CDBaby, a wonderful indie music publisher, has put up a howto for legally selling downloads of cover songs.
If you record a cover version of a song, (meaning your performance of a song that has been released in the U.S. with consent of the copyright owner), you are entitled by law to release your recording commercially, and the owner of the copyright to the song cannot prevent you from doing so.

The Copyright Act provides for what is called a "Compulsory License", which means that if you follow the steps set forth by statute, you can distribute your recording of that song on a CD or over the internet.

The following details the procedure for individuals to obtain a compulsory license to digitally distribute cover songs over the Internet to end users in the United States.

Wireless LAN switch maker AirFlow has stopped selling switches and will just sell software plus a third-party chip to other switch makers: The move is an indication of how crowed the WLAN switch market has become. An AirFlow spokesperson in this story says that in order to succeed at selling WLAN switches, the company would have to make significant investments in international sales and marketing plus make sure its switch supports all the features that all the other WLAN switch developers include. That's an expensive and challenging proposition. I'm not sure how big the market is for AirFlow's new software strategy, however. I would think that the other startup WLAN switch makers wouldn't need the software because they've already built their own. As Network World's John Cox notes, switch vendors such as Extreme and Foundry have already developed upgrades to their own switches to accommodate for WLANs. It doesn't seem like there's a very clear market for AirFlow's software. As Cox also notes, we've already seen some struggles in the WLAN switch market. Trapeze and Vivato both had layoffs. It's a very crowded market and potential buyers are moving slowly as they wait for a shakeout and for product maturity. The switch vendors that survive will have to have deep pockets and innovative offerings....

Apple and Real Networks are feuding over access to Apple's popular iPod music player. Real released Harmony , an application which allows users to play music downloaded from Real's online music store in, among other players, the iPod. The iPod is designed to play music downloaded from iTunes , its popular online music store , and especially those encoded with Apple's Advanced Audio Codec ( AAC ) standard. Apple attacked the move, and threatened a programming reaction:

"We are stunned that RealNetworks has adopted the tactics and ethics of a hacker Latest News about hacker to break into the iPod, and we are investigating the implications of their actions under the DMCA [Digital Millenium Copyright Act] and other laws. We strongly caution Real and their customers that when we update our iPod software from time to time, it is highly likely that Real's Harmony technology will cease to work with current and future iPods."

Real, whose CEO had asked Apple to open the iPod to other file formats earlier this year , reiterated its request.

In posting its quarterly financial results on Monday, Roxio Inc. announced plans to sell its software division to Sonic Solutions in a transaction valued at US$80 million. The deal is subject to the customary regulatory and shareholder approval, but Roxio has already outlined plans to change its name to Napster, focused solely on selling digital music. Roxio makes Toast Titanium CD and DVD burning software and Jam audio mixing software for the Macintosh, as well as Easy Media Creator and other titles for Windows.

Microsoft Tuesday completed its acquisition of antivirus software vendor Sybari Software with the decision to continue selling Sybari's products on a stand-alone basis.

Microsoft will offer a host of Sybari products for Windows, including Antigen for Microsoft Exchange, Antigen for Microsoft SharePoint Portal Server and Windows SharePoint Services, Antigen for Instant Messaging and Antigen for SMTP (Simple Mail Transfer Protocol) Gateways.

At the same time, however, Microsoft will discontinue selling versions of Antigen for Lotus Domino running on Unix and Linux platforms, though the vendor will continue to support current users of those versions.

Amy Roberts, director of product management for Microsoft's security business and technology unit, called the move a "business decision" since only a "very, very small percentage" of Sybari software is sold for these operating systems. She added that Microsoft will continue to sell Antigen products for Lotus Domino running on Windows, easing concerns that Sybari's software will become an Exchange-only product.

Though Microsoft purchased Sybari primarily as a way to protect users of Exchange, SharePoint portal and SharePoint services from viruses and spam, Microsoft is mulling the possibility that other Sybari software properties might be used across other Microsoft products, Roberts said.

In addition to antivirus and antispam software, Sybari also offers Enterprise Management, software that allows administrators to manage and monitor multiple Sybari technologies running in a system.

Microsoft will have more to say about any plans to leverage Enterprise Management across Microsoft infrastructure once the product engineering teams develop a strategy, she said.

Microsoft originally announced its intention to acquire Sybari in February to provide server-level antivirus security in light of numerous virus attacks against its Exchange e-mail server.

Microsoft previously purchased antivirus vendor GeCAD Software Srl of Bucharest, Romania, in June 2003, and plans to leverage GeCAD's antivirus scanning engine for use with Antigen products. Sybari offers customers a choice of third-party scanning engines rather than providing its own.

In addition to GeCAD, Microsoft also will continue to offer third-party scanning engines, such as those from Sophos PLC and Computer Associates International Inc., with Sybari software, Roberts said.

    "A 23-year-old Singaporean woman appears to have set a world record for sending text messages over a cellphone, underlining Asia's growing obsession with cellplhone technology.

    Kimberly Yeo thumbed 26 words in 43.24 seconds into her phone, beating a world record of 67 seconds for the same words set by a Briton in September 2003, said Singapore's dominant telephone carrier, Singapore Telecommunications (SingTel), on Monday.
