12/15/2003 01:00 PMThese days it seems that corporate lawyers a pretty damn quick about
pulling out their trusted "cease-and-desist" letters for just about
anything - even if no laws have actually been violated. Wired News
has two such stories this morning. First, comes the news that Miramax
is upset about a site that
reviews
Kung Fu movies. They accuse him of selling a movie that they own
the rights to. The movie was originally released in Asia in 2002, but
will come to the US next year. The problem is that the guy who runs
the site doesn't sell any movies. He does
link to a site that
does sell movies, but that site stopped selling the movie in question
once Miramax obtained the rights to it. No matter to Miramax. When
confronted with this info, they defended the action, saying that they
needed to make "it more difficult for people to purchase these films."
That may be what the lawyers think, but it might not make the most
business sense. First of all, the type of people who will go out of
their way to buy such a movie from a foreign distributor are clearly
big fans, and are the
most likely people to go out and see the
movie on the big screen when it's released here. Now, all Miramax has
done is piss off the biggest fans of the movie they're about to
release. Second, there's nothing illegal about linking to a perfectly
legal site. Miramax is simply using their lawyers to bully someone
who has done nothing wrong (and, in fact, who is trying to help
publicize their movies). What Miramax considers "protecting their
intellectual property" certainly appears to be shooting themselves in
the foot from this angle. Meanwhile, the US Olympic Committee is
hitting back against anyone who
dares to
use the word "Olympics" to describe some sort of competition.
Again, this is going past the basic purpose of trademark law - which
is to make sure consumers of a product (or event) aren't confused to
believe it's from another company (or organization). In this case,
the folks behind the "robolympics" think it's fairly unlikely that
anyone is going to confuse their event with the international athletic
competitions held every few years. In fact, they point out that the
Olympic trademark only covers athletic events - and since their event
involves robots, it's not an athletic event.

introuced (and clearly inspired by Google's Web API) provides a
cleaner-than-Amazon interface to the same data. However, they recently
report that they've been asked to cease-and-desist by Google's
lawyers. The site was very much like Google's (screenshot) but it was
clearly in good taste. I'm not sure why Google is so testy about it.
Is a books.google.com coming soon? I wonder if they'll go after Whois

created some free software utilities for Plextor DVD recorders. Noé
wrote PxScan and PxView for Windows, while Zeb ported them to
GNU/Linux under the name PxLinux. The utilities send special
commands to the drives, activating their special features, such as
media quality checks. Unfortunately, someone wasn't happy with their
efforts, as the parent company of Plextor sent them cease-and-desist
letters accusing them of using "unfair commercial practices"...

The UK Consumers' Association is petitioning government to do
something about the fact that Apple gouges UK customers, charging them
far more than their US counterparts.
The CA has written to the UK Office of Fair Trading (OFT) explaining
the situation and highlighting that the current position is possibly
in breach of European law. Under Euro law all consumers in all member
states should enjoy the same benefits that the single market brings -
it's like if citizens in Seattle had to pay more for their iTunes
music than the rest of America. Clearly with a differential between
iTunes UK (79p, 1.15 Eu) and Germany & France (0.99 Eu, 67.7p UK)
there is not a level playing field. Those UK citizens who understand
that they can use either the French or German sites to order directly
on find they are charged the UK price if they are not able to supply
as an address in either of these countries.
Although the CA campaign is focused on iTunes, perhaps because of the
mainstream press attention it has attracted, Apple are not the only
service overcharging UK consumers. The differential on Napster UK is
even greater when comparing UK pricing at 99p (1.44 Eu) against 99c Eu
(67.7p UK). This becomes even more distorted when US prices are used
as a comparison 99c US = (55.4p). Clearly albums bought on the
services multiply the differential by a factor of 10 as the albums
cost ten times a much as single tracks.

Microsoft is out of ideas. (I liked this
cartoon of Chairman Bill, from Hawaiian
cartoonist John Pritchett.)
Microsoft spent the last year exploring lots of big business ideas.
I even pitched Always-On to some Microsoft executives. In the end the
company decided it had no worthwhile idea, so it's giving its profit
back to shareholders.
Microsoft brings in $1 billion worth of free cash every month, and
has set a $75 billion pay-out plan, including $30 billion in share
buybacks. This is all in an effort to raise its stagnant stock
price.
The result will be a higher price, but I guarantee you it will also
mean a lower price-earnings ratio. Microsoft has decided to become a
widows-and-orphans stock because it can't see any worthwhile way to
invest its profits.
Be afraid. Be very afraid. Because if Microsoft, with all the money
in the world, can't thnk of anything better to do with its money than
give it away, what does that say for the rest of us? What does it say
for the technology business climate?
