Bush-Cheney Online Video Clip . Using footage from President
Bush's Sunday interview with Tim Russert on Meet the Press, the
Bush-Cheney campaign sent six million e-mails Tuesday afternoon
inviting readers to click on a link to hear the president speak on
"Responsibility." After NBC objected to use of its footage in the
promotion, the campaign disconnected the link.
Under the fair use doctrine, the campaign had
a right to use
this footage, which was 30 seconds long (about 100 words). And the
campaign was craven to back down to the network's absurd demand.
So the copyright cartel strikes again -- in the most arrogant way.

new purchase can only be made at the dealer!! In most cases high end
locksmith facilities can not only duplicate but can program or
reprogram the new keys for a owner at a substantially reduced price in

victims of copyright infringement -- Hollywood studios and the music
companies -- are obviously so strapped financially, Congress may soon
order the Justice Department to use resources tracking file sharers
and filing lawsuits against them. (Yes, I'm being sarcastic.)
As Declan McCullagh reports,
legislation known as the "Pirate
Act" is moving with light speed through Washington -- getting not
even a hearing in committee before being sent to the full Senate.
Sadly, Vermont Sen. Patrick Leahy, who should know better, is part of
this travesty; but he's running for reelection in a state where he
couldn't lose if he tried, and apparently needs more money from Hollywood.
Oh, and once the government files suit -- with huge penalties -- the
copyright cartel companies will still be able to file their own suits.
Nothing like piling on.
I'm not endorsing rampant infringement for profit, the kind of
activity that truly fits the term "piracy," such as the stamping out
thousands of CDs or DVDs in Malaysian and Chinese factories that
deserves to be stamped out, harshly. I'm not endorsing petty
infringement, either, such as downloading songs you would otherwise
have bought in a store. But this kind of legislation, turning the full
force of the government against penny ante infringers, is far over the
top. In times like these, when there are real criminals out there,
it's insane.

DVDs New Target of Hollywood. One former lawmaker said he
didn't realize that the DMCA would restrict digital-content copying to
the extent that it has. "I, like most members of Congress, had no
idea that what would be deemed to be fair use for books, CDs, and TV
programs is not the case for DVDs — and nobody intended that the
people that would enable you to make a single copy of a DVD should be
held criminally liable and go to jail and that's insane," Bob
Livingston (search), former U.S. Republican representative from
Louisiana and House Appropriations Committee chairman, told
Foxnews.com.
Insane, but it's the law Livingston and
his colleagues passed. Now a few brave members of Congress, led by
Virginia's Rick Boucher, are trying to redress the wrong they did in
the 1998 Digital Millennium Copyright Act.
They've introduced something called the
Digital
Media Consumers' Rights Act (description of bill), a bill that has
no chance of passing at the moment but is worthwhile nonetheless. The
fact of the
bill (PDF
of full text), and a
hearing on Wednesday, provides evidence that the
long-needed pushback against the cartel is beginning to get some
traction.
But they're up against an entertainment industry that has just about
bought and paid for the Draconian laws now in place. The cartel is
drumming up support for its inflexible position, and you need to make
your own views known. The EFF has
som
e good suggestions. (If you email or fax a letter, I strongly urge
you to write it in your own words, rather than just copying the EFF's
language, because Congress is now well attuned to discount rafts of
identical letters. Individual letters get much more attention than the
cut-and-paste stuff.)
It's good to see former lawmakers like Livingston talking about how
they were snookered by the cartel, meanwhile. It won't make enough of
a difference to modify the terrible DMCA in any big way, not yet. but
it helps.

Last month, I
blogged about the deceptively named Open Mobile Alliance that
provides DRM for music/movies on
cellphones. The OMA licensing cost was $1 per handset, which means
that buying OMA for all of last year's phones would have cost $684
million -- more than the total market for digital music.
The OMA has responded by generously cutting that licensing fee to
$0.65/handset, which brings the cost of outfitting all the phones sold
this year in line with the approximate market for digital music. Yeah,
that'll work.

Yahoo's Anti-Spam Resource
Center have published an explanation of their proposed Domain Keys spam
fighting technique. At first glance it looks very promising. There's
no centralised authority, no requirements for changes to existing
protocols and the central concept is extremely easy to understand.
Essentially, mail servers generate a public/private key pair and sign
outgoing messages with the private key, while publishing the public
key as part of their DNS record. Because only they can publish to their
public key in this way the signature can be used to confirm that the
sender of the email has not been spoofed. The presence or lack of a
signature can be used as part of the process of identifying spam.
The FAQ
covers all the bases I could think of, and explains how Domain Keys
can help fight phishing attacks as well.
