Xeni Jardin: A US appeals court ruled today that motorcycle stunt deity Evel Knievel cannot sue ESPN for publishing his photo online with two women above the caption "You're never too old to be a pimp."
The term "pimp" was probably intended as a compliment, the court said. But Knievel said, "What good is law in the United States of America if five or six goddamn bimbos are going to rule against it?"

Over the past few days, I've gotten more telemarketing calls than I have in a long time. Except none of them are technically telemarketing calls. And some of them start off by telling you that they're not soliciting sales. Instead, they're "taking a survey" that turns out to be an ad in question form, or they are "introducing themselves" by telling me about the services they can perform for my company. Has anyone else noticed the Do Not Call list causing telemarketers to reposition themselves so that they can continue to achieve the mission stitched into their shoulder badges:...

Over at Network World, someone is wondering just how long it's going to take people to start "vamming." This appears to to be something of a made up word to describe VoIP spamming. As the article points out, it won't be all that difficult eventually for someone to figure out a way to spoof caller ID numbers on a VoIP system, which will let rogue telemarketers start calling you like spammers - without any real way to track them down. And you thought instant messaging spam was going to be the next big spam problem...

The Direct Marketing Association (The DMA) today called on its members to refrain from making marketing calls and sending commercial e-mails to consumers on June 11, 2004, which has been designated as a National Day of Mourning in memory of President Ronald Reagan. “We are calling on marketers to consider the mood of the country on this day of national mourning,” said H. Robert Wientzen, president & CEO, The DMA. “Indeed, many member companies have already indicated to us that they plan to refrain from calling or sending commercial e-mail on that day. Businesses should keep in mind the thoughts of consumers and the reputation of the industry.” “If members do conduct a campaign, they should do so with the utmost caution and respect on this solemn day of remembrance,” said Wientzen. Well, it's been quite a few days against bad entertainment industry lawsuits. The latest is that, over in Norway, "DVD Jon" Lech Johansen has won the appeal on his case for creating and releasing the DeCSS code. This is a good ruling, though, it's likely the movie industry will appeal to the country's Supreme Court. The case revolves around whether it was illegal for Jon to create some code that would allow him to view movies that he purchased legally on his own computer running Linux. The movie industry says that he broke their encryption to do so. The original ruling said that he had done nothing wrong, and the Appeals Court echoes that in their ruling today, saying that Jon could go ahead and make copies of DVDs he legally owned - and that he did not break the law in creating software to help him do so.
