responds to
my post about the Free Culture Movement (FCM) and property
rights. He steps back from his earlier statements and
acknowledges that, yes, there are elements of the movement, such as
Creative Commons, that work within the property rights system.
For that I give him credit.
I don't agree with his stark division of the FCM into "BSD Licence"
activities that respect property rights and "GPL" activities that seek
to overthrow them, but I won't be ungrateful. It's a much more
nuanced and accurate view that what he started with. If we can
spend our energy debating the substance of the issues -- which sets of
rules better promote economic efficiency, freedom, and innovation --
we
may make some progress.
To my mind, the genius of people like Larry Lessig and Yochai Benkler
is that, unlike the prior "copyleft" generation represented by GPL
creator Richard Stallman, they are able to engage on their opponents'
own turf as well as from the outside. What set me off about
DeLong's original post was the unwillingness to accept that fact, by
labeling the whole movement as opposed to property rights.
DeLong takes umbrage at my use of the term "copyright
maximalists." First of all, I didn't apply that label to him --
I
was thinking more of Jack Valenti. As DeLong makes clear in his
followup post, he appreciates that property rights have limits:

I used to think I knew what online community was all about. I thought
it had something to do with discussion forums, like the one here at
InfoWorld I've recently tried to colonize. Having spent too many
years, keystrokes, and brain cells debating the pros and cons of
various discussion technologies, I'll just cut to the chase. This WebX
thing is not working for me. It's not simply that the software mangles
URLs, doesn't preview messages, and handles topics and threads in a
way I find awkward. What's broken, for me, is the idea that an online
community is a place where people gather, and a centralized repository
of the discussions held in that place. In that model, I've concluded,
the costs are just too high. It's
expensiv
e to join. It's expensive to participate, because interactive
discussion demands a lot of attention. And it's expensive to leave,
because the repository has your data, and may or may not (probably
won't) preserve its linkable namespace or hand the data back to you in
a reasonable form.

Journalism & Media Studies Centre,
helping out with a new media course led by Andrew Lih, a professor
there. The student project this year is especially interesting, I
think. Here's the text of a release being sent out to various
folks.
Chatter
Garden, an online community for news and discussion about Hong
Kong regional politics and public affairs, is now live.
The English language site was created as a University of Hong Kong
student project for the New Media Workshop, part of the Journalism and
Media Studies Centre. Visitors are encouraged to engage in online
community dialogue, writing weblog entries and moderating stories. The
Web site creation was directed by assistant professor Andrew Lih and
visiting lecturer Dan Gillmor, author of the book, "We the Media."
While Hong Kong has one of the most free media environments in East
Asia and China, there are surprisingly few forums for public
discourse. Chatter Garden was inspired by other online citizen
journalism projects, such as OhmyNews (Korea), Malaysiakini and
DailyKOS (US) to engage citizens in discussing regional public
affairs. Topics include politics, economy, culture, and "One country,
Two systems."
Chatter Garden is named after "Chater Garden," the park next to the
government Legislative Council building, and a popular gathering place
for local political rallies.
I'm proud of the students'

"...My daughter was only 3 months old when it arrived and
we set it up. As far as my daughter knows, TiVo has always been
around. Now that she (and our TiVo) are three years old, and there are
some very interesting things I've been able to observe.
First - she doesn't watch much TV (an allotted hour per day), but
when she does watch it, she gets a choice of a recent episode of any
of her favorite pre-recorded shows (current favorites are Dora the
Explorer and Caillou), and she can watch it at any time of day. We get
to choose what shows we'd like to allow her to watch, set up a Season
Pass, and we're done.
Second - Commercials are an infrequent novelty to her. We always
fast-forward through commercials, or watch non-commercial shows. When
she does occasionally see a full commercial, she's fascinated, and
will often ask us to stop so she can see what's going on. How can we
demonstrate to her the evils of commercial interruption, when she has
never had to experience it?
Third - Ignorance of Schedules/Programming - she has no idea when
her favorite shows are on, never has. She gets quite confused when we
are watching a non-TiVo TV, and she asks to watch 'a kids show', and
we have to explain that this TV won't do what ours at home does. We've
sometimes shortened this explanation to 'This TV is broken', which she
seems to accept, and will wait until we get home to watch our 'fixed'
TV.
Fourth - pausing taken for granted. She is now the master of paused
TV - saying 'Can you please stop this for a minute - I have to use the
Potty'....
I compare all of these observations to my TV-watching experience as
a child - always excited about Saturday Morning, because that's when
cartoons were on - swapping stories about the latest Evel Knievel
motorcycle I saw on a commercial with the other kids, knowing they had
all seen the same commercials as well. Feeling disappointed when my
parents would switch off a show mid-way through because they decided
it wasn't appropriate. The pain of commercial interruption, the
disappointment of 'nothing's on', or the missed shows that were
probably gone for good. (On a side note, anyone else remember the days
where if you missed a movie in the theater, you'd never get a chance
to see it again?)
There are a lot of other home entertainment developments that have
changed since I was a kid, but none so radically as the TiVo
experience. I never cease to be amazed when I'm zooming past a
commercial with a woman dancing with a 'swiffer', and I hear my
daughters small voice say: 'Wait Papa, I wanna see that'." [Eintagsfliegen
]
Kids growing up like this view their entertainment and multimedia
very differently than the rest of us. Heck,
as an adult I'm completely spoiled by this revolution, and the desire
for this functionality spills over into other mediums (why can't I
press a button to go back 7 seconds and hear what I just missed on the
radio or pause it?).
It's an interactive world for them, and they shift everything.

area of Boston's Newbury Street to promote his business while doing
good. Oh seems to have a single backhaul, which radically reduces his
