One thing you can definitely say about Michael Robertson is that he knows how to use controversy and lawsuits to get publicity. After first losing the trademark dispute with Microsoft over the Lindows name in Benelux, he changed the product name to Lin---s. This didn't make Microsoft happy, so they changed the name again to Linspire. However, it appears Microsoft is still not satisfied and is asking the court to fine them again - which must delight Robertson for the publicity he's getting. However, when you look at the details, this move by Microsoft seems particularly petty (though, it must be admitted, switching the name to Lin---s was fairly petty as well). Here, the complaint is that in the copyright notice on the Linspire page, it still says that Linspire is owned by the company Lindows. Microsoft is claiming that this will confuse people - which is a huge stretch. The judge should toss this out. Meanwhile, Microsoft and Lindows/Linspire should stop wasting time over things like this and spend their money and effort on things that actually make their products more useful.

Fortune's David Kirkpatrick is looking at the Microsoft suit against Lindows.com accusing them of trademark violation. He talks to Lindows CEO Michael Robertson, and buys into his arguments completely... until he speaks to a Microsoft representative. The arguments seem to be all over the place, but the one point that is most important is whether or not people will be confused by a product called Lindows, and think it was created by Microsoft. Microsoft claims to have a study saying that 18% of people would be confused. Is that enough to force a name change? Meanwhile, Kirkpatrick points out that the folks at Microsoft should probably be more worried about the actual desktop Linux offerings that are coming along, rather than what anyone calls their products.

There was a lot of hype last year around Korea's Ohmynews service that let anyone write articles for it. While there have been some attempts to recreate it elsewhere, one of the most interesting is described in today's Wired News. Instead of just building a similar "citizen journalist" project from scratch, an already established newspaper in a small town in California has thrown open their website to local residents to publish their own articles or photos. The news covers typical local interest stories: school news, community news, youth sports, etc. There are editors on hand who review the submissions to make sure they're on topic. It's an experiment worth watching. While it's not likely such a system will replace existing journalists, it certainly is a way to enhance coverage. There are risks, of course, such as dealing with unsubstantiated or biased reporting in those cases, but as the article notes, it seems to work well in this type of community, where the focus really is on local events -- where many of those involved have a better handle on what's happening than a local reporter would.

Microsoft's trademark lawsuit against Lindows will continue to trial, possibly later this year, after a federal appeals court denied Microsoft's appeal request. Microsoft was questioning an earlier court decision that found Microsoft's trademark on "Windows" to be potentially invalid because the word is a common term. Microsoft had argued that the term wasn't generic in the computer industry, despite its general use to describe onscreen objects in various graphical systems dating back almost 30 years. And because Microsoft does own a trademark on the term, it had sued Lindows for naming its Linux distribution Lindows, a name that might confuse consumers.

SAN FRANCISCO - The California Supreme Court on Thursday voided the nearly 4,000 same-sex marriages sanctioned in San Francisco this year and ruled unanimously that the mayor overstepped his authority by issuing licenses to gay and lesbian couples.

In February I remember all of the happiness when the Mayor decided to allow same sex marriages in San Francisco. I had friends who were married that day and even saw the line of happy couples lined up at City Hall. At the time Dan Gillmor voiced concern that Mayor Newsom had overstepped his the bounds of his executive power when he declared a state law prohibiting same sex marriages unconstitutional. Larry Lessig chimed in and wrote that at times the executive must push those bounds if they believe something to be genuinely unconstitutional. The last paragraph in Lessig's post has an important caveat.
One critical caveat: The rule of law requires some coordination. So if a court decides that a law is constitutional, while an executive has the right to disagree, and even push to have the decision changed, it is important that the executive follow the law at least with respect to that case.
...Thus, if California courts decide the marriage law is not unconstitutional, then Newsom should then obey that law as ultimately interpreted.
