After the bubble popped, many VCs practically stopped all investing. In the cases where they did invest, they often put in incre dibly onerous terms that gave the VCs a lot more power than they might have deserved (though, some VCs will disagree with this). Of course, now that times are getting better, people are saying that VCs are tightening terms again - so as not to get burned. What this really means is that many VCs are looking for any reason to make the terms more in their favor. Times are bad? Terms need to be tighter. Times are good? Terms need to be tighter to make sure they don't go bad again. The obvious response, of course, is that it is the VC's job to get good terms - but if those terms cause more problems, it's a strategic mistake. If entrepreneurs feel that their VCs are ripping them off, it defeats much of the purpose of getting that VC money in the first place. Besides, as the startup market picks up again (as it's doing) this becomes less of an issue. Already, we hear stories about VCs offering ridiculous valuations to companies because they're in a "hot" space. When competition for the hot startups increases, VCs are suddenly willing to make the terms a bit more reasonable.

PeopleSoft Turns Down Latest Bid By Oracle: PeopleSoft stock closed at about $22-and-a-quarter yesterday, so $26 a share is a nice premium. How long can they keep saying no?

PeopleSoft Inc. yesterday rejected Oracle Corp.'s $9.4 billion hostile takeover bid, saying the $26-a-share offer is too low and expressing serious doubts about whether the proposed combination would receive antitrust approval from regulators in Washington.

Back in early 1999, Peterme half-jokingly came up with "blog" as a shorter form of "weblog" and despite everyone pretty much universally disliking the word "blog" or "blogger" or "blogging" ever since, the name has stuck. I've never really liked it and lately I've taken to using the word weblog as often as possible, but I'm reminded of the very first time I used the short form of the word every single day since.

If you take a look at the top right corner image of the MetaFilter design, you'll see "Community 'blog" which is oh so quaint because when I designed the layout in May of 1999, I was pressed for space and couldn't fit "weblog" there. I even added an apostrophe to blog, because the contraction seemed so odd at the time. And yet, five years later it still remains.

How many of you think we live in perilous times? I agree (with those of you who think we do). For the rest of you, think again. We live with the ever-present threat of another terrorist attack. On 9/11, you were shocked. If another such event were to occur five minutes from now, you would be horrified, but not shocked. The expectation now rests just under your level of consciousness. Moreover, we are engaged in an ever-more disturbing war in Iraq. Last night, I watched the movie Fog of War (the Robert McNamara documentary). The similarities in the depth of American foreign policy misunderstandings between the Vietnam War in 1966 and the Iraq War in 2004 are stiking, and unnerving. There is much to fret about. I want to make it worse. I want to give you something else to worry over. You should be losing sleep about the security of your civil liberties. The United States has a long and consistent pattern of unduly restricting civil liberties in time of war. Time after time, we have panicked in the face of war fever. We have lashed out at those we fear and allowed ourselves to be manipulated by opportunistic and exploitative politicians. We did this in 1798, when we enacted the Alien and Sedition Acts, during the Civil War when Lincoln suspended the writ of habeas corpus, during World War I when the nation brutally suppressed all criticism of the war and the draft, during World War II when we interned 120,000 individuals of Japanese descent, during the Cold War when we humiliated, abused and silenced tens of thousands of individuals for their political beliefs and associations, and during the Vietnam War when the government engaged in an aggressive program of surveillance, infiltration, and surreptitious harassment designed to "exposre, disrupt, and neutralize" antiwar dissent. We have made some progress over the past two centuries. We are less likely to do some of these things today than we were in 1798, 1863, 1917, 1942, 1950, or 1968. That is a cause for celebration. But that progress is fragile. The forces unleashed in wartime are extremely powerful, and the fear, anxiety, anger, and vulnerability that war entails can quickly translate into persecution and oppression. Certainly, we have seen warning signs of this in some of the actions of the Bush administration since 9/11. Imagine what might happen if we were now to suffer a succession of six 9/11-like attacks over the next six weeks. Can we learn the lessons of history? Can we avoid repeating the mistakes of the past? Given the pressures and fears of war, can we discipline ourselves both as individuals and as a nation to respect civil liberties even in a time of war? And is it even sensible to talk seriously about civil liberties in wartime? What do you think?

