to trial this morning, but didn't stay long. The judge quickly
dismissed all of SCO's relevant complaints against Daimler.
At 0959, Mr. Rosenbaum was given another minute to answer
SCO's arguments, and broadly stated, "Your Honor, this is a fishing
expedition." In the original complaint, there was no claim that DC had
exported the software or disclosed it to anyone outside the company,
that the case is about DC's breach of section 2.05 of the SA. The
language of the 2.05 section has nothing about a certification that DC
kept the software confidential, at which point the judge looked rather
amused.
At 1000 Judge Chabot issued her orders:
Summary disposition is granted except on the matter of breach of
section 2.05, in that DC did not submit their response in a timely
manner. All other claims were dismissed and she acknowledged that the
contract doesn't require certifications that are outside the language
of the contract. . . .
In other words, things are going well for you if you're shorting shar
es of SCO.

finally over? We've been
following the
case since 1999, but it really started a decade ago when Stephen
Cohen forged documents to have the domain transferred to him. That
set off quite the legal saga, eventually leading to the domain being
transferred back to its original owner, Gary Kremen, along with a
ruling that Cohen owed Kremen $65 million. That's when things started
to get more bizarre. Cohen high-tailed it to Mexico, and started a
series of
odd
appeals, including one where he claimed that the ruling was
unconstitutional, since it would effectively make him a slave
to Kremen. He also claimed that he trademarked Sex.com in 1979, which
no one seems to buy. The Court of Appeals has now
turned down his latest appeal, and it's likely
his decision to leave the country didn't help matters. In the
meantime, Kremen went on to successfully sue Network Solutions for
handing over the domain name in the first place, so he's made some
cash out of the ordeal. Still, the case might not really be over yet,
as Cohen plans to appeal again to the Supreme Court -- though, it
seems exceedingly unlikely that they'll agree to hear this case.

article, another 32,000 US Citizen's dates of birth, SS numbers,
drivers license numbers, and other ID info were all stolen from
Seisant, a division of Reed Elsevier.
Reed Elsevier says it is in the process of contacting those
affected by the breach and will offer them assistance in detecting any
possible identity theft resulting from their lapse.Seisint, which was
acquired by Reed Elsevier in 2004, has previously come under criticism
for giving government officials the names of 120,000 people who
supposedly fit terrorist profiles in the wake of the attacks of
September 11, 2001. Now, it joins the growing list of companies that
traffic in consumer data without taking adequate safeguards to protect
it.
