This whole website and philosophy is predicated on the premise that theft occurs when the thief denies the victim the use of the object. NOWHERE DOES the laws of these United States makes that distinction. Theft is defined as taking or using someone's property without their permission. Period. No judge cares if you put it back or if the victim will miss it or not. Second, It appears that there are laws in most American states about logging on into networks (wireless and otherwise) without permission is clearly ILLEGAL. Anybody who thinks that their wireless pda/laptop just passively recieves the signal ONLY, is either dellusional or UTTERLY IGNORANT of how network works. Your pda/laptop sends requests for data to the wireless network, exchanges information with the network (it's called a handshake) and YES, BECOMES PART OF THE NETWORK (A NODE) ....ILLEGALLY! Why? Because it's all done with the owners permission. It is irrelevant that you are physically not on the owners property. You are still logged onto the owner's network. For all the simpletons out there still in denial, it's like going to a lampost and taking juice from it. NOTHING IN LIFE IS FREE! Signed The XODUS

The FCC has determined that there is no right to privacy over radio frequencies, and that a user is free to access any radio frequencies available to them. Remember the big ugly satallite dishes of the eighties? It was left to the satallite service owners to scramble the signal and then sell the technology to descramble it. Bootleg descramblers constitute a "Theft of Service", and is prosecuted under civil law. The only problem with this legal theory is that the warchalkers aren't just recieving a signal. They are transmitting one as well via another person's connection. This leaves tracking maliscious code generators an impossible task, because the FCC and the FBI use the generator's ISP to track and enforce applicable laws. The most logical step to address this concern would be to legislate, that if a Network Administrator choses not to provide security for access to the internet by unauthorized persons, then the organization that allowed the access will be legally liable for any harm caused by such failure. In a nutshell, it's the ISP subscriber that should be responsible and liable for all use of the internet via thier connection. My qualifications for these statements are a Bachelors of Law degree, and the current pursuit of a degree in IT Security. Thanks for your interest.