Airports are finally getting the Wi-Fi religion, but only 19 of top 50 airports have service; 6 are deciding on vendors: I know regular readers of this site are used to seeing my byline on any Wi-Fi obsessive article in the New York Times, but I can't be everywhere. Jane Levere writes an extremely tight wrap-up on the current and future state of Wi-Fi in airports, focusing on pricing, utility, and the lack of roaming plans. As noted earlier today, SBC has signed roaming agreements with a number of airport providing hotspot operators: if it added Sprint PCS and AT&T Wireless's locations, it would have the hat trick. But until SBC actually adds it's newest partners into their network and signs additional locations, we've got a pretty scattered set of airports under any given plan. One item not mentioned that affects Wi-Fi in airports is the airlines and concessionaires sudden ability to put in their own networks per a recent FCC clarification that only they can regulate unlicensed spectrum, not landlords or airport authorities. This report is just a month old, and I'm sure that airlines, retail shops, and other tenants of airports are still digesting the decision and beating airport authorities over the head about it. We'll very likely see a number of interesting airport options that crop up with that artificial landlord restriction removed. The authorities may try to keep a lid on through other methods, but the FCC handed tenants a blunt instrument. (Now, don't get on me about spectrum etiquette and coordination. It's a good idea. If you have 20 networks operating in a small space all on the same channel--very bad. Tragedy of the commons. And so forth. But etiquette is enforced when no one gets utility unless everyone cooperates. Prisoner's Dilemma and all that. Thus, spectrum coordination for unlicensed use can happen ante or post facto.)...

A couple months ago, I chatted with someone who said the New York Times was considering going to a subscription model for nytimes.com, similar to the Wall Street Journal. I said that would be a foolish and short-sighted decision on the Times' part; to place their content behind a subscription wall would be to remove themselves from online conversations now and in the future.

Adam L. Penenberg, in an article for wired.com on February 24, 2005 about the Wall Street Journal's for-pay approach, Whither The Wall Street Journal? expressed a similar point of view:

Since most people refuse to pay for WSJ stories, most bloggers are reluctant to link to them. It also has an impact on anyone who uses the web for research -- and there are a lot of us. As importantly, the next generation of readers is growing up by accessing news over the internet, and one place they are not surfing to is WSJ.com. With their habits being formed now, there is little chance the Journal will become part of their lives, either now or in the future. (emphasis mine)

And yet, yesterday the Times issued a press release, The New York Times Announces TimesSelect - New Online Offering to Launch in September announcing their decision to move more content to an expensive for-pay only section of their site. This is a move in the wrong direction: The Times should remove all barriers to content, from their registration requirement to their for-pay archive access. Such action would enable and increase linking to their broad range of content.

As Jill Walker writes in her paper, Links and Power: The Political Economy of Linking on the Web, "Links have become the currency of the Web. With this economic value they also have power, affecting accessibility and knowledge on the Web."

Enabling more links to the New York Times would:

  • increase the visibility of the Times brand
  • help content reach a larger segment of readers
  • increase traffic to the site

Clearly, increased traffic would drive increased revenue in the form of online advertising. And in the long term, I believe it would generate more income than charging US$49.95 for an annual subscription. Perhaps US$49.95 is, as Martin Nisenholtz (senior vice president of digital operations for the Times) says, a "terrific price point" for what they're offering -- if you happen to live in the US or western Europe. But it truly is a world wide web, with English as its de facto language.

As media brands increasingly become more global, it's hard to fathom why the Times wouldn't do everything in its power to ensure it's the world wide web's news leader. By charging for its online content, the Times reduces its number of linkable sources, and thus its reach in the online world. It's their first step towards ensuring they will play a smaller role in it going forward.
