recording industry campaign against those who download and swap music
online has made an impact on several major fronts, but the number of
Americans downloading music and sharing files online has increased,
according to the most recent survey of the
Pew Internet & American Life
Project. The Project’s national phone survey of 1,371 adult
Internet users conducted between February 3 and March 1, 2004 shows
that 14% of online Americans say that at one time in their online
lives they downloaded music files, but now they no longer do any
downloading. That represents more than 17 million people. However, the
number of people who say they download music files increased from an
estimated 18 million to 23 million since the Project’s
November-December 2003 survey. This increase is likely due to the
combined effects of many people adopting new, paid download services
and, in some cases, switching to lower-profile peer-to-peer file
sharing applications.

sharing is on the rise again, the RIAA still thinks that it can
win the war by making a big publicity splash and suing people. The
latest, is that they've
filed 532 new lawsuits against people
accused of offering music for download through file sharing
networks. Because of the Verizon decision, these lawsuits are all
filed against "John Doe" defendants, and they will now try to get
legal subpoenas from ISPs to find out who these people are. Once
again, this is more of a publicity campaign than a legal campaign, so
it will be interesting to see if more stories of "falsely accused"
people show up again.

entertainment industry has done with their file sharing lawsuits is
drive the file sharing underground, and made it much more difficult
for them to realize their mistake and embrace it down the road. While
many others have
compare
d the RIAA's battle with Prohibition, Clay Shirky has taken the
argument one step further and is pointing out that the RIAA's lawsuits
have done what the cypherpunks failed to do over the past decade:
encourage
everyone to use encryption. While the cypherpunks have been
warning about the need for encryption for years (usually as a
protection against government behavior), most people ignored it
because they didn't see the need. They weren't doing anything "bad",
so why should they bother with the trouble of figuring out how to
encrypt their messages. However, now it turns out that plenty of
people are doing something that the recording industry has deemed as
"bad" and are being sued for it. Thus, people suddenly have a real
incentive to use encryption that they never had before - and that's
likely to be a lasting result. Shirky suggests that five years from
now, people will look back and wonder what the music industry was so
upset about, but plenty of people will still be encrypting their
communications.

outlets about their "Are Your Kids Breaking the Law When They Log On?"
campaign, which aims to scare parents into spanking their kids for
file-sharing, and comes across as red-scare-era propaganda. It's
funny: Hollywood fought the Red Scare and McCarthyism tooth and nail,
but today, they're more than happy to appropriate its rhetoric and
tactics.
*UNDERSTAND THEIR GENERATION OF THINKING. "*Everyone is doing it"
or "rock stars and movie stars make too much money anyhow" or
"the corporate entertainment scene is corrupt" is* *likely to be
what you'll hear.* * You'll need to arm yourself with the
counterarguments to these. Explain that most artists are not
super wealthy and that they are leaving themselves open to doing
something that is ethically wrong, could damage their computer
and have legal consequences.
*SET A GOOD EXAMPLE*. If you are currently using a peer-to-peer
network to obtain digital music and movies, understand that your
children will follow your lead. * *Let them see you buying your
entertainment legally and they'll follow suit.
