File Traders Moving Further Underground

File Traders Moving Further Underground 01/17/2004 10:47 PM
This shouldn't be a surprise to, well, anyone, but the more the RIAA fights back against file sharing, the further underground file sharing goes. The latest efforts include building in more anonymity to file sharing services, and also designing systems to make it easier to figure out which files were legitimate, and which were fakes, viruses or spyware. This is only going to continue until the recording industry stops the current self-destructive campaign and realizes it's time to embrace file sharing and figure out ways to build real business models based on file sharing. Either that, or they can wait and let others do it for them - which is what appears to be happening.

RIAA goes after 531 more file sharers

RIAA goes after 531 more file sharers 02/18/2004 10:49 AM
The Recording Industry Association of America (RIAA) is continuing its tactic of filing suits against anonymous "John Doe" computer users who the organization accuses of illegally sharing copyright material over peer to peer networks. The association filed lawsuits against 531 unnamed people on Tuesday, claiming that they are offering substantial amounts of copyrighted music files for free. The legal actions were filed in Philadelphia, Atlanta, Orlando and Trenton, New Jersey, the RIAA said.

Actually File Suits

It's not really that big a deal, as other courts have already said the same thing, but the RIAA has lost another case, saying that before they can subpoena ISPs for customer info, they first need to file a lawsuit. Since other courts have already told them this, that's what they've been doing lately. However, it does reaffirm previous rulings, and means the RIAA won't be able to point to split rulings to try to push their case further.

The Recording Industry Association of America (RIAA) has taken new legal action against 896 alleged file traders using peer-to-peer (P-to-P) services, the organization announced Wednesday. Wednesday's total includes new lawsuits against 744 users of a variety of P-to-P services, including Kazaa, eDonkey and Grokster Ltd. The RIAA filed an additional 152 lawsuits against people already identified in the litigation process who declined RIAA offers to settle their cases, according to the RIAA. Those 152 people were previously sued by the RIAA as unnamed defendants. Not including the lawsuits announced Wednesday, the RIAA has taken legal action against about 1,500 alleged music uploaders since January.

Accusing The RIAA Of Racketeering For
File Sharing Lawsuits

Accusing The RIAA Of Racketeering For
File Sharing Lawsuits
02/18/2004 02:56 PM
We've covered the story of DirecTV suing anyone who ordered a smart card reader and telling them they should just settle since it would be cheaper than fighting the lawsuit (even if they did nothing wrong with the smart card reader). Some of the accused have realized that this seems quite a bit like extortion ("just pay up, it'll be less trouble...") and have sued DirecTV with racketeering. Now, one woman is saying that this same argument can be equally applied to the RIAA and their lawsuits against those accused of sharing file illegally. She's now charging the RIAA with racketeering under RICO laws for trying to extort money out of her. It's a tough claim - because the RIAA's obvious response is that she (or, as she claims, her daughter) was doing something illegal. Still, the method of dumping thousands of lawsuits and then offering to settle them for a few thousand rather than going through the trouble of a lawsuit does sound an awful lot like extortion.

Judge: RIAA can't subpoena file-trader
information
12/19/2003 03:44 PM
The Recording Industry Association of America Inc. (RIAA) does not have the authority under U.S. law to subpoena the names of alleged peer-to-peer file traders from ISPs (Internet service providers), a federal appellate court ruled Friday. The U.S. Court of Appeals for the District of Columbia overturned a lower court's decision allowing the RIAA to file subpoenas asking Verizon Internet Services Inc. to turn over the names of suspected copyright infringers without the RIAA having to file lawsuits against the alleged file traders. But the RIAA's argument that the subpoenas allowed in the 1998 Digital Millennium Copyright Act (DMCA) apply to material transmitted through an ISP as well as content stored by an ISP "borders upon the silly," the court wrote.
