Remember the opening scene of StarWars movie that made you feel like a little bug under the belly of a huge beast?

When I was a child, I would take ordinary things around the house and examine them closely, not as one would look at it with a microscope, but looking at it like an ant or a fly might see while crawling or flying across it's surface.  What I enjoyed was the different perspective and its effect on me.  Mere dented pots and pans suddenly transformed into spaceships or spacestations, and those ugly dents on the outer hull had a lot of stories to tell.  Aside from my parents worrying about me spending hours alone with a frying pan in hand, it was magical times for me.

I wish I could do the same with products sold at e-tail websites or auction sites.  Unfortunately, not even quality static pictures of products are readily available.  Innovative e-tailers like Zappos are impr oving shopper experience but it's still far from my vision of satisfying shopping experience.

Is this a moneymaker?  I think it is for expensive products like Gucci bags.  If you see those bags very closely with lights glinting off each bumps in the leather texture, they look far more substantial than they really are.  3D model and texture database of products is also valuable IP.

Can it be done?  Definitely.  You will need even more high resolution textures than yet to be released Doom 3, but next version of DirectX will break open most of the limitations that made it difficult.

It won't be long before shoppers will be flying around the things they are interested in buying.  Hmm.  If you are a guy, wouldn't you want to hover across the surface of Planet Halle Berry?  Captain!  I am experiencing stronger than usual turbulence between her cleavages.

Yeah, yeah.  I know I am weird and I like it that way.

So the New York Times ran a magazine piece about Robert Greenwald's latest political documentary, OutFOXed. Stanford's CIS and the great folks at Fenwick & West have been advising Greenwald (pro bono) about how best to exercise his fair use rights in making this critique of FOX News. This clip gives you a sense of the issues we faced. And so you'll see how relieved I was to read Dianna Brandi's (VP for legal affairs at FOX) comment in the Washington Post: "People steal our footage all the time.... We generally sort of look the other way." I take it she's referring to the fair use by others of FOX's footage, and if so, then bravo FOX. Fair use, of course, is not stealing, even though lawyers who know better like to use that false description as often as they can. (But if she really means FOX footage is being stolen, then that's awful. Get better locks, Fox.) I actually knew nothing about FOX News before working on this film -- not much time for network news, and I had only ever heard Bill O'Reilly once, on Fresh Air. And while I came to the project with low expectations about any news network, I was still astonished. As you'll see when you buy the DVD or host a MoveOn.org house party, there's a lot to be amazed at. The most powerful is an amazingly unFAIR and unBALANCED clip with Jeremy Glick and Bill O'Reilly. Not unlike (but much worse than) the exchange Georgetown Professor David Cole described. (Washington Post). As the Times article describes, Greenwald's style for distributing documentaries may be the beginning of something new -- political criticism, using interviews and clips, making a strong political point, distributed through DVDs and political action groups. (See some other examples here). On what theory does he, and others, have the right to use such material without permission? On the free culture theory we call the First Amendment: Copyright law must, the Court told us in Eldred, embed "fair use"; "fair use" is informed by First Amendment values; the values of the First Amendment most relevant here are those expressed in New York Times v. Sullivan. As with news-gathering, critical political filmmaking needs a buffer zone of protection against the overreaching of the law. And if the potential of this medium -- now liberated by digital technology -- is to be realized, we need clear precedents that establish that critics have the freedom to criticize without having to hire a lawyer first. Watch the movie. Celebrate the freedom it represents. It is a particularly American freedom that we should celebrate and practice more often.

Any news organization that doesn’t support our position on copyright is crazy. Next week, we could take a month’s worth of video from CNN International and do a documentary “Why does CNN hate America?” You wouldn’t even have to do the hatchet job Outfoxed was. You damn well could run it without editing. CNN International, Al-Jazeera and BBC are the same in how they report-mostly that America is wrong and bad. Everybody should stand up and say these people don’t have the right to take our product anymore. They don’t have a right to take a year’s worth of Dan Rather or Ted Koppel and edit it any way they want. It puts journalism at risk.
If someone thinks CNN or Al-Jazeera is doing a bad job, they should say it. Using clips of news programming to criticize a network is totally game I think. Although news has become entertainment, I don't think it should be controlled in the same way that creative content should be. I think that fair use should be applied liberally. The press and the news media should encourage critical debate. I think that a network that has a monopoly on millions of eyeballs should be fair game for documentaries like Outfoxed.

