David Pescovitz: The Federal Government is fighting to block members of a small Christian sec in New Mexico from ritually drinking a psychedelic tea. In November of last year, the 10th US Circuit Court of Appeals affirmed an injunction against the government's enforcement of the Controlled Substances Act and the United Nations Convention on Psychotropic Substances. The sacred tea, hoasca, contains dimethyltrptamine (DMT). Now, the Bush administration is appealing the Supreme Court to overturn the ruling. From Legal Times:
O Centro Espirita was founded in Brazil in 1961. The tea, hoasca, which in the Quechuan Indian language means "vine of the soul," "vine of the dead," and "vision vine," comes from the Amazon rainforest. Members drink the tea at least two times a month during ceremonies. Approximately 130 members of the church reside in the United States, 8,000 in Brazil.

Brazil, a member of the international treaty at issue, has exempted hoasca from its controlled substances list.

But the Bush administration claims that no such exemption should exist in the United States.

The 10th Circuit's ruling is grounded in the federal Religious Freedom Restoration Act, which protects individuals from governmental interference in the exercise of religion. Congress passed the act after the Supreme Court, in the 1990 case Employment Division v. Smith, affirmed Oregon's prohibition on Native Americans' use of peyote and marijuana for religious purposes, ruling that the First Amendment free exercise clause afforded them no protection...

Under the RFRA, the government must show that it has a "compelling governmental interest" in restricting the religious practice and that the interest is fulfilled in the "least restrictive" way. The 10th Circuit ruled that the government had not proved that use of the tea, which contains 25 mg of DMT per typical serving, would lead to adverse health effects or abuse of the drug outside of a religious context.

Yesterday we noted that the MPAA and movie theater owners were whini ng about how much people coming in an taping movies was hurting their business. The obvious response, we pointed out, is to recognize that going to the movies is a social experience. It's not just about the content (though, that is important), but the overall experience. If they improved that, then people would want to go -- even if they could score the same movie off the internet or a cheap DVD bought off the street. While the folks in Hollywood refuse to entertain this idea, someone (anonymously) in the comments to that story pointed to an article in China noting that this is exactly what Chinese movie theaters have done. After years of declining attendance, they finally shaped up and made going to the movies cool again. They improved the overall experience, putting in better equipment and more comfortable seats. They improved the sound and the lighting as well. It sounds like they also made some theaters to be more like bars, to help attract young adults away from traditional bars. Yet the supposedly "creative" movie people in Hollywood insist "nothing can be done" to get people into the theater.

Other super-cool features, not yet widely available, include the ability for me to 'quick-book' just-in-time meetings directly via a chatbot, handily available on my Jabber buddy list... neato! One-line command (indeed one-word command) does the trick, and then I've got a URL I can broadcast to my buddies to join the meeting with one click: no downloads, no installation, no setup, and way simpler than Breeze-y stuff, though based on the same underlying technology.

Hmm. This day has not begun well. I tried taking a new route to work today. It turns out to be far slower than anticipated. So I arrived at about 9:27am for my 9:30am meeting. The meeting that was marked "Location: TBD" in the invitation. I dock the laptop (twice--the first time it decided not to see my USB mouse, as it often does). Check mail. Nothing from the person organizing the meeting. I look him up on our Intranet....

I was at the Atom Community Meeting all day.  I had only two hours of sleep so my brain pretty much stopped working by late afternoon.  There were some good moments but, overall, it was another reminder of how a meeting can turn smart people, including me, into babbling tiredsome geeks.  Communication wasn't clear and instant understandings were rare.  Of course, my brain's capacity diminishing by the hour didn't help.

Re W3C and IETF, W3C clearly lost their bid for Atom although they made good efforts at the meeting.  I thought what W3C reps said were a bit on the cheesy side but I wasn't entirely happy with the IETF process either, like IETF WG having to use WG mailinglist for all communique and how IETF WG chairs are chosen by a IETF director.  As amazing as it sounds, IETF stunk of bureucracy, albeit one with a geeky twist.

Having to choose between techno-bureacrats and cheesy geeks financed by companies doesn't make me happy but I gave my IETF 'humm' to techno-bureacrats.  I sure hope they don't evolve into techno-rats.

I encouraged formalizing of the Atom 'group' to streamline the syndicated data standard extension approval process, but I don't think it will happen.  Neither IETF nor W3C handles extension approval process well IMHO.

BTW, Tim's post has a nice group photo he somehow managed without his glasses.

People have been pinging me about this, so I guess I should post something about it. I'm not going to Davos this year. I wasn't invited this year. Not sure exactly why... But I'm in pretty good company... Anyway, I posted some thoughts on the Forum over on Omidyar Network which I'll post here as well.

