SAN FRANCISCO -- In 2003, much of the talk at LinuxWorld Expo & Conference was of the increasing worry about IP litigation involving Linux and Unix, especially emanating from Lindon, Utah, via The SCO Group. SCO had filed a $5 billion lawsuit the previous March against IBM, contending that Big Blue had knowingly misused and distributed SCO's Unix System V code within its AIX operating system. A lot of not-very-nice words were used last year to describe the litigation that SCO was initiating. This year, things were different; the name "SCO" was seldom heard.

It looks like Cory Doctorow's talk to Microsoft about why copy protection is bad for everyone -- including the recording industry, customers, and Microsoft itself -- didn't have much of an impact. Microsoft is now in talks with the recording industry about how to build copy protection into their next generation operating system to make sure you can't actually do what you want with the music you buy. Of course, this is likely to be an expensive waste of time that will only annoy legitimate buyers by causing problems. The people who really want to copy music will figure out workarounds. The large counterfeiters will already have big workarounds, so it won't impact their business at all. The only people impacted will be people who want to do perfectly legitimate things with the music they bought, but find out they're blocked because Microsoft and the recording industry doesn't trust them.

When my son was a bit younger, we noticed that when we asked him a question, he'd answer with a question. Inevitably this led to the following exchange:

Computer Weekly is reporting that Apple has admitted that a minor security update to the Mac operating system has prevented users from gaining access to certain websites or running Java-based applications. After updating to Mac OS X 10.3.9, some Mac users have found their Safari web browser quits from Java-enabled websites, and Java programs on the machine may not launch or suddenly quit. The update was released on Friday. Computer Weekly reports Apple as saying the problem could be fixed by re-installing two earlier security patches - Java 1.4.2 Update 2 and security Update 2005-002.

It seems you can't go a day without finding some sort of out-dated law that isn't quite ready for an internet-enabled world. Earlier this month, there was the story of a new law in Ohio that would force eBay sellers to get an auctioneer's license (which requires a one-year apprenticeship). However, it turns out that many states already have very similar laws, mostly targeted at traditional pawn and consignment shops. In some cases, these laws require anyone selling goods on consignment to file a daily report to police, including home info and fingerprints of those trying to sell items. Can you imagine going into a place like AuctionDrop and having them fingerprint you? Some (mainly existing pawn and consignment shops) are pushing for state officials to start enforcing those laws -- especially against all of those new eBay middleman shops like AuctionDrop. However, the laws are not really written in a way to separate out these shops from individual sellers, which could make it tricky. The reality of the situation is that these existing pawn and consignment shops are simply using this as a way to get at the online competition, when they should be more focused on why we have these laws in the first place. Of course, it might not matter all that much, as it appears many of these eBay middleman shops aren't doing particularly well -- but for the individual seller at home, it could be a potential regulatory nightmare.

Here's more on today's New York Supreme Court decision on gay marriage. The court ruled that the New York's city clerk may no longer deny marriage licenses to gay couples. The decision, which is available here, won't take effect for 30 days, leaving time for an appeal to be filed before the city clerk would have to begin allowing gay marriages.

A new study suggests that with the rise in telecommuters, many employees have never even met some of their closest colleagues. Because of that, many workers feel that they don't have as close a relationship to those colleagues as they should, and may not trust them as much as those they work with in person. In other words, there are other unintended consequences of telecommuting. Again, this seems to be the sort of thing that's highly dependent on how the telecommuting is done. For a team that works in a dispersed manner, it's still helpful for them to get together on a regular basis. "Invisible" workers who are going to be working closely with each other should be brought together occasionally. It may not completely solve the mistrust issue, but it's better than having them be completely faceless.

Imagine you go out buy a Game install it play it several months and then remove it from your computer you would expect the game to clean up after itself. Apparently Starforce copy protection is embedded in some games and installs itself onto Gamers hard-drives and when the games are removed the Starforce code remains. This has led to performance issues and being these gaming companies assume every consumer is a criminal. They have decided invading these peoples computers is a good for business. If I wanted to copy a game I would just go on the net and download the cracked version. Gaming companies need to start treating their customers like customers instead of criminals. [Techdirt]
