  • Brad Stone (Wired): The Linux Killer. If SCO loses, the company is likely toast. But winning will be a tall order. SCO must show that the old, murky contracts between AT&T (which developed Unix), Novell (which bought the operating system from AT&T in 1993), and the old Santa Cruz Operation deliberately transferred the Unix copyrights to the new SCO Group; it also must show that it owns the rights to derivative flavors of Unix, like IBM's AIX. Finally, and perhaps most difficult, SCO must prove IBM and other Linux programmers around the world got sloppy and ported proprietary code into Linux. Legal experts tracking the case think each hurdle - let alone all three - is difficult to clear. The odds are clearly against SCO.

    The nasty legal battle between SCO Group and IBM may soon grow wider, as SCO executives have dropped a new bombshell. In private interviews during their annual user conference in Las Vegas this week, SCO executives said they have discovered that IBM lacks proper licenses for its Unix-based AIX operating system, heart of a multibillion-dollar business for IBM.

    SCO alleges that since 2001, AIX has contained code for which IBM does not have a license. Moreover SCO claims to have found internal IBM e-mails in which IBMers acknowledge this shortcoming. SCO says it discovered the e-mails in a mountain of documents IBM produced in discovery related to SCO's lawsuit against IBM over the Linux operating system. SCO may file a new complaint based on these allegations or may amend its current complaint to include the new charges, says Darl McBride, chief executive of the Lindon, Utah-based software firm.
