Arrested For Recording Movies

Arrested For Recording Movies 04/15/2004 01:02 PM
Late last year there was a lot of talk about a new California law that completely banned bringing any kind of video camera into a theater, even if you weren't using it. As many people pointed out, this seemed to go too far - as just carrying a video camera (especially a camera phone) doesn't mean you're doing anything illegal with it. Well, the law went forward and now the first two arrests have been made - in both cases traditional situations where people in the audience were caught trying to record the film on camcorders. While the actions described clearly are illegal, it still seems like this law goes too far. In other related news, the article mentions the sentencing of the guy accused of putting screener tapes online - saying that his sentencing has been delayed six months so the studios can "calculate the losses incurred." It's going to take six months to calculate the losses? Expect the losses to be nowhere near reality, as they'll assume that every potential download was a "lost sale," when that's clearly not true. It's likely that many of the big fans of those movies went and saw it in the theater anyway, and others never would have paid to see the movie anyway. In fact, there's a chance that the download enticed some people to go see the films in the theaters. But, of course, don't expect Hollywood to take into account any of those things.

Those of you that are long term readers will remember we went into a lot of details about recordable media becoming corrupt over time. Apparently this issue is starting to get some mainstream attention in that there are some proposals on the table to include a rating of the media quality. In my opinion this is long overdue. The Recording Industry Finds Their Way
Onto Internet2

The Recording Industry Finds Their Way
Onto Internet2
04/12/2005 02:01 PM
Late last year, the RIAA made a big deal about how they wanted to join the Internet2 group as a member. It was obvious from the beginning that the only reason they wanted to do so was to track to people file sharing on the network. They did make some noises about using the faster Internet2 technology to test out better digital distribution techniques, but the real interest was in finding a few more people to sue. In that, they've been successful. The latest round of lawsuits targets file sharers on Internet2.

A Code Of Conduct For The Recording
Industry

A Code Of Conduct For The Recording
Industry
04/12/2005 02:00 PM
It appears that record companies and their movie counterparts are pressuring ISPs to adopt a "code of conduct" for blocking P2P file sharing and turning in such users to the authorities. Perhaps it seems odd for one (non-governmental) industry to create a code of conduct for another. But what the heck. In that spirit, we've taken the liberty of creating a code of conduct for ISPs to impose on the record labels. It would go something like this: 1) acknowledge that file sharing is inevitable (and forget about us policing our networks for you); 2) use that to your advantage, as industries have similarly done for centuries; 3) if you need help with #2, do this: devise a smarter business model that embraces file sharing, perhaps even exploits it; 4) if you need help with #3, do this: consider sharing as free advertising and build services around that; 5) if you need help with #4, try this: your new business model all laid out for you; and 6) by all means, stop giving sibling spinoff acts a contract and/or a microphone.

The Recording Industry's Grand Plan: Sue

09/03/2004 12:29 PM
Just like the MPAA's new leader, it looks like the RIAA's grand plan doesn't include anything that involves actually listening to what their customers are telling them, but rather, it's all about telling their customers what they're doing is wrong, wrong, wrong, and you should go to jail for it. In an interview with the RIAA's top lobbyist, Mitch Glazier, he repeats all of the usual RIAA lines about how important the Induce and Pirate Acts are, how he believes they're actually winning this battle against file sharing and how any change to the DMCA clarifying "fair use" would somehow be a "terrible precedent." However, he makes a very telling statement when it's pointed out to him that for each file sharing network they shut down, another 10, with better security, better filtering and better tools seem to spring up. His response is: "Our job is to make the risks high enough that fewer companies are interested in taking those risks." Apparently, it's not their job to see what their customers want and actually offer that. Meanwhile, for all the "risks" they're trying to add, plenty of others have noticed that every one of the RIAA's strategies so far, seems to have backfired in some manner when it comes to file sharing.

“The attraction to Apple’s DVD Studio Pro for me is threefold: ease of use, flexibility and power,” David Nagel writes for Digital Producer magazine. “These three factors came together in one tight, highly intuitive package known as DVD Studio Pro 2 last year, when, for the first time, we gave the program our rare Must Buy recommendation (a first for any DVD authoring system). Now, at version 3, it’s even more powerful, flexible and intuitive than ever.” [Jul 9]
