Little Guy Wins Domain Dispute
Little Guy Wins Domain Dispute
03/23/2005 08:30 PMDavid beats Goliath in domain-name dispute: Good to
see the little guy win one. This guy registered mattel.org and got sued for it.
Mattel, Inc. argued that Gopi Mattel's domain name improperly
incorporated its MATTEL registered trademark. Mattel, Inc. asserted
that Gopi Mattel had no legitimate right or use of the mark, and
contended that he purposely changed his name from Muthyal to Mattel
precisely so that he could capitilize on the mark.
Gopi Mattel responded that Mattel, Inc. waited too long to complain
— almost four years after he obtained the mattel.org domain
name. He also proved that he changed his surname in 1996, when he
naturalized as a U.S. citizen — five years before he registered
the domain name. He demonstrated that his certificate of
naturalization, his driver's license and other supporting documents
reflected that he has gone by the Mattel name consistently. He also
set forth that he has not improperly sought to sell the domain name or
to disrupt Mattel Inc.'s business.
Of course, the little guy has won before. There was the Veronica
guy, who got sued by the publisher of Archie.

The Domain Name Market is Back
03/06/2004 01:56 AMDomain Names Are Big Again:
The domain name business is back, apparently.
Dot-com domain names are fetching respectable prices
again, after more than three years of attracting scant interest. Names
like Truck.com, Beef.com and others have recently sold for more than
$100,000, according to Domain Name Journal, a trade publication, while
Web sites like Men.com, which offers a dating service, and sites
selling pornography like Whitehouse.com are crossing the
million-dollar threshold.

Google becomes domain name seller
02/01/2005 09:22 PMGoogle has become a registrar - a company allowed to sell Internet

quietly approved Google#8217;s application and gave it ID number 895.
It is now entitled to sell any .biz, .com, .info, .name, .net, .org

oogle becomes domain name seller | The Register
Last week, Internet overseeing
organisation ICANN and technical arm IANA, quietly approved Google's
application and gave it ID number 895.
It is now entitled to sell any .biz, .com, .info, .name, .net, .org
and .pro domains (but not .aero, .coop, or .museum). Although it
denies that it will become a seller of domain names, you have to
wonder why?
The Register has an interesting idea..
“ Then of course there is the
possibility that it will find a way of tying in all of its other new
services and connecting them to a domain name sale. So, for example,
you buy "All-in-one.com" through Google and it gives you Gmail,
Blogger and whatever else in a bundle. It does a Microsoft of the
internet by getting you to use all its software and services and so
give itself an enormous amount of power and control. “

Online Gamer Wins Back Goods From
Virtual Theft
Online Gamer Wins Back Goods From
Virtual Theft
12/19/2003 01:02 PMThere's been a ton of discussion in the last few months about how the
law applies as it crosses over the real/virtual barrier. The biggest
question seems to be whether or not
someone
can be charged for stealing virtual items in an online game.
Especially in cases where such items can be resold for real money, is
it really theft, or is it "just a game"? What if the whole point of
the game is to attack others and steal their stuff? There isn't a
particularly easy way to answer these questions, though anyone
creating an online game might want to think about it, as their "terms
of service" are likely to act as a de facto Constitution for the
world. Over in China, though, the first decision has been made on
such a case and
a video game company has been told to return the goods lost
to a player when someone else hacked his account. The guy tried
to find out the identity of the hacker, but was denied, and then sued
the gaming company for money. The court's ruling sounds fairly
reasonable. It looks like they aren't making the company pay, but are
telling them to restore the items the player lost.
