John has submitted this somewhat disturbing, if not at all surprising, "anonymous insider's account" of a software company that is ramping up their patent efforts, after another company beat them in a lawsuit over patents, and the company began to realize just how valuable patents were in that sense -- if not actually for the purpose of innovation. The clear point is that patents do little to help innovation, often do quite a bit to harm innovation, but do keep the lawyers quite happy. Software engineers are told to come up with just about anything that might possibly be patentable, and the engineer in question does so -- coming up with nearly 20 patents in a matter of days. The engineer admits that all would be pretty obvious to any "competent worker in our field," but all were gleefully accepted by the lawyers. The engineer points out that these patents alone likely created over a $1 million worth of legal expenses -- money that is not being spent on actual research and development any more. Despite the fact that the "any competent worker" point should make these patents completely invalid the lawyers actively point out that the patent examiners aren't smart enough to know any better: "Look, if the examiners were any good they'd be in industry, so you don't have too much to worry about." Meanwhile, the engineer notes that all of the innovation in the industry seems to be coming from areas where there are no patents. It is just an anecdotal story, but, it's one that seems to be getting repeated an awful lot in the software industry. If the entire point of the patent system is to promote innovation, and time and time against the opposite has been shown to be true, why isn't anyone reforming the patent system (and, even worse, why are other countries making their patent systems more like ours)?

A federal appeals court has ruled that file-sharing software is in fact legal. The panel noted that file-sharing companies simply provide the software for individual users to share information. Therefore, they cannot be held accountable for what users share, be it a word document or copyrighted material.

While developers of file-sharing software are rejoicing about the federal appeals courts ruling, the RIAA and MPAA are steaming mad. This ruling has dealt a serious blow to the two industries, but they have vowed to continue the fight. They have urged a re-examination of the law, and will undoubtedly proceed with an appeal. However, they still face the same old problem : unlike Napster, new file-sharing networks don't have central servers where computer connect to access copyrighted material. This technique makes file-sharing networks like Sharman and Stream cast even harder to shutdown.

If this ruling had not gone through (i.e. the RIAA / MPAA won), several file-sharing developers would have had to face the possibility of further legal action. Right now, those file-sharing developers (Grokster Ltd, Stream cast Networks Inc. and Sharman Networks Ltd.) are in the clear. The situation is such that the RIAA & MPAA won't stop until file-sharing is a thing of the past : read - they'll never stop. Problem is, you can't shut down file sharing networks with legal action.

Trigger: Joe covered Trigger in a Friday diversion a few months ago. I got hooked on it and played it until my fingers bled.

The only drawback to the game was that the same old maps got boring. Well, version 5 has been released, and there are scads of new maps for downloading, as well as some guy who has written a program to generate six random maps every day.

Fun stuff. Now we just need more cars.

While the story linked here is mostly about yet another overhyped prediction saying that TiVo-like DVR devices are "a threat to commercial advertising," there are two interesting points that seem obvious -- but haven't gotten much attention in these debates. The first is that, while everyone figures out how to fast forward through commercials, some people apparently forget until a bad commercial comes on. In other words, they're fine watching a commercial that seems interesting, amusing or relevant -- but when the bad commercials come on, they realize they are wasting their time. The second point is that users of DVR's, while fast forwarding through commercials do tend to be paying close attention to what's on the TV, looking for "heavily branded screenshots" that indicate it's time to stop fast-forwarding. While this idea has been taken and tweaked to lead to TiVo' s popup ads during commercials, it does make you wonder if advertisers will start designing more TiVo-friendly commercials which would be heavily branded, even for people fast forwarding through. It might also mean that some TV shows could try a branded intro shot, with a statement along the lines of "Stop fast forwarding NOW!" which could also be sponsored by various brands -- though, that could annoy non-DVR using watchers.
