04/12/2005 06:10 AMMusic firms are launching their first lawsuits in Asia as the
crackdown on net piracy continues. The International Federation of the
Phonographic Industry announced this morning it had filed 963
lawsuits, with some of them in Japan. Other countries targeted this
time round include the Netherlands, Finland, Ireland and Iceland.
Music sales in Japan have fallen by nearly a third in the past five
years - the country has the world's second-largest market for music.
John Kennedy, IFPI chairman and chief executive, said: "The
industry has decided this is the time to act. The Japanese are
law-abiding citizens and it may be this delivers the short, sharp jolt
that we need there."
The lawsuits come as legal online alternatives such as Napster and
iTunes continue to expand. The industry is also calling for ISPs to
take a more pro-active approach by going after those who illegally
upload material themselves.

Earlier today, I was over at the NPR studios here in Los Angeles
taping a segment for next week's "
Day to Day" -- a
conversation about MP3 blogs, with show host
Noah
Adams. He's an amazing newsman -- the former long-time co-host of
All Things Considered -- and the author of
Far Appalachia (read an
exc
erpt).
We were talking about all of the ultra-obscure sorts of
niche-niche-niche music that online services like MP3 blogs help
people find, and he shared a story about an independent community
media organization in eastern Kentucky devoted to Appalachian regional
culture. Their radio station, WMMT (which streams
online) specializes in bluegrass and oldtime. Evidently, one deejay
there was well-known for maintaining an extensive collection of rare
oldtime music -- on his iPod. He'd drive three hours to get to
the station -- with his iPod -- and play material from it on-air. Kind
of funny when you think about the nature of the music (by definition,
old), and the nature of the medium (new). Sure beats lugging heavy
crates of vinyl all around the mountains, though.
The media organization has a website, and a name: Appalshop (appal = short for
appalachian, has nothing to do with Apple Computers). Plenty of
interesting stuff there, including some documentary film projects.
And on a related note, Noah did an incredible segment not too long ago
on Day to Day. Remember the story about "Dan," the homeless man
in San Francisco who became a philanthropist after inheriting $200,000
from his mom? Turns out Noah tracked the guy down and had a series of
conversations with him, which you can listen to
here. It's nothing short of great radio.

has convinced 16 artists (some of whom are signed to major label
contracts) to contribute tracks to a compilation CD that
has been released under a Creative
Commons license. As the article admits, the only difference on
the CD is a "legal" one -- that people are free to share the music on
the CD. The "big" names on the CD are David Byrne and the Beastie
Boys. While it should get a bit of publicity for Creative Commons,
it's not entirely clear if this does all that much to further the
discussion about music sharing. The real innovation in the industry
is coming from the
new
music labels that realize the music is just one element of what a
musician has to offer, and that the music can be used for promotion,
rather than as a good to be sold.

08/14/2004 04:42 AMOne group tried get out ahead of the lobbyists and demonstrate the
usefulness of P2P in areas not usually covered by the mainstream
media, and they've used SP2 to do it.
Downhill Battle, a site which attempts to promote independent music
and stop the RIAA, was told by Microsoft this week to stop
distributing their torrent file of the recently released Windows XP
Service Pack 2.
Its creators had noble intentions, a demonstration of how P2P
filesharing technology can help distribute files that are too large
for centralized distribution to handle. Since Microsoft limited the
amount of downloads users could make from their downloads server to
2.5 million a day, Downhill felt their could help ease the load.
Microsoft didn't see it this way.
Microsoft sent multiple DCMA warnings to Downhill and while they have
stood up to such threats before, the group has decided to simply
remove the torrents as Microsoft requested. It seems they have decided
that the effort was a big enough of a success, that they could to do
as Microsoft asked, and turn their efforts back to their primary
focus, the fight against the RIAA.
One would assume reasoning for the request is understandable, yet the
exact reason is unknown. Does Microsoft want to control the
distribution of their latest creation? Does Microsoft dislike
torrents? Or is it simply the fact Microsoft doesn't want people
installing bad versions of their package and messing up their

