An interesting article being picked up by a variety of publications written by famed musician Don Henley, saying that the trouble facing the recording industry isn't about the internet or piracy, but about record labels that no longer understand what business they're in, and who are so focused on profit, they're forgetting that they're creating music and not a commoditized product. Henley's solution is that musicians should fight against media mergers and demand that labels treat musicians fairly. He seems to believe the only way to do this is to have the government step in. I'm not sure why this is necessary. Musicians should vote with their feet. If they're getting screwed over by the record labels (and they are), that's an opportunity for better record labels to come along. Some new labels are trying to be different, and if a few major musicians went in that direction others would quickly follow.

During a panel presentation on peer-to-peer file sharing at the Educause conference this morning, Graham Spanier , President of The Pennsylvania State University , announced a deal with Napster that will give Penn State students access to music for $.99 per song downloaded. A Penn State press release outlines the way in which the service is expected to work:

• Students living in residence halls at a dozen Penn State campuses will be able to participate initially.
• Unlimited streaming of music files will be available from Napster’s inventory of more than 500,000 songs.
• Tethered downloading is included at no additional charge. This means a student can download and keep the music files on up to three personal computers. These songs can be burned to CDs or transferred to portable devices if purchased for 99 cents each.

Penn State plans to roll out a pilot of the program beginning in January. The deal is being promoted as a way to provide students with the ability to download music legally while addressing issues of bandwidth overload.

Steve Jobs has admitted in the past that Apple isn't looking to make money off of iTunes. Instead, they view iTunes as a loss leader for selling more iPods - where they make their real margin. So, it's a bit surprising that Roxio appears to be going in the other direction. They're now giving away an MP3 player to anyone who signs up for one year of Napster. Of course, it's a cheap MP3 player with only 128 megs of storage, but the concept is still the same.
