Two signs that SCO is desperate 12/24/2003 12:16 PM

As SCO widens its arguments, the whiff of desperation is becoming a full-fledged stank. So, now the Gnu Public License itself violates copyright law? According to CEO Darl McBride, the GPL removes the profit motive from software development and the profit motive "underpins the constitutionality of the (U.S.) Copyright Act." Here's Linus' reply: "I'm a big believer in copyrights," Torvalds wrote in an e-mail interview. "Of all the intellectual property (laws), copyright ... is the only one that is expressly designed so that individual people can (and do) get them without having scads of lawyers on their side." "If...

For those of us who scour the Internet on a daily basis, searching for the latest tidbit regarding Apple’s next innovation, we may be finding a dearth of information in these, the weeks surrounding the anticipated Macworld San Francisco conference. After all, no one wants to be served by a big bad American corporation, especially not during the holidays. Court papers show that Apple is on the legal warpath, suing "anonymous people who leaked details about new products by posting information on the Internet." According to Reuters, Apple said in the seven-page civil complaint, filed on Dec. 13, that it did not know the "true names or capacities, whether individual, associate, corporate or otherwise," of the defendants. Once they have been discovered, the Cupertino, California-based company said it would amend the complaint. It's not like we haven't seen this before. Apple filed similar lawsuits in August 2000 and December 2002 after information was leaked its new mouse and dual-processor Power Macs, but every time this type of suit rears its ugly head, it puts the Mac Web world on high alert. If it was color-coded, we'd be at orange. And as we in the States know, orange isn't all that different from yellow or blue. Sure, we'll see a few extra headlines in the mainstream press regarding Apple's action against these so-called "unnamed individuals." We’ll see a lull in official rumor postings. And the true believers will let their minds wander just a little further before Steve’s keynote presentation on Jan. 11. But in then end, we'll all — from ThinkSecret to AppleInsider — ask the same question: Is it really worth the risk? With the iPod, Apple is in a truly unique position. While it's always been a company of innovation, now its sales, stock price and bottom line directly depends on it. Before, a design leak of the Power Mac or the iMac meant a stir within the Mac community, intense debate on Spymac or MacRumors, and a slight revision of Steve's keynote speech. For instance, in January 2003, less than a month after a suit against former contractor Jose Lopez for leaking images of the new Power Mac, Steve spoke of the rumor drought, after introducing the new 12- and 17-inch PowerBooks, Airport Extreme, Safari, Keynote and iLife: "The rumor sites said this was going to be the most boring Macworld in history." Clearly, he was having fun with us. But now, more is at stake. If Apple indeed releases a micro version of the iPod in January, and, let’s say it starts shipping it in March, the competition will have already had a five-month head start. Apple’s lifeline is all but dependent on the period between its product unveiling and the first copycat hits the scene. If there's no buzz, if Dell or Creative beats them to the punch, you can wave goodbye to its dominance in the market place. Millions of new Apple fans will be clutching their iPods on Jan. 11, waiting to see what Apple unveils, and ready to purchase the next big thing. Over the years, we've seen rumor sites come and go, but more than any other tech company, the Mac community is built on this very gossip. For every site we lose, another pops up, each staking their claim at becoming the next ThinkSecret or MacRumors. But if the sources dry up, what will become of these rumor-based sites? Apple has always threatened rumor sites with legal action if they didn't remove the offending image and/or text from their site, but we've yet to see any real action taken against the Web for posting such information. However, with the recent rash of journalists who are being leaned on by U.S. governments to divulge their sources — Jim Taricani from my home state of R.I. comes to mind — who's to say Apple won’t shift their attention to our favorite rumor sites for information? So, let's just say, this suit likely has a bit more teeth than the last two. If I had to guess, we'll see a swift follow-up on this story, naming the perpetrator(s), and possibly more suits in the near future — not two years down the line.

How low can Napster go? Desperate much? 02/05/2005 09:07 PM
I was looking thru the info of Napster to go, just out of curiosity. I clicked on the link for "Look at compatible MP3 players, and it was the standard Dell, Creative, Gateway MP3 players. At the top of the list, they say, "Got an iPod, click here" and when you do it sends you to this page.

That is really really desperate if you ask me.

A desperate plea for biscuits...

