There’s been a lot of buzz recently around Edge.org’s assemblage of “Laws” proposed by Interesting People. Nobody asked me for one, but lately I’ve been doing some consulting for Dick Hardt’s stealth startup Sxip Networks while I look for a gig and it refreshed my appreciation of maybe the most important lesson I’ve learned over the last couple of decades, maybe enough to pump it up and claim it’s a Law, in fact two: Herewith the Two Laws of Explanation...

Want to know just how far the debate over intellectual property has been skewed these days? A few months after IBM decided to free up approximately 500 patents they weren't really using in hopes of stimulating growth in other areas, the NY Times felt it was necessary to write a whole article explaining how it was actually possible to profit from freely sharing information. The disturbing part is that the article frames this in a way suggesting that most business people these days probably wouldn't think it was possible to profit by releasing info so that others could improve on it and offer more that will come back to help IBM. This is what we get when we allow our education system to be outso urced to the entertainment industry, who go around telling kids that anything free is obviously bad and "stolen."

An economics professor explains how the psychology behind bidding on things for investment reasons tends to limit the amount of the high bid.
Google intends to sell shares of itself through an auction in which Google stock is sold to those willing to pay the most per share.  This means, for example, that if only 20% of the bidders end up with Google stock, these 20% will consist of people who bid the most for Google.  Now, if you end up being one of these "lucky" 20% should you worry that the winner's curse has stricken you since you apparently valued the stock at an amount greater than what most investors believed Google to be worth?  

Rational investors will take the winner's curse into account when making a bid.  For example, assume that before the auction you think a share of Google is worth $100.  But you figure that if you end up being a winner in the auction it means that most investors think Google is worth less than $100.  So, the act of winning will cause you to think Google is worth only $80 a share.  You should, therefore, bid no higher than $80, an amount diminished by the winner's curse.

Over in the UK, they've realized that it's about time they updated some of their cybercrime laws. This makes sense, since most computer crime laws are pretty much out of date, but since so few politicians seem to really understand technology, the fear is that any update may make things worse. Already, the report mentioned in the article recommends increasing jail time for "hackers." That may be good or it may not be, but just using the generic term "hackers" is a bad sign. The problem isn't with hackers, but it should be focused on what crime (if any) they've really committed. The report does note that the police do need to be better trained in how to deal with computer crimes, and that certainly makes sense. Still, politicians and computer crime laws seem to have a very bad history together, and it's unlikely this time will be any different. The problem is usually that the politicians don't understand cybercrime, and thus, they over-react to it. Until a new generation of tech savvy individuals gets elected to office, this is going to be an ongoing problem.

While I agree that rushing into anti-spyware/adware legislation wouldn't necessarily be a good thing, it's pretty clear that "self-regulation" isn't currently working. Still, that's what the FTC is recommending rather than any kind of anti-spyware legislation, such as the new Utah law that requires adware/spyware makers to inform users what their programs are doing. The FTC admits that certain deceptive practices may be illegal already, and they can go after those companies - but so far it's obviously done very little to stop the spread of spyware. Instead, the FTC recommends "education" which certainly hasn't done much to stop the spread of other internet hazards like viruses, spam, and phishing attacks. What's more likely to happen is that, as with those other threats, people are going to increasingly need to get their hands on anti-spyware applications which will work some (but not all) of the time. While many tech savvy people already use such applications, others are going to expect their ISP to protect them, which, so far, they've been unwilli ng to do.
