Russ' company gets a mention 08/15/2004 09:21 PM

Ross Mayfield pointed to this story in CNet about cell phone blogging and they mention WaveMarket - the company that Russell Beattie works for.

I really dig this company. Their WaveBlog product is just part of their offering, which also includes WaveSpotter and WaveAlert. Though I'd certainly like to see all trhee of these products in an integrated experience - I'm sure Russ will make sure these products - rock.

One thing I hope they get right is integrating cleanly with a PC experience. I just hate it when cell phoen folks try to "go it alone". There shoudl be a clean dance between phone, PC and back - just like doing the Tango.

Since When Is It Illegal To Just Mention
A Trademark Online?

Since When Is It Illegal To Just Mention
A Trademark Online?
01/05/2005 05:51 AM
There are some strange things happening with trademark law, and it certainly seems to go beyond the scope of what it's intended to cover. The point of trademark law is to prevent someone from passing off their goods as someone else's. It's to avoid confusion. A trademark shouldn't be considered something that you have absolute control over -- but just in situations where confusion can occur. However, that's not at all how it's being used. Instead, it's being used to stifle any kind of comment that someone doesn't like. About a year ago, we wrote about the somewhat bizarre case where the Greater Toronto Airport Authority told a silly site that posts photos of urinals (pretty much just for the hell of it) that they couldn't mention the name of the airport for no clear reason other than that the GTAA didn't like it. The owners of that site, Urinal.net, have now been approached again by someone who is trying to stop them from posting perfectly legitimate information. In this case, complaint is coming from the Marco Beach Ocean Resort, who is claiming that it's somehow illegal to use their name on the website. Urinal.net has responded by (amusingly) distortin g the name enough to try to get around the request of the lawyers who contacted them. Part of the complaint seems to concern the fact that the anonymous contributor mentioned that the urinal is viewable from the lobby. Of course, courts have ruled that simply passing on content sent to you via the web or by email does not make the person or company passing on the info liable for its content. So, if the resort believes that this information is false, then it's not the fault of Urinal.net, but the person who sent it in to them. I asked the maintainers of the site if I could see a copy of the cease & desist, but apparently the lawyers claim that the cease & desist is copyrighted to them and that the recipient is not allowed to forward it to anyone. I wonder if that means they can't even forward it to a lawyer? So, as far as I can tell, the Marco Beach Ocean Resort seems to think that (a) they absolutely own all rights to the name beyond what the law intends (b) they can blame the most easily accessible party, rather than those who are actually responsible and (c) any cease and desist is to be some sort of "secret" cease & desist that can never be shown to anyone, which seems to go a bit beyond what rights copyright gives them. How long is it going to take before lawyers realize that the simple act of trying to repress something they don't like online is likely to make it so that something that most people would never, ever see (like a photo of a urinal in some random beach resort) is now seen by many more people? Let's call it the Streisa nd Effect.

The five-secret-person Department of Education panel that allocates funding for closed-captioning will no longer provide assitive tracks for the deaf to shows that mention witchcraft, including Scooby Doo, Bewitched, and Justice League.
[T]he result of this mysterious panel's deliberations was that the US Department of Education was to declare over 200 TV programs (almost no cartoons, except for things like Prince of Egypt. No more sports. Precious little drama...) were now inappropriate for closed-caption funding...

Apparent terrorism threat to Los Angeles West Side. According to KNBC News 4 in LA, Federal authorities in Westwood have received a threat of terrorism against a local shopping mall somewhere on the West Side, to take place sometime tomorrow, Thursday April 29. Though unsubstantiated, the threat is being taken seriously enough that all local police forces have been notified and at least partially mobilized. I don't know about you, but I won't be shopping tomorrow.... are any other places in the US getting local threats like this, either now or recently?

Could we actually lose the war on

Could we actually lose the war on
terror?

Lesser Evils

The chief ethical challenge of a war on terror is relatively simple -- to discharge duties to those who have violated their duties to us. Even terrorists, unfortunately, have human rights. We have to respect these because we are fighting a war whose essential prize is preserving the identity of democratic society and preventing it from becoming what terrorists believe it to be. Terrorists seek to provoke us into stripping off the mask of law in order to reveal the black heart of coercion that they believe lurks behind our promises of freedom. We have to show ourselves and the populations whose loyalties we seek that the rule of law is not a mask or an illusion. It is our true nature.

Terror in the Skies, Again?

Terror in the Skies, Again? 07/15/2004 06:45 PM
Is this a firsthand account of a terrorist "dry run"? Terror in the Skies, Again? On June 29, 2004, at 12:28 p.m., I flew on Northwest Airlines flight #327 from Detroit to Los Angeles with my husband and our young son. Also on our flight were 14 Middle Eastern men between the ages of approximately 20 and 50 years old. What I experienced during that flight has caused me to question whether the United States of America can realistically uphold the civil liberties of every individual, even non-citizens, and protect its citizens from terrorist threats. Don't like what the annual report on International Terrorist activity says? Just kill it--forever (never mind that the law requires it) -- The State Department decided to stop publishing an annual report on international terrorism after the government's top terrorism center concluded that there were more terrorist attacks in 2004 than in any year since 1985, the first year the publication covered. ... other current and former officials charged that Secretary of State Condoleezza Rice's office ordered "Patt erns of Global Terrorism" eliminated several weeks ago because the 2004 statistics raised disturbing questions about the Bush's administration's frequent claims of progress in the war against terrorism. "Instead of dealing with the facts and dealing with them in an intelligent fashion, they try to hide their facts from the American public," ...