A desperate plea for biscuits... 02/07/2005 02:03 AM

What follows is pretty much the archetypical weblog post. I mean it doesn't have cats in it or anything, but it's the next best thing. It's like practically award-winningly archetypical. You want to give someone a lifetime achievement award for weblogging or something, then it would be for quality posts like this one, right? Right?

When I was a kid - and I mean something like seven or eight years old - I lived in a house in Norwich on a road called Sunningdale. My mother used to do a lot of her local shopping in a tiny little shop on Unthank road. I cannot remember its name. Anyway, my mother used to get me these biscuits - they were made by Bahlsen and were called ABC biscuits - and I used to love them. They were absolutely, undoubtedly my total favourite biscuits. It was my special treat to get a packet of these biscuits.

Anyway, one day they weren't there any more. Just like that, they were gone. And after a few brief weeks of hoping they'd turn up again, my tiny child-brain got used to the idea that they weren't coming back and somehow I managed to get on with my life. Every so often I've found myself in a shop with Bahlsen biscuits and I've had a bit of a scout around to see if they had them. But they didn't. But hey - no biggie, right?

Recently, however, my family went on holiday and what should they find in some obscure shop is southern Spain, but packets upon packets of my favourite biscuits. And so they bought them. Six packets of them. And I tried them, and they were really nice. And now I've only got one packet left (pictured below). So here's where you guys come in. I don't want to sound like an addict, but does anyone know where I can get more of these gorgeous beautiful biscuits? I'll send you cash money for them. If you know a shop in London where I can get them, I'll be overwhelmed with good-will towards you.

picture of Bahlson ABC biscuits

So there you are - a long post about biscuits in the tradition of English weblogging. But yet also somehow with a touch of self-aware poignancy, because these aren't just biscuits. They're also a part of my personal narrative - a piece of my living history rediscovered! Crunchy history! Chocolaty history! Mmm... History..!

Here's the desperate, pathetic message I got from Friendster today. I'm starting to think they just don;t matter anymore.

I just feel sorry for Reid and Mark. They should have sold when they had the chance!

You're our favorite subscriber!

Seriously. I know we here at Friendster shouldn't play favorites, and our chief operating officer (he's the old guy in the office) told us not to do this, but seriously, you just totally rock. The way you reconnect with old friends. The way you've figured out just how small and interconnected the world really is. The way you discovered people with the same interests as you. We suspect you've even gotten a date out of Friendster, or that if you didn't, you could have if you needed to. Easy. With one of those three suspiciously hot people who keep popping up right above your friends list. For other people, we just use those pictures as cruel, aspirational temptation. But for you, they're totally getable.
We even made Friendster much faster just for you. But hey - don't tell anyone we told you all of this. That old guy in the office will just start lecturing us again and pulling out charts and graphs and PowerPoint displays. He's such a loser.

Thanks,
Your friends at Friendster

Jeff Adkins: "These ideas are for Mac products (mainly). and some of them are not big enough to pay the rent. but that's not the point of this article. I've been reading an article or two a day about some out-of-work programmer complaining of job outsourcing to India. I've kind of got a problem with that myself, actually. I mean, if we can prop up agriculture with subsidies, why not high tech?"

Hmm - why isn't WhizSpark part of this consortium? I wonder if they wanna help put up shared XML servers of Events - scraped from throughout the web? That's what OpenEvents is all about. Open APIs into shared Events.

AOL Signs Off From Sender ID

AOL Signs Off From Sender ID 09/17/2004 06:43 AM
America Online has decided not to fully support Microsoft's Sender ID spam-fighting plan after the Internet Engineering Task Force and the open-source community expressed intellectual property concerns. "AOL will now not be moving forward with full deployment of the Sender ID protocol," spokesman Nicholas Graham said in a statement sent via e-mail Thursday. Instead, the Dulles, Virginia-based Internet service provider will support only the Sender Policy Framework to fight spam by verifying the source of e-mail sent to its users, he said.

AOL's rejection comes a week after an IETF group considering Sender ID as a standard said the proposal needed rewriting. Earlier this month, the open-source groups Apache Software Foundation and Debian Project dismissed Sender ID because the license would prevent them from supporting the technology. AOL is concerned about the lack of acceptance for Sender ID in the open-source community, Graham said. Additionally, the ISP is afraid that recent changes to Sender ID will make it incompatible with the original SPF specification, he said. AOL had endorsed Sender ID when it was submitted to the IETF in June.
