Apparently a DVD manufacture in Taiwan was producing DVD players which outputs could be recorded. The MPAA does not like it when companies push the boundaries that allow consumers to have fair use of the data that they buy. I suppose some naysayer will say hey you don't buy music you license it. Well semantics aside I feel everyone should be able to make a backup copy of whatever media they purchase.

If the MPAA and RIAA would replace ever CD and DVD that I have as they fail at no charge I would not care but being they would not consider that then I feel it is within my rights to copy DVD's I own and keep a backup copy. [dvd-recordable.org]

Today I ran across an entry on Dave Sifry's weblog that noted that Technorati was hiring. I went to Technorati's job page and found a job that looks like it was made for me, as good as the dream job that got away from me a year ago. Excitedly, I sat down and wrote up a cover letter, pointing out all the ways in which I would be a perfect fit for the job (and thinking about how much fun it would be). At the end, I debated how to include my resume. If Dave is processing applicants through a recruiter, they probably want resumes in Microsoft Word, which seems to be the only format that most recruiters can deal with, for reasons unknown to me. On the other hand, Dave is a longtime Linux geek. I remember that I've exchanged emails with him in the past. I check my email archive -- aha, my last email from him was written using Ximian Evolution 1.4. Better include my resume inline as ASCII as well, with a link to the online version of my resume, I think. So I send off my resume and cover letter and happily turn to other tasks. Half an hour later I check email, and do my usual quick scan through my junkmail folder. What do I spot but the cc'd copy of my cover letter and resume. I just started testing a new version of the Spamnix spam filter that added Bayesian filtering. Spamnix is a Eudora plug-in based on Spam Assassin. It decided that the email and resume that I sent to Dave was SPAM: SPAM: ------------------------ Spamnix Spam Report ------------------------- SPAM: Spamnix identified this message as spam. This report shows which SPAM: rules matched the message and how many points each rule contributed. SPAM: SPAM: Content analysis details: (5.4 hits, 5.0 required) SPAM: 5.4 BAYES_99 BODY: Bayesian spam probability is 99 to 100% Apparently words like Standards, Marketing, System, Proven, Global, Experience, President, Technologies, Product, Project, Manager, Director, Startups, and Software, which appear in my resume, are also common in the spam I receive. To some degree this makes sense -- resumes and cover letters, like spam, are a form of self-promotion. This is probably one of the reasons that I find job hunting painful, since I was trained to be modest about my accomplishments, and am shy by nature. But it creates...

Nearly a year ago, many were surprised when Toysrus .com sued Amazon.com claiming that their contract specified that the only toys on Amazon's site would be supplied by Toysrus.com. The complicating factor was that Amazon allows individual sellers to sell their own goods on the site -- and there was no easy (or reasonable) way to tell people they simply couldn't sell toys. It didn't take long for Amazon to think about the situation and realize they were probably better off dropping Toysrus.com altogether, selling toys on their own, and continuing to let independent sellers sell on the site. So, to try to get out of the contract, they counter sued, claiming Toysrus.com did a terrible job of picking the best toys and handling inventory management. While a judge granted an injunction to Toysrus.com last year and told the two sides to sit down and work out their differences, an appellate court has thrown out the injunction entirely and said Amazon can continue letting its sellers sell toys. The court says that the original judge on the case didn't actually consider the specific contract language that was in dispute -- which would be somewhat strange, if true. Either way, this clears the way for toy sellers to move back onto Amazon.com for the time being. Of course, what was silly about all of this was that there really was no benefit at all to Toysrus.com in doing this. If they kicked toy sellers off Amazon, they'd just go elsewhere (such as eBay or Overstock) and build up business on those sites.

Jon Asato sez: "Here's a story that caught my eye on GameSpot.com. Businesses in certain states are required by law to collect, among other privacy invasive information, the thumbprints of customers who want to sell their used video games, CDs, and books."
In addition to recording the drivers' licenses, telephone numbers, and addresses of customers who sell used games or consoles, some stores are routinely requiring thumbprints as well. Retailers are collecting the information under a law intended to regulate pawn shops and make it easy for law enforcement officials to track down thieves who fence stolen goods. A number of states have such laws, and Utah passed its own version just last month.

In California, the law has been on the books for more than a decade, but with the increased market for used games and DVDs, some retailers are taking a cautious approach and are collecting fingerprints just to make sure they don’t run afoul of local regulations.