Salon has a review of the new documentary about Fox news, called Outfoxed, which went on sale today and is now the 11th best-selling DVD on Amazon.
Take the network's "some people say" mantra (as used in my first paragraph, above). I had watched plenty of Fox News without ever noticing this -- it's a way of introducing commentary, and specifically the reflexive right-wing views of the presumptive Fox core audience, into what is supposed to be news coverage, while appearing to not quite endorse it. "Some people say that criticizing the war at a time like this is letting down our men and women in uniform," or "Some people say Richard Clarke is a political operative who's trying to sell books." (Or, yes, "Some people are saying that John Kerry looks French!" -- uttered with a peculiar mixture of consternation and delight. Gosh, what a weird idea! But now that you mention it ...!)

Bit Torrent and the ability to download everything in one click (is this the end of Direct TV, Tivo and the music business?!).

Used BitTorrent a little bit when it first came out and was a bit underwhelmed. It didn’t work, there weren’t a lot of places to find files, etc.

I decided to take another look at it when a designer friend of mine was telling me that he has the latest version of every single piece of design software on his Mac compliments of bit torrent (yes, I know it’s wrong… not the point I’m trying to make, the point is coming :-).

Part I: I installed bit torrent and immediately noticed an amazing new trend (prob. not new to all of you) of people posting dozens of albums in one RAR file for download. Huge file sizes in the 500 to 4,000 meg size range. The last season of seven seasons of Southpark, every Nirvanna album and here is another file with every Howard Stern radio show from March in one file.

In one click you grab one really well organized, clean and deep sets of files—scary.

Part II: A couple of month ago I got the Gateway Connected DVD player. For $195 it connects via WiFi to my desktop and I can hit the My Music or My Videos button on the remote control and pull up those directories on my hard drive (in the other room).

Part III: Today I moved into my new apartment in Santa Monica and was faced with the standard $100 month cable/dish bill and I’m thinking “dang, I only watch less then a half dozen TV shows and they are all here on bit torrent… maybe I should save the $1,200 a year and just download the shows and watch them via my Gateway Connected DVD player?”

The Point/Question: How soon before you’ll be able-with one click-download every prime-time TV show or last year’s top 500 CDs in one click?!

(Note: This is not a trick question, I have yet to find a file containing that much content—however, I did find a file with last weeks top 100 singles that someone put together in one nice package).

Hardy news site, The Register, recently published a detailed analysis of the file sharing protocol Bit Torrent. Bit Torrent has received attention in the main stream news after reports that it was carrying as much as 50% of all peer 2 peer (p2p) traffic, which in tern amounted to a massive 30% of all the traffic on the internet. The paper, by Dr. Johan Pouwelse, examines the protocol and looks especially at one of the largest bit-torrent hubs, Suprnova.org. Dr Powelse notes that the major problems facing hubs like suprnova are fakes and maintaining hub availability. The availability of files on bit torrent is based on a centralised system; without it, the network fails as users cannot access the trackers. Decentralising bit torrent has already begun - Suprnova have started a project called "Exeem" which apparently has 5,000 beta testers trialling it, and has an ultimate aim of taking the best of Kazaa (a decentralised network) and merging it with Bit Torrent. Decentralisation removes the issue of poor availability at the tracker end, yet0 it also provides more scope for fake files and a reduction in data integrity at the user end.

The paper concludes that bit-torrent needs to evolve to create incentives to users to seed files. Bit-torrent as a protocol is a system that’s here to stay; it enjoys more and more usage from more main stream content providers. Yes, there is a lot of illegitimate use of the protocol, but unlike Kazaa, these users should not be allowed to over shadow the usefulness to legitimate users of the bit torrent protocol.

[Update] Since this article was published, Suprnova has shutdown as a hub for torrents. Although this cannot be confirmed, the shutdown is very likely related to legal action from the Hollywood against tracker websites; earlier in the week many other sites were taken down. The effectiveness of the takedowns could be massive; the paper below notes that when on the Suprnova mirrors went offline during their monitoring period, they saw a massive reduction in the number of users downloading files through the site.
