around the iPod, with a ton of accessories on the market thanks to
this one single device. Back in January, Apple announced that it was
going to start a "Made for iPod" marketing program that would let
accessory makers add a special logo to their products or marketing
materials. What wasn't reported, however, was that
Apple wants 10% of
the wholesale price on any "made for iPod" products (backed down
from 10% of the retail price). This sort of thing isn't that
uncommon, but taking 10% just so you can use an specific logo seems a
bit steep. What's to stop a company from just pointing out that their
product was made to work with the Apple iPod -- without using the
specific trademarked phrase of logo?

suing Apple for antitrust
violations, claiming that they broke antitrust laws by only
allowing their music to play on iPods -- blocking out other music
players from the market. It's unlikely that he'll win the lawsuit,
and honestly, it sounds more like a setup by an Apple competitor than
just some individual who feels wronged. The guy in question says he
was "forced" to buy an iPod in order to make use of the music he
bought on iTunes, but the courts will likely point out that he could
have gone to a competing online music store. Of course, what this
really highlights is how some of these copy protection issues are
building fragmented worlds. How would people react if the CDs they
bought at Tower Records could only play on Tower-branded radios?
Thanks to the way the industry views intellectual property online, the
end result is a lot of competing separate worlds, which actively
discourages use.

According to the RIAA, CD sales are increasing. Now, the RIAA also
says that P2P destroys music sales, so it follows that if they're
selling more CDs there must be less P2P, right? Uh, no -- file-sharing
is up, too (so CD sales should be falling right?).
So is it possible that CD sales and P2P are decoupled (as all the
quantitative, independent research
a> indicates), and that the downturn in CD sales is better laid at the
feed of bad business, a bad economy, fewer albums and more things
competing for entertainment dollars (cough games cough Internet
cough).
The number of CDs and other music products shipped from record labels
to retail merchants rose 2 percent last year, to 814 million units,
the first annual increase in five years, according to the Recording
Industry Association of America.
