MIT's The Tech interviews the MPAA's outgoing spokesmonster Jack Valenti, with hilarious results. It's not often that a slickster as teflon coated as Jack gets made to look an utter fool (though I'd welcome a round onstage with him in front of a university audience) so bravo and bravo again to The Tech's Keith J. Winstein, who ran circles around Valenti.
TT: Indeed, but are you doing that when you rent a movie from Blockbuster and you watch it at home? ... I run Linux on my computer. There’s no product I can buy that’s licensed to watch [DVDs]. If I go to Blockbuster and rent a movie and watch it, am I a bad person? Is that bad?

Appearing on "The Late Show with David Letterman" Monday night, John Kerry opened with a pointed, nasty joke, saying that during the upcoming debates, Bush will be sitting on Cheney's lap. Thank you for writing to me about the digital broadcast flag. I appreciate hearing from you.

I feel strongly that we must prevent the theft of copyrighted works, and that includes digital television (DTV) programming. As we move forward in the digital age, it is increasingly easy for unauthorized copies of copyrighted works to be made and illegally distributed. Over-the-air digital content is the easiest to pirate.

As we contemplate the use of new technologies to protect copyrighted works, we must pay careful attention to ensure that a balance is struck between competitive protections and individual consumer interests. It is important to allow for the continued fair use of copyrighted material, even while we seek to stop unauthorized reproductions from being illegally distributed outside the home and over the Internet.

Again, thank you for writing. Please know that as the Senate considers legislation of the broadcast flag, I will be sure to keep your views in mind. If you should have any questions, please feel free to contact my Washington, DC staff at (202) 224-3841.

Lie: TiVo's TiVoToGo service -- designed to comply with the broadcast flag -- limited the number of devices you could watch your recorded videos on to a set number. Nothing about fair use says that n devices is permissible, but n + 1 isn't. TiVoToGo was one of the more permissive services -- systems like 5C and 4C have no consideration for fair use (for example, you can't tell a 5C device that you need to the ability edit a show that you plan on using in connection with criticism or classroom use).

Cory Doctorow: Shawn sez, "I just posted this defense of Bit Torrent on my personal journal after receiving a C&D letter from my webhosting service demanding I stop sharing 'copyrighted' material, even though it's made very clear on my site that the files I host on my Blog Torrent install are my own creations (well, me and my friends, but they're all cool with it). The file in question is a short documentary about Booth Babes my wife and I made and posted on our site back in 2001, and the file that tipped them off was generated by my test install of Broadcast Machine (which has been mysteriously not working on my server)."
I don't want them to turn off my websites. And this is not any kind of civil disobedience, which would involve breaking a law. I'm just uploading my files to the Internet and trying out some technologies to facilitate this with the lowest demand on my webserver. If hosting companies apply some kind of blanket filter against .torrent files, that will seriously limit our ability to share media and content. It is completely unacceptable for web servers to do this kind of unmonitored regulation and threatening. What if I had been on vacation, couldn't respond, and they shut down my site in a week?

Update: Shawn sez, "I spoke with a very nice Indian man named "Andre" who seemed to grasp the silliness of the situation. He escalated the issue to his manager, and said I should hear back within 24 hours. So I've been waiting. No reply to my email either so far.

As they were coming down the street I told my 5 yr old to go stand in the road so I could take his picture with them. I've finally finished posting my pictures of the 2004 How Berkeley Can You Be Parade. One of the things that makes Berkeley such a wonderful place to live is the mix of people who inhabit it. The annual How Berkeley Can You Be parade is one of my favorite Berkeley events, because it reflects the Berkeley mix so well -- the creative artists, the earnest citizens, and the zanies. This year's parade theme was alternative locomotion, and, helped by its status as the end point of the West Coast Art Car Fest, organized by Berkeley resident Harrod Blank, the parade delivered. While there wasn't a single most popular car, like last year's Sashimi Tabernacle Choir car, there were lots of great electric cars, bicycles, scooters, and many wonderful but uncategorizable entries. Unsuprisingly, given the timing and locale, politics was the unofficial theme of the parade. This year's crowd pleaser wasn't a car, it was the "Billionaires for Bush" contingent, resplendent in their tuxedos and evening gowns. The anti-circumcision protesters weren't nearly as popular, but they did have the best poster. Befitting our small town status, the causes with the most marchers were the local causes, more funding for our public libraries and public schools. All in all, a great event. If you are ever in Berkeley in mid-September, don't miss it....
