PATRIOT Act: The last refuge of
scoundrels
PATRIOT Act: The last refuge of
scoundrels
05/24/2004 11:34 PMOne of the more remarkable news stories to break in the past month, a
time of many remarkable stories, told of the strange saga of the
ACLU's challenge to the
PATRIOT act. It turned out that, under a provision of the PATRIOT
Act itself, the ACLU had been barred even from telling anyone about
its challenge to the PATRIOT Act, and had to fight the Bush
administration just to be able to announce its suit.
This bit of Kafkaesque logic may seem positively un-American. But
it makes sense within the increasingly divorced-from-reality,
driven-by-images, shoot-the-messenger world of the Bush
administration. Here, a secretary of defense get really steamed not
about the fact of torture in a U.S.-run prison (hey, shit happens!)
but about losing control of the flow of images about that torture.
Here, in the wake of the worst geopolitical strategic mistakes
committed by a U.S. leader since Lyndon Johnson's Vietnam escalation,
a president decides that his first priority must be -- a P.R.
offensive!
(Sorry for the digression: it's hard to stay on track when the news
provides so many sidings into bitter absurdity.)
Today the Electronic Frontier
Foundation filed an amicus curiae brief in the ACLU's case, and
Salon -- on behalf, in particular, of The WELL, which is a Salon subsidiary
-- is proud to be among the signers. They also include the Electronic Privacy Information Center,
the Center for Democracy and
Technology, the Center for
Constitutional Rights, the U.S.
Internet Industry Association, and the Online Policy Group.
What's at issue here, chiefly, is a provision of the PATRIOT Act
that (to quote from the EFF brief) "authorizes the FBI to compel the
production of subscriber and communications records in the possession
of a broad range of Internet-related communications service providers,
potentially covering billions of records from tens of thousands of
entities. These demands, known as National Security Letters (NSLs),
are issued without judicial oversight of any kind, yet allow the FBI
to obrain a vast amount of constitutionally protected information."
The brief -- a "friend of the court" filing in which parties who feel
they have interests at stake in a proceeding offer legal arguments
that complement those of the plaintiffs -- argues that the Act is not
only constitutionally overbroad but also "not cabined by any
intelligible standard": in other words, there's no way to make sense
of it in terms of the realities of the Internet today.
The WELL has a long history of helping define the shape of Internet
users' rights and responsibilities. As the Bush administration
continues to push beyond the edges of reasonable legal means in its
conduct of the "war on terror," we'll keep doing what we can to fight
back and protect the privacy of our users, customers and community
members.
(I will post a link to the brief as soon as it's online.)

Generating Perl graphs with GD::Graph
04/13/2004 11:22 AMPerl's GD::Graph module is a tool that allows a software developer to
quickly and easily generate graphical representations of data.
Originally written by Martien Verbruggen in 1995, the package has
matured into a very flexible and popular tool. It is ideally suited to
any situation where a dynamic data set, from a database or elsewhere,
needs to be fetched and represented on the fly. It is widely used in
corporate intranets, where many a webmaster has used it to generate
graphs that show data in exactly the format management likes.

BIRD BY
BIRD
BIRD BY
BIRD
08/02/2004 03:38 PM
The best thing about
Anne Lamott's Bird by Bird:
Some Instructions on Writing &
Life is, even when the thought of sitting down and writing is
about as appealing to you as root canal work, she inspires you to
want
to write. That alone is worth the investment. The book is full of
mostly well-established wisdom about the art of writing, but it's
written intelligently and with great humour and passion. She really
practices what she preaches.
She takes you through the standard rules: Write every day at the same
time, always write something each day, no matter how brief, or how
hard
it is; break the job into manageable tasks ("take it bird by bird");
start with short assignments and "shitty first drafts" that just get
everything down, and edit later; avoid perfectionism; write about what
you know; use your own authentic voice and style; use index cards as
reminders, phone friends and experts to
get background material you need quickly and authentically, and use
writing groups and trusted readers to keep you going and honest. She
explains how to deal with writer's block, agents, publishers, and
jealousy of other (successful but clearly inferior) writers.
What I liked best about the book were some of the humbler, lesser
known rules of good writing:
- Stories tell themselves through you, so it's critical to
find means to silence the noise in your head and let them come
out
- Flawed, hopeful narrators are great voices, and points of
view, from which to tell your story
- Plot need be nothing more
than the discovery of what each of your characters cares about,
revealed vividly and continuously
- Characters must show
strength or courage to be sympathetic
- Dialogue must be
authentic and individual, yet concise and fast-moving
- Good
writers must be observant, reverent, and even startled by life and its lessons
- Great stories
are about great truths, things the writer
cares passionately about that come out in the writing: "To be a good
writer you not only have to write a great deal, but you have to
care."
- You must trust yourself and your intuition, especially
with first drafts, not self-criticize and second guess every
step
- You have to give the best you have always, not save it up
for the next story
- Writers have a duty to the reader to be
honest, to make
things clearer, to help heal readers' "gaping wounds and dazed
expressions", to soothe
The book includes an extraordinary 2-page story by the author
that
illustrates these and other points: It is charming, heartbreaking,
full
of surprises, imbued with the author's great love for two very special
characters, imbued as well with a bit of wonderful, spare, dialogue,
some stunning imagery and an improbable analogy. But mostly, the story
moves, and in so doing it
takes the reader along for the ride.
Until you can read Bird by
Bird for yourself, here are two quotes by other accomplished
writers about the art of writing:
"The greatest writing is done on the edge of what you know and what
you
don't know."
-- Beth Nielsen Chapman
"The skill of writing is to create a context in which other people can
think."
-- Edwin Schlossberg

Story Of A 419 Victim
Story Of A 419 Victim
11/03/2003 01:28 PMI still can't believe people fall for Nigerian 419 scams any more.
The scam has been around for ages, and I get about five such scam
emails every day. You have to have been living in a hole not to know
about them, but apparently there are still plenty of people (with lots
of excess cash to throw away) who fall for it every day. While
authorities estimate that the vast majority of 419 scam victims never
admit what happened (mostly out of embarrassment for their own greed),
it appears the press has found
someone in
Singapore who's willing to admit just how greedy he was. He fell
for a typical 419 scam, and lost about $200,000 (US) - some of which
he'd borrowed. He's now trying to sell his house. He seems to
realize how stupid the whole thing was - or, at least - his wife is
making sure he realizes: "My wife said I use the handphone so much
that my brain is damaged. I think she's right. She said my eyes can
see only the dollar signs."
