News</i> that Google, after its Gmail debut, does not hold legal
rights to the trademark, yet.
Normally, the registrations for trademarks are handled in a
"first come, first served" basis and in this case, Google is
in fact, the fourth in line. Who gets it first? Cencourse, a Miami
company that provides multimedia services has filed the application on
the same day that <a
href=http://www.neowin.net/comments.php?id=18716&category=main
target=_blank>Google spilled the beans on Gmail</a>.
The first applicant, Cencourse, filed the application on March 31st.
Precision Research jumped in on April the 2nd, following by the
British market research firm, Independent International Investment
Research (IIIR) who filed the application on the next day. Google
didn't make a move until April 7th.
IIIR is the only company out of the three that contacted Google about
the dispute. The company's CEO admitted to operating a service with
similar name since 2002 and filed the application after hearing about
Google's service.
"Having invested in making our target market aware of our
service, we wish to avoid the confusion that would inevitably arise if
a much, much larger firm were to brand its service indistinguishably
from our own," he said.
It is likely that the dispute will be heading to court where Google's
attorney holds confidence in victory. One could only imagine why the
trademark ownership hasn't been taken cared off before the service
gets announced.

Google Watch project has put up a page about Google's Privacy
Policies. They point out that Google's persistent cookie (it expires
in 2038) can be used to track Google users. I've refused Google's
cookies for a long time for this reason. It's annoying because Google
forgets my language and SafeSearch preferences, but since I search
Google for so many things I'm especially concerned about my privacy. I
wish Google would switch to a cookie that only stored specific
preferences, rather than identifying information. I hope Google will
respond with the reasons for their current cookie system. [Finally, a
note on the weblog format. I feel safe in publishing negative comments
like this because I know that most if not all readers check the site
periodically, so there's little chance of someone getting incorrect
and not seeing the correction.] Interestingly, they point out that
Matt Cutts, a Google employee, spent a year at the NSA. Food for
conspiracy theorists....

Privacy Problems. My thoughts: The cookie is a serious issue. Google
assigns everyone who visits a cookie that uniquely identifies them to
Google for all time. There's very few legitimate reasons to do this,
and they certainly don't outweigh the harm done. (Google could easily
assign a cookie that only contained your preferences and not a
personal identifier.) Logging is also an issue. Actions by the current
US government make it clear they don't care about privacy, and it's
very likely that they've convinced Google to hand over full logs of
who is searching for what. I think the bit about hiring spooks is
silly, just working at the NSA doesn't ruin you forever. The toolbar
asks in bright bold red letters if you really want Google to phone
home about every site you visit. Obviously you should answer no if you
like your privacy. Google could probably improve things by letting you
press a button to look up the PageRank for a page, rather than always
doing it automatically. I like the cache copy. Putting stuff on the
Internet makes it public; get used to it. I think most people agree
the sites penalized by Google deserve it. If you think your site was
penalized unfairly, let me know, and I'll spread the word. On the
other hand, I think Google should publish their block list and
algorithms. Conclusion: Google needs to stop sending the cookie and
promise to only store aggregate data, with no connection between users
and search terms. This issue was publically raised almost a year ago;
that Google still hasn't dealt with it is inexcusable....

optional to use. It appears that enough people (probably including
those at Google itself) sat down with State Senator Liz Figueroa to
explain how email works, and have convinced her to
tone down
the bill so that it now allows Gmail. That's right, the
anti-Gmail bill now has loopholes that specifically allow Gmail. In
other words, Senator Figueroa seems to have realized just how
pointless the bill was in the first place and is trying to save face
by adjusting it so that it still seems to have a purpose: banning a
bunch of things that no one was doing, like having humans read the
content of your emails to put in advertising.

on intellectual property issues. Their latest move is to send out
cease-and-desist letters to sites that host fan fiction -- not because
those made up stories use characters, places and themes from real
movies -- but
because
they use the (trademarked) MPAA movie rating system. That's
right, if you happen to label your story as rated G, PG, PG-13, R or
NC-17, you'd better watch out, the MPAA might come after you. Of
course, they seem to ignore the fact that this system has become
common around the world, is
hardly taking anything away from
the MPAA's own system (if anything, it
enhances it), and also
is useful in keeping age-inappropriate stories off the screens of
those who shouldn't see them.

high school student named Mike Rowe because his web site is
mikerowesoft.com and he refused their offer of $10. Ten dollars! I
know it sounds cheap, but you have to remember that these are ten
American dollars. You have to sympathize with Microsoft: Tons of
people are going to end up on Rowe's site by mistake simply because
they typed every letter after the "i" wrong. By the way, I just

advertisements based on the names or trademarks of their competitors.
We've already explained why
should
be perfectly legal under trademark law (which doesn't prevent all
use of a trademarked term - just any use that is seen to be confusing
people into believing one company is another company). However, this
NewMediaZero piece points out that, even if it
is a trademark
violation, it makes
no sense
to go after Google, who is simply the publisher. If they must go
after someone, the complaining companies should go after those who
they are accusing of misusing their trademarks: the competitors buying
the ads. Of course, what this article leaves out is that the
complaining companies are upset that
Google appears to be
profiting off of their trademark by selling the ads. I wonder what
would happen if Google set up a "compromise" position where a portion
of the money that an advertiser paid for advertising on a trademarked
keyword went to the trademark owner?
