One of the struggles that companies have as distribution and sales mechanisms change is handling legacy channel conflict issues. Dell became huge by selling direct to customers, but when rival Compaq started to move in that direction, their retail partners freaked out - and Compaq had to scale back their plans. It appears that book publishers are now going through the same process. They've realized that if someone is looking for info about certain books on their site, it makes sense to also offer them a chance to buy it. However, it's pissing off retailers, who don't want to hear that their suppliers are competing with them. Retailers say a reasonable compromise would be having the publishers point to the retailers, which was my first response as well. However, then it becomes a political situation of who do you link to and why? There's also the fact that this makes for a less enjoyable consumer experience. I know that, more than once, I've been annoyed at online sites where I go for info on buying a product, but when I try to buy am given a big list of retailers instead of a way to buy right away.

There's been so much hype in both the mobile and music industries about ringtones, that people seem to have lost sight of what's actually happening in the market -- and whether or not it's even remotely sustainable. With that in mind, it seems like both industries seem to think that because they've been able to sell a good number of ringtones at ridiculously high prices (though, way too often through trickery) that ringtones are the only place to be. So, while the recording industry continues to sue file sharers and neglect radio, everyone's talking ringtones. That leads to some bizarre promotional ideas, such as releasing a song as a ringtone first before it even hits the radios or stores (downloadable or physical). Apparently, the industry believes that exclusivity trumps promotion (or, that exclusivity somehow is the best promotion). The way the industry normally works is that you get a song out there and playing on the radio, TV (and, increasingly, whether the industry likes it or not, on file sharing networks) and use that to drive demand to get people to purchase CDs or downloads (or other assorted musician related items). However, this is the equivalent of saying that some record label decided it would launch a CD in stores first, before promoting it. Once again, it seems the recording industry has its priorities so screwed up that they're looking to make money on their own promotions, rather than using the promotions to sell something. In the long run, that seems like shrinking your own market. How many businesses charge you to view their commercials?

Nearly two years ago, we wrote about a piece by Larry Lessig looking at how the comic industry in Japan was thriving based on copycat comics that would normally be seen as infringing works in the US, forcing entertainment industry lawyers to shut down these fan-created efforts. In something of a followup to that piece, Henry Jenkins has written about how so-called "piracy" has been a huge help in making Japanese anime popular and commercially viable in the US. Clearly, the easy distribution of digital content has different effects -- some of which are beneficial and some of which are harmful -- for the creators of that content. By assuming that only one of these effects exist, companies that are cracking down on "piracy" without realizing they may be hurting free promotional activity are doing damage to their own business.
