News from the oral argument in the Grokster case yesterday is quite good. The argument on our side of the debate was excellent. Sex.com Case Denied Appeal Again

Sex.com Case Denied Appeal Again 03/31/2005 11:13 PM
Could it really be that the infamous Sex.com court case is finally over? We've been following the case since 1999, but it really started a decade ago when Stephen Cohen forged documents to have the domain transferred to him. That set off quite the legal saga, eventually leading to the domain being transferred back to its original owner, Gary Kremen, along with a ruling that Cohen owed Kremen $65 million. That's when things started to get more bizarre. Cohen high-tailed it to Mexico, and started a series of odd appeals, including one where he claimed that the ruling was unconstitutional, since it would effectively make him a slave to Kremen. He also claimed that he trademarked Sex.com in 1979, which no one seems to buy. The Court of Appeals has now turned down his latest appeal, and it's likely his decision to leave the country didn't help matters. In the meantime, Kremen went on to successfully sue Network Solutions for handing over the domain name in the first place, so he's made some cash out of the ordeal. Still, the case might not really be over yet, as Cohen plans to appeal again to the Supreme Court -- though, it seems exceedingly unlikely that they'll agree to hear this case.

Appeal for Broadcast Assassins.. 02/17/2004 07:50 PM

Public service announcement: Basically the BBC is doing a session in a couple of weeks (March 8th) in London exploring the impact of new technologies on viewing / listening behaviour and they're looking for volunteers to come and spend the afternoon with some key managers from around the organisation (or something like that). I don't have a lot of details about the project, but I think there's a nominal contribution for the day and people who participate will be doing something good and positive both for the BBC and for all of us who end up consuming stuff that the BBC produces. If you're interested in participating then you have to fill in and return th is questionaire as soon as humanly possible. Unfortunately, I can't attend as I work for the BBC (annoying but true), but I'd be interested to hear how people got on...

Microsoft needs geek appeal

Microsoft needs geek appeal 04/26/2004 10:10 AM
I thought I had a pretty good handle on the differences between the open-source community and the traditional proprietary approach to software development. But watching a Microsoft spokesperson defend his company and its whole approach to business in front of a room full of Linux zealots last week helped crystallize the gulf between the two camps--not just in business strategy but in fundamental philosophy and political bent. First off, Microsoft deserves some credit for actually attending the panel debate and addressing a pretty tough crowd--the Redmond gang would be hard pushed to find a less sympathetic audience than the faithful filling the hallowed halls of Linux Expo at London's Olympia.

Johannson on Trial for appeal

Johannson on Trial for appeal 12/02/2003 11:02 AM
It's the equivalent of "You can play the CD on three designated CD players that support the DRM. Like, it will play ONLY on xyz brand cd player and only three of those that you pick. Yes, you have to stick to that brand of cd player (the iTunes player, the supported OS of iTunes, no unix support in sight) and too bad if you have a fourth one in the bedroom. It's not gonna play in your second car's player either. Nor in the kitchen. Nor on your neighbor's player. Nor can you trade it on the used market when you're tired of listening to it. "
"They finally found a way to sell you some wind. Even better, they will restrict the direction and force in wich the wind will blow, how often and where it will happen..."

As "DVD-Jon" Johansen goes to retrial, a backlash is rising in the media & community towards Apple's DRM (digital rights management), a week after this same kid created an open-source program that lets users copy the songs that they bought onto other sources.
