While conventional wisdom is that venture capital moves in a sheep-like herd, all investing in similar "hot" space, not all deals fit those criteria. The latest venture capital study of VC investments in 2003 tur ned up a number of investments that are considered "odd", in that they're certainly not in areas where you see VCs shoving each other aside to get in on the deal. This includes the makers of "hybrid" metal/wood baseball bats and a company that makes energy efficient traffic lights, with security cameras hidden inside. Of course, if you look at the numbers of these deals, they all tend to be pretty small bets, so you have to wonder if there's something more to the deal. The article also doesn't identify who the VC was who invested in these deals - and my guess is that they're not done by any of the bigger name VCs, but rather smaller niche market VCs.

Intel has a number of ideas for wirelessly sharing data among devices like TVs and computers in the home: It demonstrated a concept PC that runs on Microsoft's Media Center version of XP. The PC connects to a TV, can share content wirelessly, and can be controlled by a remote control instead of a keyboard. Intel is also working on a couple of new chips including Grantsdale, which includes integrated graphics, support for dual monitors and DDR2 memory. Intel is also working on a chip it's calling Alderwood which will let PCs act as access points....

Calypso, which recently was awarded a patent on technology than enables roaming between Wi-Fi and cellular networks, named vendors that it says infringe on the patent: The company said that that patent would have major implications on the way Ericsson, Motorola, and Nokia do business. The press release also said that companies that don't want to license the technology right now but plan eventually to make devices that roam between networks will have to obtain rights from Calypso but doesn't explain why that's so. I've asked leaders of a few companies such as Radioframe and Bridgeport--both are working on roaming between cellular and Wi-Fi networks--for their take on the Calypso patent and neither was interested in commenting. I had a similar experience when looking for comment on the patent for redirect that Nomadix received recently. However, this story quotes the CTO of Birdstep as saying that its technology, which enables roaming between the networks, doesn't interfere with the Calypso patent. Perhaps that means that companies may be able to get around having to license from Calypso. On a side note, parts of Calypso's Web site are pretty amusing. On the company history page, I found this statement: "Calypso stunned the telecommunication industry when it introduced the world's first and only mobile video phone" That's interesting as I'm not sure I recall that happening nor have I heard of any operator selling the product. I wouldn't call that "stunning" the industry....

  • NY Times: Supreme Court Affirms Detainees' Right to Use Courts. The Supreme Court ruled today that people being held by the United States as enemy combatants can challenge their detention in American courts — the court's most important statement in decades on the balance between personal liberties and national security.
  • There's still a scary deference to the executive branch in some of the language in these rulings. But there's also something to cheer: the president can't decide what the law is. The court punted on the Padilla case. He's an American citizen who was grabbed on U.S. soil and slammed indefinitely into a military brig. The court said his lawyer raised the case in the wrong court. Sheesh. But there's overall good news. As one justice wrote, the "War on Terror" does not give the president "a blank check" in defining the rights -- or lack of rights -- the Constitution grants.

  • NY Times: Court Hears Case on U.S. Detainees. The Bush administration yielded no ground before the Supreme Court on Wednesday in arguing that the open-ended military detention of United States citizens as enemy combatants, without criminal charges or access to lawyers, was justified both in law and as policy.
  • The administration's claim here -- that the president and his aides alone can decide to lock an American citizen away forever is a claim to their right, and that of future presidents', to be tyrants. It's incredible that this is even thinkable. But our collective fear from the Sept. 11 attacks, and Congress' absolute spinelessness in defending the Constitution it swore to uphold, has given Bush what he so plainly wants: the opportunity to be the president who asserts, and gets, absolute power. Absolute power is always abused. Always. This kind of absolute power -- making leaders the prosecutor, judge and jury -- is the lynchpin of tyranny. If the court upholds this abuse of liberty, it will be assisting in a crime: If this assault on the Constitution succeeds -- if the Constitution has truly become meaningless on something so fundamental -- then we will have destroyed America to save it.