expresses his concerns about how some aggregators plan
to handle invalid Atom feeds. Mark believes that rejecting
invalid XML on the client side is a bad idea, and proposes a thought
experiment in which all web browsers use strict XML parsers and refuse
to display XHTML that isn't well-formed.
This is a bit of a bait-and-switch, though. XHTML has the whole
sordid history of HTML on its back, and since browsers have generally
been forgiving of even the most convoluted HTML there's a substantial
backwards-compatibility issue. The XML-based Atom, however, is brand-spanking new, so it doesn't
have the same baggage as XHTML.
So, let's try another thought experiment. I've copied Mark's Atom
newsfeed and made it invalid XML by adding a single &
character, then uploaded it to my site:

Mark asks us to "imagine that all web browsers use strict XML
parsers," but rather than use our imaginations, lets see what happens
when we browse this feed in Internet Explorer:

Hmmm...IE appears to be doing client-side validation, and it shows
an error instead of displaying the feed's contents. Okay, so let's
try Mozilla:

Looks like Mozilla does the same thing. How about Opera?

So, the most popular Windows browsers all perform client-side
validation, and fail to display the contents of the invalid Atom feed.
There's nothing surprising here, of course - any validating XML
parser will reject this feed.
Consumers of RSS feeds have had to code around all sorts of
validation problems in order to be backwards-compatible with existing
feeds. Atom, however, is new, so customers aren't already subscribed
to hundreds of invalid Atom feeds. Being well-formed is a requirement
of XML, and Atom is defined as an XML format, so why not expect Atom
feeds to be well-formed? Let's get it right this time.

being used by people around the world , who are putting its
materials to different uses.
Mr. Cooper, who describes himself as "a lowly tech-ed guy" at Pacific
University, in Oregon, says that he envisions a future in which
professors and students, using free course materials like MIT's and
open-classroom sites on the Web like Tapped In, will exchange their
teaching services through a kind of online barter system.
"I could volunteer my hours [to teach] at the high-school level and
that would give me credit to then get other hours from somebody else,"
says Mr. Cooper, an education-technology specialist at Pacific.

At a Unesco forum about the project in Paris in July, Alain Senteni,
director of the Virtual Center for Innovative Learning Technologies,
at the University of Mauritius, said his institution had an interest
in translating and adapting the content of MIT courses for
French-speaking developing countries.
And Mohammed Dahbi, a professor at Mohammed V University's Agdal
campus, in Morocco, said faculty members and administrators might use
OpenCourseWare as a model for course structure and pedagogy when they
recast their courses during the next few years. University courses, he
said, are being rewritten as part of a broad reform movement in
Morocco.
The high-profile, positive reception of OCW has prompted
other institutions to pursue similar initiatives of Webbing up
course content for world usage.

Sharing Experiment is a project with the goal of demonstrating how
file sharing actually helps the music, movie, and software industry.
Folks are encouraged to post purchases they've made and a short
explanation of how they learned about the band/movie/game and why they
ended up buying something for it. All the evidence is anectdotal, but
when taken together, it's already over a quarter million dollars in
reported sales and the site has been up for one week.
Personally, this was the point I tried to make in the heyday of
Napster. You could find anything on Napster, but rarely could you find
complete albums, so the service had the effect of promoting CD sales.
I would often surf others' music lists whenever I noticed things I
liked, download the things I hadn't ever heard of, then I'd end up
buying CDs from Amazon.

its downtown: I first heard about this on the radio program I was
interviewed on yesterday on New Hampshire Public Radio (show archived
at this page). The first year had 600 unique users connect to a free
hotspot in the Market Square area. They're extending that and hoping
for twice the users using donated services and hardware. The cost must
be quite minimal. Now 600 people (not 600 sessions) only translates
into an extra few people a day, on average, but Portsmouth is using
whatever tools they have to increase traffic to the community. The
fellow interviewed alongside me on the radio said that their big time
is cyclical, every four years, when the primaries roll through the
state, and that reporters were filing over the free Wi-Fi this last
winter....
