Yesterday I pointed to a post by Jeremy Zawodny that appeared to be calling for a flame fest with me as the guest of honor. I pointed to it after the first few comments made it clear that it wasn't going to be a flame fest. In fact, it was the most rational discussion of conflict disclosure I've seen to date in the weblog world. It left me bursting with pride to be part of this community.

There's nothing wrong when someone writes an essay advocating something that they have a financial interest in, as long as the interest is disclosed. For example, if you're going to buy a house, it's good to know you're reading something written by someone who will profit if you buy the house. That's why you get an inspector to look over the house after you decide to make an offer. And why you'd feel betrayed if it turned out the inspector was getting a percentage of the sale. (In fact the inspector would go to jail for doing that.)

So when a Google shareholder write's an empassioned defense of Google, it was correct for Zawodny to ask if he was a shareholder. He did ask, and got an answer, and as far as I was concerned, that was news, so I pointed to it. All of this is good, it's the system working as it should.

As I read John Battelle's analysis of search engines, I wonder if he is consulting for the companies he's writing about. John has a long career as a journalist and now as a professor, both professions require disclosures of conflicts of interest, so I assume he has no such conflict, because I haven't seen a disclaimer from him.

On the other hand, I often see people who I know have conflicts writing in their area of conflict without disclosure. In a world where everyone's playing footsie, if you tend to out people, you quickly get a rep for being difficult, or having personality problems. Does this sound familiar? Heh.

In any case, the thread on Zawodny's was a milestone. Thanks to Tara, Brian, Ryan, Randy, Scott and Rogers and the others who stood up and said it's important to know where people are coming from. Tell people when you have a conflict, they'll read you more carefully, they'll respect you more, and the world will be a better place.

So a new license draft has been posted here. The changes relate to our standard attribution language and the plan is that they take effect across all of our core licenses. The new version will be 2.5 because it is a minor change. We are in the process of working through other revisions to the licenses that will form the basis for version 3.0 but this change is needed now to take account of the demands of wikis & the open access journal community.

Many of you have given comments on the beta wiki license which have been very useful. The difference between this license draft and the beta wiki is that attribution in this draft can be to the author and/or one or more other parties. The beta wiki license only permitted attribution to the author *or* another party or parties. Also, we have included an additional example in the brackets to make it clear that one of the attributed parties may be a journal.

Here's what the always-excellent telecom analyst Anna-Maria Kovacs has to say about the regulatory implications of the AT&T-SBC deal:

"As Congress works on rewriting the Telecom Act and as the FCC moves ahead on a whole host of issues ranging from inter-carrier compensation to the treatment of broadband and VoIP, the debate will be very different without AT&T. The major voices in Washington will be those of the ILECs, the cable companies, and the content providers."

It's a sobering thought. The counterweights to the incumbent local phone companies will be... the incumbent local cable companies, and every user's friend, the content industry. That doesn't seem to leave any industry forces pushing for competition, innovation, or user empowerment. To the contrary, it makes it easier to foresee regulatory and Congressional deals in which both sides work to keep users and new entrants at bay.

In a series of bizarre events, Apple has sued a bunch of bloggers for releasing information about their upcoming products. The thing is, a journalist is protected by the law, so that they don't have to reveal their sources, but Apple has managed to convince a judge that a blogger is not a journalist, and therefore must reveal their sources.

Dan Gillmor writes about this in depth, being a blogger and a professional journalist. He has some quite excellent points, I recommend that you read it. An interesting piece of information is also this article from CNET that suggests that in the future, blogging and other form of citizenship journalism might be subject to FCE regulation in the U.S., due to the fact that linking to a political campaign might be considered official support, and therefore subject to the same regulations as all monetary support.

I think this discussion will happen also in Finland in the near future. An unregulated internet where anyone can say anything they like is a horror to anyone in power. It's quite likely that also over here there will eventually be attempts to limit freedom of speech online - our very own Minister of Culture, Ms. Karpela, is already trying to circumvent the relevant laws to make sure that "filth" (as defined by your average geek writing a crappy program, owned by a corporation with commercial interests, and supervised by your average alarmist Christian) would be censored from the Internet.

All this talk about censorship and regulation makes my head ache. It won't work - get over it already. Embrace the change: the winners will be found in the crowd that accepts this first.

The alternate is that only professional, accredited writers have a freedom to speak.

Update: The FEC article has been shot down by representatives of FEC. And a good thing, too. I guess it shows that politicians will have to be even more careful about what they say, lest the blogger horde misinterpret them. However, I think in general it's good to have public review of important decisions - blogs have a way of turning legalese into something human-readable. Perhaps it is not always right yet, but it's getting more so.

Update2: Blogger Garrett M. Graff has been admitted into a White House news briefing, says CNN. Just as an interesting data point...

Update3: Kari Haakana has asked the Finnish Journalist Union, and got a response confirming that in Finland the right not to reveal your sources extends to any kind of online publishing, including bloggers.
