Copyright Board of Canada
issued a ruling on
" private
copying ", largely via peer-to-peer computing, with several
components. First, downloading is acceptable, but uploading is not
(presumably to target hyperpirates). Second, new mechanisms for
levies were described, freezing current ones, allowing new
charges.
the Copyright Board said uploading or distributing
copyrighted works online appeared to be prohibited under current
Canadian law.
However, the country's copyright law does allow making a copy for
personal use and does not address the source of that copy or whether
the original has to be an authorized or noninfringing version, the
board said.

Virus Inflicts James Joyce on Mobile Phone Users The first
ever computer virus that can infect mobile phones has been discovered,
anti-virus software developers said today, rendering many phones
virtually useless.
The virus was apparently released in time for the 100th anniversary of
the eponymous literary holiday. It infects the Symbian operating
system that is used in several makes of mobiles, notably the Nokia
brand, and propagates through the new bluetooth wireless technology
that is in several new mobile phones.

04/14/2004 01:05 PMThere's a constant (and, it seems, incredibly boring) debate about
"blogs vs. journalism" - which seems sort of pointless to me. It's
not as if this is a zero sum game where there's room for only one.
The two work off of each other, and often the lines are quite blurry
between them. Trying to set up a specific "us vs. them" dichotomy is
only an attempt (by everyone who bothers) to get more publicity.
Still, I found it interesting to find an
editorial in a large newspaper suggesting that the internet has
become "the fifth estate." It's not often you see the mainstream
press admitting that anyone outside of themselves has a place in their
world at all.

percent standard (read "fixed by collusion" among realtors) commission
is too much ($60,000 for what might only be a few days of work).
Economists who have studied the real estate market, however, find that
in some ways the commission is too low because realtors don't work
very hard to sell clients' houses compared to their personal
houses. In other words they sell a customer's house relatively
cheap so that it will sell quickly rather than work for many weeks to
get the best price and 6% of the extra.
Why haven't we seen anyone propose a commission structure that says
the realtor gets a 25% commission... but only on the amount above the
assessed value of the property? Your typical $1 million NY or
Boston apartment is assessed at maybe $850,000 and could be sold for
that price with almost no effort in a few days so the commission paid
on such a sale shouldn't be more than $1000. If a realtor could
sell the place for $1.2 million via clever marketing, however, she
should be entitled to a fat commission.

the process works: Mortgage Approval, Appraisals, Surveys, Title
Searches, Purchase Agreements, Stipulation Sheets, Closing, Whining,
Bickering, Signing 1,000,000 pages, Moving, blah blah blah... Even
though it's a scary thought when you first start, and you've probably
heard enough horror stories to not want to go through the process,
it's really not that bad. It's actually pretty easy if you take a
little time and learn about it. It makes more sense than most college
curricula, and it doesn't take a genius to figure it out. Literally
anyone can play the game if they have a dedication to making things
happen. This is an introduction to real estate investing using my 4
years of personal experience as a guide. While all of my experience
has been on the U.S. side of the pond, I'm sure enough of this
information will apply to everyone to make it worthwhile. (This was

02/05/2005 10:08 PMI have enormous performance anxiety at the moment. The world's
turned to look this way for a few scant moments and everyone else is
rising to the challenge and I'm just hiding. And it looks like I'm not
the only one. Apparently, loads of Microsoft employees are using iPods instead of
Microsoft-related products. You may not see the direct connection
here, but everyone's looking at the digital music arena at the moment,
Apple are doing tremendously well in it and there's absolutely no
reason why Microsoft couldn't just look at their competitors, pull
themselves together and go out there and try and create something even
greater. It's not like they're short of cash or bright people. But
instead they're burying their heads and pretending it isn't
happening:
An internal e-mail circular sent to several senior
managers in mid-December talked about iPod shipments to Apple's nearby
store in Bellevue1. The e-mail said: "FWIW, the gal at the Bellevue
Square Apple Store said that they are getting in two shipments of 200
iPods every day to keep up with this week's demand, and are nearly
constantly selling out."
The note prompted a curt reply from Dave Fester, general manager of
the Windows Digital Media division, who wrote the group: "I sure hope
Microsoft employees are not buying iPods. We have great
alternatives..." Fifteen minutes later, the manager responded: "I
don't know what I was thinking. I'm sure that Microsoft employees are
not buying iPods, or Macs or PlayStations."
I find this totally stunning and completely wrong-headed. Microsoft
are trying to play the loyalty card to get their own staff to use
their products even when they don't want to? They're making it a
matter of fealty? This is no way to be creative - it's no way to
operate in a commercial marketplace today. People don't make better
products by not using the best ones that currently exist. And
companies don't spot trends and opportunities by forcing their
employees to lose faith in their own preferences and choices and
become forced proselytisers of another's beliefs.
iPods everywhere is an opportunity for Microsoft. It sounds
ridiculous but it's true. That there's a market that they haven't
conquered - a space they haven't won it - should be the greatest
reason to aspire to greatness. That there is something beautiful and
functional in their midst that is worth admiring shouldn't be ignored
just because they didn't make it. It should inhabited and ripped apart
- explored and enjoyed, all with aspiration to see the cutting edge -
the popular choice - and look to see how it could be surpassed.
It comes down to having respect for your craft and for the world in
which you live. If you want to make great things then first you have
to know what makes something great. And if you want people to make
things that trigger enthusiasm in others then a good start would be to
encourage that same enthusiasm in your staff. Making something that's
true to itself is much easier when you're honest about its failings.
Wise up guys, let them have their iPods. Let them learn from them, let
them revel in them and then get them in a room and think of something
that'll blow it away...
