Guilty Until Proven Innocent For This
ISP
09/02/2004 05:50 PMAn ISP in the UK has decided that all these legal processes with
takedown notices and figuring out who's sharing what with whoever else
is just way too much work. Instead, it's much, much easier to simply
declare
everyone guilty and block all P2P traffic, unless you come begging
for it with a very, very good reason -- at which point they might
allow you your P2P license, and let you use P2P applications. Seems
like a good way to encourage people to go check out the competition.

Innocent Love of a Dancer
Innocent Love of a Dancer
04/15/2005 04:40 AM
Dancer of Sunjung
(sungung means innocent
love in Korean) is a Korean movie currently in production which I
am looking very
forward to. It's a story about a young dancer from Yanbian
competing in a Korean
ballroom dance contest and finding love. I hope it's as
enjoyable as the original
version of Shall We Dance was.
Goonyoung
Moon, the young leading actress with a thousand cute faces, is
one of my favorite
Korean actresses. Here is one of the thousand that makes me
laugh everytime
I see it.
Yanbian, fyi,&n
bsp;is a
Chinese prefecture bordering Russia and North Korea which is
heavily populated
(~40%) by descendents of Korean origin called Chosun-jok.
Enough Koreans have
lived there for long enough to even have evolved their own accent
which is faithfully
reproduced in the movie.
I would love to learn ballroom dancing but I've had only about 5
ballroom dancing lessons over the
past 20 years because I just don't enjoy the way ballroom dancing
is taught traditionally:
too much focus on steps and not enough on how to weave them
together into a dance.
As it is now, it's as bewildering as learning to program in
assembly language although
I've been known to spin girls confidently (and unfortunately
uncontrollably) on the
dance floor given enough drinks under the belt.

BitTorrent: Guilty Until Proven Innocent
BitTorrent: Guilty Until Proven Innocent
03/25/2005 07:27 PMWhile BitTorrent certainly is used for unauthorized sharing of
content, it's increasingly being used as a legitimate distribution
mechanism. While it unfairly gets lumped in with things like Kazaa
and Grokster, BitTorrent is just a protocol. It's like blaming FTP or
SMTP for file sharing -- and both certainly are used to share
unauthorized files. However, because BitTorrent is considered P2P
some less than clueful folks seem to think it must be illegal. This
leads to bizarre situations where
students are losing their network access for "illegal P2P
activity" when no illegal activity occurred at all. Instead, the
school's IT folks seem to assume that BitTorrent, by nature of being
P2P can only be used for illegal acts. I'm assuming they'll be
banning FTP next. The school
could claim that they're banning
it due to the traffic, but they specifically pointed to the legal
issue, suggesting that all of those entertainment industry subpoenas
appear to be making some universities a little trigger happy on
yanking internet access.

Brain Fingerprint Says Convicted
Murderer Is Innocent
Brain Fingerprint Says Convicted
Murderer Is Innocent
02/17/2004 04:58 PMIt's been over a year since we last
mention
ed the debate over "brain fingerprinting" - a technology for
reading someone's brainwaves to see if their brain has the information
stored. In other words, if you present some bit of info that only a
person involved in a crime would know - their brain fingerprint would
indicate they knew it. This is, of course, very controversial and not
everyone is convinced that it really works. The debate should rise up
again, now that a convicted murderer on death row has been given a
brain fingerprint that
shows he does
not know important details about the murder. Of course, it does
make you wonder if someone involved in a particularly horrific crime
(as this one appears to be) might black out the memory of the crime to
the point that such a brain fingerprint would come up negative.

Durst Admits to Killing, Still Found
Innocent
11/11/2003 06:50 PM Robert Durst Admits to Killing but is found
innocent because the jurors didn't think the prosecution proved
beyond a reasonable doubt that Durst intentionally murdered, cut his
ex-friend up and then threw the body parts in a lake.
I'm sure the fact that he's got like $9 billion had absolutely nothing
to do with it.
But since he's got a history of killing, I suppose they'll just wait
for him to "accidentally" kill someone else and then try to
dispose of the body without getting caught.
But isn't an accidental killing still prosecutable? Isn't the fact
that he admitted to chopping the body up and throwing it in a lake
prosecutable?
Are you wondering what ever did happen to his wife too?

Maher Arar: terrorist? Innocent computer

Maher Arar: terrorist? Innocent computer
scientist? It's who you know.
11/06/2003 11:10 AMMaher Arar -- a dual
Canadian-Syrian citizen who operated a computer consulting business --
was arrested by US officials during a stopover at New York's JFK
airport, then and deported to Syria by the US government. The FBI
flagged him as a "suspected terrorist." After year of torture in a
Syrian prison (he describes having been beaten with objects including
shredded electrical cables, and living in a urine-filled, rat-infested
3'x6'x7' "grave"), they seem to have decided he was innocent, and safe
enough to ship back to Canada.
From Joi Ito's blog:
Obviously, it's probably easier for a Syrian national to get on a
"list" than a Japanese, but this really scary. They say he had had a
relationship with another suspected terrorist who is also being
imprisoned and tortured now in Syria. He says he barely knew the guy.
So what does this mean for us? If we meet someone, we should not
"become friendly" with them until we are certain that they are not a
suspected terrorist. What does this mean? We need to make sure they
don't hang out with other suspected terrorists. So if you believe in
six degrees, it's likely at some point you will be a suspected
terrorist.
How do they know if you hang out with someone? Friendster? LinkedIn?
Your email? We need to be VERY careful about the privacy of not just
the content of our communication, but the privacy of who we are in
touch with, often called sigint, or signal intelligence. Seriously
though, this will cause a chilling effect on meeting, calling,
emailing or otherwise "being in touch with" anyone who you don't know
very well that could land you on the "suspected terrorist" list.
Among questions being raised by Arar's advocates: why was he deported
to Syria, notorious for violating the human rights of prisoners,
instead of being returned back to Canada -- where he lived, and owned
a technology company? There are now calls for an open investigation in
Canada -- and in the US.
Here's a link to one article in which Arar describes
his imprisonment,
Another in which his Canadian citizenship is said to
have prevented more severe torture, and
here's a link to the Google News search.
