Microsoft Corp.'s request for suspension of the European Commission's anticompetition decision and other interim measures will be heard in the European Court of First Instance (CFI) on Sept. 30. The date was set by the president of the CFI, the second-highest court of the European Union (E.U.), at an informal meeting Tuesday. The meeting was attended by lawyers representing Microsoft, the Commission and other interested parties, according to a spokesman for the CFI.

The law firms of Hinkle, Hensley, Shanor, & Martin, L.L.P., Lerach, Coughlin, Stoia, & Robbins, L.L.P., and Freedman, Boyd, Daniels, & Hollander, L.L.P. counsel for a proposed class of New Mexico consumers, and Microsoft Corp. jointly announced today that a settlement has been reached in a class action lawsuit alleging that Microsoft Corp. violated New Mexico’s antitrust and unfair competition laws. The settlement, which received preliminary approval on July 29, 2004 from the First Judicial District Court for the State of New Mexico, will make vouchers available to class members that may be used to buy any manufacturer's desktop, laptop and tablet computers; any software available for sale to the general public and used with those computer products; and specified peripheral devices for use with computers. The total amount of vouchers issued will depend on the number of class members who claim vouchers, and the maximum value of the vouchers that may be issued to class members will be $31.5 million.

Microsoft is preparing to go to court in Minnesota this week to fight allegations that it abused its Windows monopoly to overcharge customers in the state for its software. As part of its defense, Microsoft may call Bill Gates and Steve Ballmer to testify, the company says. Unless a last minute settlement is reached between the software vendor and lawyers representing Minnesota consumers, opening arguments in the case are scheduled to begin mid-week, Microsoft spokesperson Jim Desler says. The court has allotted three months for the trial, he says.
