We all agree that convicted spammer Jeremy Jaynes is a nasty slime deserving of punishment for his daily 10 million spam emails fix. But now we're not the only ones wonde ring if a Virginia court went overboard on his 9-year jail sentence. Brian McWilliams says basically the same thing in his column, adding that not only is it excessive but also misguided and potential dangerous. The gist is of the commentary is two-fold: first, the overly stiff sentence puts him on par with violent criminals and completely ignores other forms of punishment, ie, he may not have to hand over a penny of his filthy lucre; and second, crucifying him this way is a good deterrent but will only martyr him and create a public backlash. Perhaps the lesson for prosecutors here is that you might serve the public better by seeking more balanced penalties. Maybe a tad less jail time, more commensurate with the crime, and a bit more repaying of the ill-gotten gains. Even better, throw in some community service, like forced service in the fight against spam. On a big scale, Mr. Jaynes and his ilk could help catch spammers or figure out ways to thwart them. Sort of the bad-hackers-turned-good approach. On a smaller and far more satisfying scale, we could make them clean up after themselves. Put them on Deletion Detail. If Jaynes had to delete spam messages all day, maybe we'd be more inclined to believe his pledge to reform himself.

Siemens Scale by Porsche

Siemens Scale by Porsche 09/13/2004 04:38 PM

siemens_mw_.gif imageIs it just me, or does it seem like F.A. Porche is designing everything these days, like laptops, and hard drives, and - oh hey - a kitchen scale. This Siemens-built scale looks nice enough, but nothing special, so it sort of dilutes the brand cachet, doesn't it? It's like that damn Ferrari laptop that Acer makes - if it weren't for the nice red paint job on that thing (well, and the badge) you'd never know it had a thing to do with Ferrari.

Oh, you guys need a code, don't you. There's one in this post.

James Dean died in a Porsche and boosted
sales; what about JFK, Jr. and Piper?
03/17/2005 03:24 AM

At the Ralph Lauren car exhibit at the Boston Museum of Fine Arts, which opens to non-members on March 6, a plaque next to a 1955 Porsche 550 Spyder contains the following:

"In September 1955 legendary actor James Dean ... crashed his new 550 Spyder and was killed.  This tragic event immortalized the Porsche name and transformed a relatively small company into a very big business."

So... if it worked for Porsche with James Dean, how come it didn't work for Piper when JFK, Jr. crashed his Saratoga?  If anything you'd expect the truck-like family man's 6-seater Saratoga to have fared better than the rear-engined Porsche, which was notorious for hard-to-handle oversteer.

[Don't rush down to the MFA to see this exhibit.  There are much more interesting car collections at a lot of the U.S.'s car museums, including the one 30 miles west in Stow, Massachusetts at the Collings Foundation.]

Spammer's Temporary Restraining Order

Well, that certainly was quick. Yesterday we wrote about the tempo rary restraining order against SpamCop from reporting any spam from OptInRealBig to ISPs other than OptIn's own, and today that temporary restraining order was dissolved, as it appears the lawyers for IronPort/SpamCop made a compelling argument that OptInRealBig wasn't telling the full story. The judge admits that: "The legal issues are more complicated than they originally appeared." The hearing on the case has also been moved up a few days and will be held early next week.

DealBITS Drawing: Matias OS X Keyboard

DealBITS Drawing: Matias OS X Keyboard 06/17/2005 05:46 PM
Adam C. Engst (~410 words)

A little over a year ago, I reviewed the Matias Tactile Pro keyboard, which uses Alps mechanical switches to provide a "clicky" feel that many people, myself included, really like. Now Matias has a new keyboard - the OS X Keyboard - that addresses two common complaints with the Tactile Pro. First, the Tactile Pro is relatively expensive at $99.95, whereas the OS X Keyboard costs only $29.95. Second, the Tactile Pro is rather loud thanks to those clicky keys, and some people (or their office-mates) find the noise annoying. In contrast, the OS X Keyboard, short of occasional clicks from its Spacebar, is far quieter. The OS X Keyboard also hides the seldom-used Caps Lock key down in the cluster of modifier keys to the right of the Spacebar (replacing it with a Control key above Shift), prints the appropriate symbols on the modifier keys in addition to the Option characters on all alphanumeric keys, and arranges the three volume keys (mute, up, down) in a line between the Help/Home/Pg Up row and F13/F14/F15. But (there's always a "but," isn't there?), the OS X Keyboard uses rubber dome switches instead of Alps mechanical switches, and as such, doesn't have nearly as nice a feel as the Tactile Pro. It's comparable to the Apple Pro Keyboard, other than a somewhat looser Spacebar. In terms of construction, it's white plastic, and is quite light; it doesn't have the tank-like feel of the Tactile Pro. Overall, the OS X Keyboard hasn't rocked my world, but it seems to be a decent, inexpensive keyboard that might be a good choice for anyone buying a Mac mini or looking for a backup or replacement keyboard.

About a year ago, in one of our earliest DealBITS drawings, we gave away a few copies of SmileOnMyMac's PDFpen software, which enables you to manipulate PDF files in a variety of ways. SmileOnMyMac has now updated PDFpen to version 2 and released PDFpenPro, which builds upon PDFpen by enabling you to create interactive PDF forms. Both programs let you merge PDFs, rearrange and delete pages, add text (for filling in non-interactive forms) and graphics (such as signatures), and more. PDFpen 2 improves the program's performance and adds the extremely useful capability of searching for, selecting, and copying text from PDF documents. Macworld gave PDFpen 4 mice in a recent review.
