfere with the government's actions.
Meanwhile, Zacarias Moussaoui, a foreign citizen accused of terrorism,
was presumably given his rights in federal court because, given the
case against him, the government thought those rights would do him
little good.
First the Bush administration jails a
man solely on its say-so, allowing no access to a lawyer or a chance
to defend himself. It extracts, apparently, a "confession" of some
sort. (Did it use the same tactics as in Iraq and Afghanistan
lockups?)
Then, just as the Supreme Court gets ready to rule on whether the
president can overrule the Bill of Rights on his whim, this
information is suddenly made public. As Turley notes, this is a press
release aimed at the justices as much as the American people.
Padilla may indeed be the scum of the earth. But if they can do this
to him, they can do this to innocent people. People like you. Think
about it.

If the Constitution was a EULA
03/26/2005 05:13 AMCory Doctorow:
The current administration has spent the past four years treating the
Constitution as though it were a EULA and subject to change without
notice. Slate's "Important Changes to Your Citizenship Agreement"
reviews some of these changes in a compact and helpful form.
SECTION 5
The Freedom of Speech section of the Agreement is amended to
distinguish between Regular Preferred Speech and Non-Preferred Speech.
The Non-Preferred Speech rate applies to all speech which is not in
good standing as defined under the "Preferred Citizen Rate
Eligibility" section of your Agreement. Both the rate and your freedom
of speech may vary based on changes in the National Terror Alert
Level...
SECTION 16
This amendment affects the Right to Privacy section of your agreement.
Under the new terms, the Right to Privacy must be applied for on an
individual basis. To apply for your Right to Privacy, you must send
your full credit history, a copy of your party registration and church
membership, a complete set of fingerprints, a DNA sample, and two (2)
passport-size photographs of your bedroom to: National Privacy
Registry, Washington, DC, 20012-3006, att: Doris.