This may sound like sour grapes, but I didn't get invited to Davos this year, but after going for 4 years, I was also planning on possibly not going. It's great fun meeting old friends, but I'm finding many of the smaller conferences more interesting these days. A number of people I know are going to the World Social Forum this year instead. Having said that, I'm sure something will happen this year that makes me wish that I was there. Please say hi to everyone for me.

Joi, thanks for your insight. I'd be curious about your thoughts in terms of collective: has the WEF been a mechanism that enables actors to work more intelligently and in partnership across sectors? this is something i've been longing to understand better; there is a sense among participants at places like the World Social Forum that the WEF is exclusionary and serves only the interests of the multinationals. What seems most vital about the forum is the capacity to pool intelligence and coordinate action in a way that reduces global risk. is this happening?

I think that a lot of the good things that happen at the forum on not intentional and not visible. It's bridge building across sectors. Although the forum has tried to be more and more inclusive, I think it has shifted away from its humble, somewhat academic roots to a conference where there is more participation by powerful people. Also, there is the official program, then there are special groups (like the Media Leaders group I spoke to last year) and then there are secret meetings. In many ways, it is more of a meeting place than a "movement" with something concrete to accomplish such as the WTO or G8, although I've never been to either.

I would disagree that it "only serves the interests of the multinationals" but it does have sponsors that allow it to exist and they obviously get special treatment and access. Having said that, the social entrepreneurs, for instance, include many legitimate social entrepreneurs who are doing a lot of great things that the forum enables in many ways.

So net-net, I would say the forum is a good thing, but I think your mileage may vary.

Finally, I would add... looking at the various lists of people who get invited and un-invited... the process, from my perspective, is close to random, athough there are clear biases. If you've never been invited, don't worry about it. Many many important and interesting people have never been invited. If you get invited and you've never been, give it a go, especially if you don't have to pay. If you go for a few years and get tired of it, you're not the only one.

Oulu meeting

Yup. The Oulu meeting is over, and - if you do some creative maths, and have a very strong sense of denial - it was an enormous success. We had 67% more people coming than we were aiming for!

Well, okay, there were five in total, out of which only three actually lived in Oulu. But the original target was just to meet pnuk, so we were positively surprised to see Falmawen arrive with a very large backpack and a short-haired companion, which had apparently tagged along from Turku. But he was a blogger, so it was okay :-).

The discussion ranged from blogs to movies, from certain bloggers to some other bloggers (wouldn't you all like to know who they were...), from food to beer, and a few mentions of the upcoming Finnish Blog Awards... The evil scheming and plotting is afoot.

All in all, good fun. There are still so few bloggers over here (and the Pinseri Top-list being the combining factor) that we can still - to some degree - speak about a Finnish blog community. This will obviously wane away as more and more bloggers join in (and I am sure some would already argue against it), but so far, from my personal experience, it seems that there is a connection between bloggers. It may be because many of the bloggers share things like common interests, similar education, or just the fact that if you're a blogger, your friends stand a better chance of catching the illness as well.

However, my hope is that in the future we get far more varied blogs - senior blogs, junior blogs, activity blogs, journalistic blogs, publicist blogs, celebrity blogs... And this will eventually mean the disappearance of that feeling. Oh well. I think I'll still have variety over a blogistanic feel-good hug-o-sphere anyway ;-).

BAMF.jpgI went to my first Bay Area Mobile Forum meeting yesterday - as I consider it crucial to have mobile devices part of the digital lifestyle aggregation scenario.

It's ugly.

It's fucked up.

Lord help us if it gets any worse. Verizon (despite their Cory Doctorow look alike campaign) are stone fascists. This is gonna catch up with them soon enough.

Ray Rischpater from a company called Rocket Mobile was there to fill us in on the gory details fo something called BREW. STAY AWAY! is all I can say.

Meanwhile Russel Beattie and other experienced mobile nerds grokked what they needed so that they could understand the motivations and issues surrounding BREW.

As bad as it is - Verizon alone has 40M BREW phone subscribers and that means money. There's lots of money to be made out there with BREW.

And Oil, and the military industrial complex. And slavery - too.

But I met some coolio peeps too. One who's got a coolio new aggregator coming - who didn't want me to say anything about it so.....

OK, so I am at this blogger meeting. So far the discussion has ranged from sex to tool purses (?). And especially tits. To be specific, the left boob of a particular blogger (who shall remain anonymous until she confesses.) I guess this is fairly typical then :). Well, as long as the beer keeps flowing, and the discussion keeps become more interesting - what do I care?

The turnaround is about 10 bloggers, which is about expected. At least the following blogs are represented: SchizoBlog, Pala maailmaani, MitVit, Shrike's Time Tomblog, Kari Haakana, KatjaW, Nea, Haltia, Luksus, and ButtUgly.
