e Pencil by Henry Petroski, 354 pages that demonstrate
conclusively that at least one area of history has been
justifiably ignored.
It turns out that, before setting off for Harvard
College, Henry David Thoreau devoted quite a bit of time to
figuring out how to blend graphite powder and clay into a pencil that
could compete with the best English and French products. He and
his father were very successful pencil merchants in the 1840s.
As cheap German imports made the business less profitable the Thoreaus
moved into supplying graphite powder for electrotype printing.
In 1853 Thoreau's friends asked him why he'd stopped making
pencils. He responded "Why should I? I would not do again
what I have done once."

some company claiming a random patent concerning a business they're
not even in. In this case, it's a patent from the same company
that has managed to squeeze a ton of money out of companies by
claiming to own a patent on the compression of images used in .jpg
images. Now they claim they hold a patent on the concept behind DVRs,
thanks to a vague patent that talks about recording TV signals on
computers. Once again, you have to ask two important questions: how
is that non-obvious enough to deserve a patent? It was a clear
evolution of the technology. Second, why do we allow the patent
system to work this way when it's clearly not rewarding innovation at
all, but actively punishing those companies that innovate? Meanwhile,
with TiVo building up their own
patent portfolio, it looks
like we'll have yet another
paten
t cold war involving all of this nuclear stockpiling. At what
point do people realize that the system is broken? It's not
encouraging innovation. It's just making some patent lawyers
wealthier while taking money
out of research and development of
new, innovative products.

really matter. A group of (large) tech companies and movie studios
have now
teamed up to
create a "coalition" to come up with copy protection schemes.
Apparently, Cory Doctorow's speech about
why
DRM is bad for everyone hasn't had much of an impact -- even on
folks at Microsoft where he gave the talk. They're included in this
"coalition" that seems suspiciously short on smaller companies. It's
easy to see why, of course. Those smaller companies don't want to get
locked into some proprietary, expensive technology that doesn't work
well and only serves to piss off their customers. It's only larger
companies who seem to think that protecting obsolete business models
is more important than innovating and embracing new business models.

thinking. The latest, dug up by the always excellent WiFi Networking
News is the fact that someone has actually gone and
patented the
concept of using a redirect to force you to a login page when you
connect to a WiFi network. How is this possibly patentable? It
seems like an insanely obvious idea - and one that plenty of companies
use
because it's obvious - and not because they ripped off
someone's "intellectual property". The point of the patent system is
to encourage innovation. The point of this patent (like so many
others we've been hearing about recently) is to hold companies hostage
for doing something obvious.

claims to do background checks on its members (though, they don't
actually check to make sure the person is who they say they are) was
trying to
get
state politicians to pass laws requiring such checks or force
other dating or social networking sites to put a huge notice saying:
"WARNING: WE HAVE NOT CONDUCTED A FELONY-CONVICTION SEARCH OR FBI
SEARCH ON THIS INDIVIDUAL." This law is obviously completely pointless
other than to try to make life difficult for the competition of this
one tiny dot com dating site. However, it appears that a number of
clueless politicians are buying it, and
just such a law is moving forward in a
number of states, with Michigan leading the way. What's amusing
(though, in other ways, scary) is the rationale one of the Michigan
sponsors is giving: "There are inherent dangers in the whole area of
the Internet. Something needs to be done." This seems like a fairly
typic
al political response. Something isn't perfect, so a law
must be passed -- even if it will have no impact and (if
anything) likely make the situation worse, not better. Of course, for
the dating site that is pushing all of these laws, it's only going to
backfire on them if the law passes -- because then those other sites
will start doing background checks, and this site will lose its one
tiny, pointless differentiating factor. You have to wonder if they
pushed for the legislation with the belief that there was no way it
would pass -- but they were likely to get some press out of it. Now
what will they do if it actually does pass?
