Apparently, marketers are just now figuring out that browsing and searching are two different modes of web surfing, and people will t reat ads differently in each situation. Some pointed this out quit e a while ago, but thanks to Google and Overture promoting contextually matched ads as somehow being just like search ads, many advertisers expected similar results -- which they're not getting at all. So, now, some advertisers seem to be fighting back and are telling Google and Overture that it's about time they separated out the two forms of advertising and let the advertisers work each campaign separately. It appears that Overture has started to move in this direction, but Google continues to insist that there's no reason to treat the ads differently.

A week and a half ago, we wrote about how a court had overtur ned an earlier ruling for Netscape (now AOL) against Playboy, saying that Playboy couldn't sue if Netscape sold the search term "Playboy" to competitors of Playboy. Now, rather than fight the legal battle for something that doesn't really matter to them, AOL has apparently settled (read: paid up) the case out of court. This is too bad, as this sort of case is only going to return to court at some point. Once again, though, I believe Netscape was in the right. To me, keywords are the same as shelf placement in a grocery store. It's not being used to confuse people, but to entice them. Everyone knows Coca-Cola, so if you want to sell Bob's Cola, you want to make sure you're next to Coca-Cola on the shelf. No one is going to confuse you for the other, but someone looking for Coca-Cola may (or may not) notice Bob's and check it out. It's not trademark infringement. It's competition.

U.S. regulators said on Monday they had settled charges against a supplier of computer pop-up ads that had used a little-known Windows feature to bombard users with unwanted ads. The Federal Trade Commission (FTC) said it had reached a settlement with San Diego-based D Squared Solutions that bars the company from sending pop-up ads via Windows Messenger Service.

Windows Messenger allows computer network administrators to communicate with others on their networks but is unnecessary for home users. It is unrelated to popular instant-messaging software such as AOL Instant Messenger. The messenger service pop-up ads from San Diego-based D Squared were used to sell pop-up blocking software, and they could appear even when a user was online but not browsing the Web, according to the FTC.
