New License Fee May Face Operators

New License Fee May Face Operators 01/26/2004 06:27 PM

A patent awarded to Nomadix last week could force hotspot operators to pay royalties to Nomadix or change the way their networks work: Nomadix received a patent for technology that it claims it developed first which allows hotspot operators to redirect customers to a sign-up page, often referred to as a "gateway" page, when they first fire up their computers. "We're the first to develop this technology and we've been doing it for a while," said Joel Short, chief technology officer and senior vice president for Nomadix. Many hotspot networks, particularly the larger ones that charge for access, redirect customers to a specific home page where they can sign in or pay for access. Often their methods for redirect were developed in-house. Redirection involves the access point or back-end system capturing any Web page request from an unauthenticated user on the network and redirecting them to a page that contains login or usage information. "Some have copied what we've done," Short said. "We stand behind our intellectual property and now we're going to encourage those folks who provide that method to license the technology from us." STSN, Hilton Hotels, and some McDonald's restaurants have licensed Nomadix technology, but T-Mobile, Wayport, Cometa, Surf and Sip, and other hotspot operators don't have licenses. STSN and Nomadix have both received investments from the Intel Capital wireless fund. Most of the non-licensed operators have been reluctant to discuss the new patent. Cometa declined to comment on the matter. T-Mobile has been working on a comment since the middle of last week but has yet to provide a reaction to the new patent. Wayport and Surf and Sip are looking into the issue further before commenting. If Nomadix chooses to pursue companies that use redirect without licensing its technology, the operators will either have to pay license fees, argue the reasonableness of the patent in court, or forgo using redirect. Redirection allows new or existing customers to avoid installing client software for connecting to a network, although some networks are moving towards requiring special hotspot software, which would sidestep this issue. Many free community networks have also used redirection as a method of asking users to acknowledge that they are agreeing to a set of principles to use the free networks. Schlotzsky's Deli and many free or sponsored commercial networks also employ the method. Companies are not required to enforce patents as they are trademarks;...

You Too Can Profit From The War on Terra "You’d think with both the Iraq and Afghanistan wars well under way and with the war on terrorism being more than two years old that the share price of any bullet proof vest manufacturer would be fully valued. Not so! The company that manufactures the amazing life saving bullet proof vests that Sgt. Travis L. McKinney wrote to from the Iraq front line is not only undervalued but is a screaming takeover candidate that is poised to enjoy an up to 450% increase in its stock price." Mobile Operators Want Yet Another
Standard

Mobile Operators Want Yet Another
Standard
12/31/2004 05:18 AM
How very typical... After all the hype about 3G -- which so far has failed to live up to expectations, and all the impending hype about other wireless broadband technologies such as WiMAX and FLASH-OFDM, it looks like a bunch of mobile operators have decided to toss all that and get to work on a completely new standard for mobile broadband, with the aim of being 10 times as fast as 3G. While it isn't really surprising, this is the type of thing the industry is famous for. They overhype a technology way beyond what it can do, then when people realize it really isn't that impressive, they move on to a new standard that they'll hype up for years. While there are some big players joining up to work on this project, expect it to take quite a long time for anything to actually come of it. By the time this offering reaches a commercial launch, the requirements of users are likely to have changed drastically. The competitive marketplace will also be very different. So, before people go off and declare this new, completely imaginary standard to be the wireless broadband technology of the future, it might make sense to wait a few years and see how far it's really progressed.

Why VBScript Logical Operators Aren't

Why VBScript Logical Operators Aren't 07/15/2004 04:59 PM

If you've ever lost a monitor to VBScript (from frustrated punching, mine has dents), Eric Lippert provides some solace in that there's at least a reason why it behaves that way.

In JScript you can do something like this:

if (blah != null && blah.frob == 123)

and it works just fine. But in VBScript

If (Not Blah Is Nothing) And (Blah.Frob = 123) Then

Then if Blah actually is Nothing, this still crashes and dies, whereas JScript does not. What the heck is going on here?

What's going on is that VBScript is not logical. VBScript is bitwise. All the so-called logical operators work on numbers, not on Boolean values! Not, And, Or, XOr, Eqv and Imp all convert their arguments to four-byte integers, do the logical operation on each pair of bits in the integers, and return the result. If True is -1 and False is 0 then everything works out, because -1 has all its bits turned on and 0 has all its bits turned off. But if other numbers get in there, all bets are off.

I didn't say it was a good reason. I just said it was a reason.

Will The RIAA Sue Supernode Operators?

Will The RIAA Sue Supernode Operators? 04/20/2004 04:44 PM
Ed Felten is reporting that the music industry may be considering expanding their legal attack on file sharers by suing those users whose computers are "supernodes" for file sharing networks. If you're not familiar with how these file sharing networks work, they usually try to find a number of users who have strong connections, and turn them into an ad hoc "hub" of activity for searching for files. Even if a supernode is used for the search, the actual exchange of files takes place between the computers that have and want the files. The legal reasoning is that these supernodes, in effect, play the same role that Napster's centralized directory server played - which is why it was deemed illegal, while the next generation of file sharing programs was called legal since they had no centralized directory. The RIAA's lawyers realize that they can call the supernode users "directories" and get them in trouble for the same reason. Once again, though, if they go through with this, it will be a case of lawyerly thinking (we can sue and we can win) over business thinking (what's good for business), which would realize this would likely be a tremendous public relations nightmare. The main problem is that most supernode users have no idea they're a supernode. The system automatically chooses who will act as a supernode. So, you would have the industry accusing people of breaking the law because some software on their computer made a choice, and they may not have actually shared any illegal files at all.
