preliminary injuction. In other words, SearchKing asked for their
PageRank to be put back to where it was while the trial was being
held, and the judge said no. LawMeme has the full story, including
several interesting quotes from the judge's dedcision. The author has
an interesting thought in the comments:Let's step over into Bizarro
world, where Badgle, the leading search engine, is run by Dr. Evil.
Badgle uses familiar algorithms to rank pages, except that whenever
its engineers find a page they don't like, they manually drop it down
a hundred pages in the search results. And, interestingly enough, the
only pages Badgle doesn't like are those that praise Austin Powers.
Thus, when you run a Badgle search on "Austin Powers," you get back
only pages making fun of his bad teeth. Whenever someone wonders why
the leading Austin Powers fan page has a low ranking and asks Badgle
what's going on. Badgle replies that the page's operator "was engaged
in behavior that would lower the quality of Badgle's search results."
Would this scenario change your point of view? Maybe not, but I
suspect that there are many people who support Google whole-heartedly
in this lawsuit, but who wouldn't be so willing to support Badgle's
actions.So this decision could have much farther-reaching effects than
whether search engines can demote the PageRank of "spam kings". Stay

08/18/2004 04:26 PMAnother lawsuit has been filed against Google due to the companies
AdWords keyword advertising program. So next Tuesday Google will be
heading over to a German courtroom where it will continue to defend
its technology against Metaspinner Media GmbH.
Metaspinner claims that Google's AdWords keyword advertising program
infringes on its "Preispiraten" trademark. According to
PCWorld Metaspinner already "won a preliminary injunction against
Google last November and is seeking a permanent injunction and
damages." This isn't the first time Google has been taken to
court for similar trademark infringements. Earlier this year American
Blind & Wallpaper Factory accused Google that its search engine's
keyword-based advertising violates its trademarks.
This probably isn't the last of these types of lawsuits, eEspecially
since several companies use generic words in their names - e.g.
General Motors. Because of this, Google could also be targeted for
keyword-based advertising. For Google's ad program to be ever
sucessful, they need to resolve these issues once and for all.

seemed
to misunderstand the purpose of trademarks a second French court
has ruled that
Google cannot
sell ads based on trademarked keywords. This time, the case was
brought by Louis Vuitton Malletier. Here, the argument appears to
make a bit more sense on its face, as it wasn't competitors that LVM
was worried about, but counterfeiters selling products to people who
searched on the Louis Vuitton name. Except... that's wrong. Louis
Vuitton Malletier should be going after the counterfeiters, not
Google. The counterfeiters are the ones who are breaking trademark
law by advertising products that aren't actually Louis Vuitton. So,
why is Google involved at all? They're just offering the platform by
which these ads are placed and shouldn't be responsible at all for the
content of those ads. Furthermore, as long as the ads aren't
confusing buyers about the nature of the products, then there's no
reason for it to be trademark infringement. It's just in cases where
there is confusion -- and then it's the company doing the confusing
that should be taken to court.

stop Google from borrowing without permission headlines, texts and
pictures from the agency for its news pages

suing for what amount to 13.2 million euros in damages. The agency is
claiming to have asked Google repeatedly to remove the content in
question, with the company having failed to react to the requests,
however.

This new, official, logo has been displayed since the 24th of October
and
those of you who wondered how it has been picked and what the name of
the
winner is should read up in the PR section.
The longer explanation also features a larger version of the logo
itself,
so that you may have a closer look at its details. We like our new
logo,
we hope that you will like it too.
IMPORTANT: We do not yet have a formal licensing agreement for the
new
logo and so are unable to give permission to distribute it.

That's all I've got. I actually don't hate it, really, and it'll be

logomarks that I would be liekley to use this as a crib-sheet for

green wireframe swooshy pop-art blob? That is
