Jeremiah writes "Amidst the public ballyhoo about how rampant P2P piracy is costing the music business its very life (gasp! NO!), BMI announced it collected a record level of revenue and royalty payout to its artist members. From their press release: "BMI has reported revenues of $673 million for the 2004 fiscal year, an increase of nearly $43 million, 6.8% over the prior year. Royalties of more than $573 million were distributed to our songwriters, composers and music publishers, an increase of $40 million or 7.5% from the previous year, and the most ever paid by an American PRO." Another interesting tidbit: "During the period 1995-2004, BMI had an average annual revenue growth rate of 9%..." If I read this right, BMI has been reporting solid growth over the last nine years, which makes me question the industry's claims about P2P. Either P2P ate into their growth (not mentioned), they found a way to cope with it (plausible), or it may actually help music sales. Whatever. Reminds me a bit of a spec I did for a life-insurance company's radio ad: Money , Money, Money (mp3 file)."

Web hosting costs money per gigabyte. Internet access costs money per megabit. Internet providers pay per sustained megabit to their providers, who do the same. So, I pay money to my ISP, who pays their upstream provider, who pays theirs and so on. Then I pay for my website and their pay their provider who pays theirs and so on.

Who is "and so on"? Who has all my money? Who the hell is making out like a bandit on all this stuff?

This isn't a particularly new story. In fact, over a year ago, we first mentioned that much of the money in New York designated on phone bills to go towards E-911 service was actually going towards things like winter boots. Now, the NY Times has picked up on the story and notes that only $30 million of the $440 million people thought they were paying for a modern 911 service has actually gone to that purpose. While many areas still are not prepared for the new system, the state insists that E-911 systems will be up and running by the year's end. Of course, the problem isn't just that E-911 systems aren't ready, but that people were told they were paying this fee for 911 systems. If the money was supposed to be going for winter boots, why didn't they add a "winter boots" fee line to mobile phone bills?

Whether it was Joi Ito or Barak, 6A certainly knows how to spend that VC money. Eve ryone is talking about it and it's not even 9 AM yet here in PST zone. The purchase of LiveJournal is truly a remarkable thing.

I can think of ONE social networking investor/entrepreneur who is pissed he didn't get the deal. He tried several times to contact Brad Fitzpatrick - but I guess he's not Joi Ito.

Somewhere in this deal - this imaginary conversation happened:

BRAD: "So what are you gonna do with our end-users?"

Michael Sippey: "They'll start using TyupePad - cause we'll tell them to."

BRAD: "Maybe they don't WANT to use TypePad. It's not LJ, it doesn't have the social networking aspects and quite frankly - they're HAPPY with LJ."

BARAK: "Yes - but since we'll own you, we can do whatever we want with your end-users."

BRAD: "Well then fuck you - I'm not gonna do the deal."

DAVID HORNIK: "Fine - then how 'bout $10M? How does that sound?"

BRAD: "Not enough! I want $20M."

JOI: "Come on Brad, I'll give you honorary status on my IRC channel - we'll laud you everywhere you go and we'll move you to San Francisco."

BRAD: "what about my peeps? What's gonna happen to them?"

MICHAEL SIPPEY: "We'll put them into the back room - they'll be happy programmers or else we'll just dump them."

BRAD: "OK make it $25M - but stash my money into an off-shore account and don't let anyone know. I want to announce that we sold it for $3M. Shhhhhhhhh."

or something like that.

Thsi is truly an amazing deal.

Brad has been insular, narrow minded, not willing to listen to others or do any deals - and now this. Wow - talk about a turn around!

But he's smart to grab the money now. I just don't see how he has the power to change, move, manipulate or really offer up his end-user base. As noted in Techdirt - these folks aren't inclined to pay.

Now Brad has dropped 100 balls on how to figure out how to "milk that tit" - so now let's see if 6A (and Andrew Anker) are any smarter.

I bet they are.

Finally if you read what Om says (and believe it):

Live Journal has been in talks with several other possible acquirers, though Six Apart is more of a natural fit. My sources tell me that all Live Journal employees are going to be retained.

Then at least the LiveJournal employees are safe. Now the question is "what about the LJ end-users?"

Regardless there are a few things now clear:

- if you want to leak something - go to Om Mailk
- VC money works
- Andrew Anker has found the right place for himself - and his buddy David Hornik is the envy of the VC world
- and the power and aura of Joi Ito is confirmed.

Now I just wanna see what Micahel Sippey is all about. We still don't have WYSIWYG editing in MT and my GOOD friend Anil is all promises, but no action on.....

Well I'll just leave that blank and we'll give Anil the benefit of the doubt. It looks like he's (and the rest of 6A) have been busy.

But last I looked CEOs get the credit for deals like this - so my 25 year friend Barak Berkowitz (I first met him in NYC in 1980) gets the shout out "DUUUUUUUUUUUDE".

This one goes into the Shameless Hall of Fame: Some of the lawyers who sued Microsoft for its predatory behavior against California customers are doing their best to fuel the public's contempt for the legal profession. They're asking for more than $250 million in fees, as the AP reports today -- "about $3,000 per hour for one lawyer, more than $2,000 an hour each for 34 other attorneys and $1,000 an hour for administrative work." This is beyond absurd. We get ripped off once by Microsoft, and now the lawyers -- whose deal with Microsoft gives precious little individual customers -- are bellying up to the trough in ways that would embarrass anyone who had an ounce of shame. The judge in this case should say no. Give the lawyers a reasonable fee, not this grotesque lottery score. It's the customers who deserve most of that money.

Ad Age (reg req): Sony Pays $25,000 a Month for Gawker Blog. Sony Consumer Electronics e-Solutions Group is the exclusive sponsor for the launch of LifeHacker, a blog that goes live today about the software of personal gadgetry by Gawker Media, according to the online company. The deal, which also includes placements on Gizmodo, Gawker's earlier gadget title, will cost Sony in the range of $25,000 a month, according to a source close to the deal. The sponsorship runs for about three months.
Well, there go the pay scales at Nick Denton's company...
I'm not nuts about the sole-sponsor ad model, but it's obviously going to be a wave of the future in personal journalism.

Lo ic also said that John Battelle mentioned in Davos that Boing Boing was making between $20k-$30k a month.

That's serious money. No wonder Jason Calacanis is complaining. He ain't making it.
