s
uggestion for adjusting intellectual property laws for software -
saying that if you own more than 50% of the market, you should be
forced to give away your product - and its source code - for free.
The writer then makes some very good points about why forcing
companies to give away their software isn't unfair - and how they
should still be able to make plenty of money with such market power,
even if the offering was free. I agree that companies can still make
money offering software for free, but I don't think the overall
suggestion is that good. If a company wants to charge for software,
that's their business. Furthermore, any such "forced freeness" would
lead to unintended consequences as companies and users tried to game
the system. The big question, of course, is how would the markets be
defined? Software companies will suddenly start redefining their
markets to make them as broad as possible, to give them smaller market
share numbers for the purposes of such a rule. Already, we see the
opposite happening for PR purposes. Just how many software companies
are the "leader" in their market - after redefining that market to
make sure they're basically the only player?

06/22/2005 03:01 AMI am not a fan of disposable razors, they always seemed wasteful to
me, and never very good. So a long time ago -- before they made fancy
razors for women -- I started using Gillette men's razors. Over the
years, I slowly upgraded until I was using the Gillette Mach 3. And I
was happy. Until I left it in the shower on Nantucket last week. So I
headed to Duane Reade for a new razor and for some reason decided now
was the time to try a ladies' razor. The Gillette Venus looked nice and the handle appeared
ergonomic and easy to manoveur, so without much thought I bought it.
Then I shaved my legs with it.
OH MY GOD!!
What was I thinking using that crappy old Mach 3 for all those
years? The Venus is AMAZING! Easy to control, nimble around the
ankles, slick and fast up the calf, and above all, smooth! My legs
haven't ever felt so smooth after a shave ever! I'm counting the
minutes until I can shave again, that's how much I love this razor.
It's a triple-mint, double-plus-good, two-thumbs up, five stars and
diamonds razor. For sure.

Some days I wish I lived in LA, where everything is
sunshiney and every confusing bit of gadgetry can be shrugged away as
"magical," like the new DVD players being issue to Academy members
that are supposed to help prevent the Oscar screener discs from being
copied. Brother blogger Defamer attacks the issue in typical sidelong
Gawker fashion, explaining how the destitute movie industry elite who
make up the voting members of the Academy often are forced to trade in
their screener copies for tiny nuggets of crack and Efferdent.
Is it really that big of a deal? I've downloaded screener copies
before, but they were all compressed to hell. If the analog hole still
exists on these magical units - likely - then it's not going to stop
that lone jonesing VP from pushing out lossy analog copies to the
net.

indispensable, I learned that day in Dallas. My successor will come
into this job and he won't be me, but he might do a hell of a lot
better job than I'm doing.")
It may be possible to so infect a movie with some kind of circuitry
that allows people to copy to their heart's content, but the copied
result would come out with decayed fidelity with respect to sound and
color. Another would be to have some kind of design in a movie that
would say, 'copy never,' 'copy once.'
Even ignoring the technical non sequiturs ("stuff ... algorithms into
a movie"; "infect a movie with ... circuitry"), this is wildly
implausible. Nothing has happened to make the technical prospects for
DRM (anti-copying) technology any less bleak.
We can only hope Valenti's successor stops believing in "technological
magic" and instead teaches the industry to accept technical reality.
File sharing cannot be wished away. The industry needs to figure out
how to deal with it.

Ever since I
blogged about the anti-Japanese protests in China, I have
been having a dialog with a number of people about Japanese history.
One of my Chinese friends recommended
"Hirohito and the Making of Modern Japan" (Herbert P. Bix)
for a more objective and critical view of the Emperor's role in the
War. I am reading the book now. I believe this book does a great job
of uncovering a fairly systematic coverup by the US occupation and the
Japanese media of the role of the Emperor in World War II. However, I
do think that Bix tends to makes some conclusions based on the facts
he uncovers that I would not necessarily agree with. It is, in any
case, a very good book for anyone interested in Japan to read.
With this fresh in my mind, I visited Kyoto, my home town, and was
amazed at just how much Japanese tradition is organized around the
Emperor. The Emperor went though various levels of influence in the
governing of the nation, but has remained in place for 125
generations. Regardless of his level of influence, the Emperor has
been the center of most of Japanese culture. Kyoto, for instance, is
divided into the "Right Kyoto" and the "Left Kyoto". This has nothing
to do with East or West, but is the right or left side of the city
when viewed from the Emperor. The bullet train "climbs" from Kyoto to
Tokyo (the new capital) toward the Emperor and any road that points
away from the Emperor is pointed "down". All kinds of symbols and
names allow you to understand exactly what each Temple's relationship
to the royal family is. Maybe it was just our guide, or maybe it was
that I was sensitized, but I think he talked about the Emperor in
almost every explanation he made.
I question whether we should still have an Emperor in Japan and I
believe that the facts about the Emperor's involvement in the war
should be more publicly known. However, I wonder how the cultural
foundation of Japan will change if the Emperor and the royal family
were removed.

before he does, he has resolved to visit every tube station in Zone 1,
and he's inviting the general public along on his tube-crawl:
Here's the deal, I'll be starting at 12.30 on a weekday in the last
week of July (probably Friday the 30th July, but don't quote me just
yet). If you'd like to join me as I rattle round Central London and
visiting every station of note (and Hyde Park Corner) then make sure
you're at Vauxhall Ticket Office for around 12.20 to find me.
Anyone wishing to set up a Rival team to try and beat me on the day is
more than welcome, I'd only ask you to also start at Vauxhall with us.
Once it's all over, we'll retire to a pub at around 4pm for a late
lunch/early dinner, some farewell drinks, and I'll invite you all to
the housewarming in Edinburgh.

My
cattle grazing grounds are not my idea and vice versa. But thanks
to laws I can "own" the idea as if the idea was a cow ; link
goes to a interesting university-level paper [PDF].
The author makes some interesting analysis and points attention to the
fact that current intellectual property laws can go against well
established economic theories at the expense of free market
competition theory, technical innovations and society-as-a-whole best
interest.
Recommended to people with economic theory experience , but also to
everyday public-goods-privatization opposers as the paper isn't
(intentionally) way too technical.
