Mark Frauenfelder: Well-known environmentalist Willie Fontenot was giving some college students a tour of an oil refinery recently. They were standing on a public sidewalk, taking photographs of the refinery, when sheriff's deputies and refinery security guards came over and asked Fontenot to confiscate the students' drivers licenses and hand them over. Fontenot refused, and as a result, he lost his job as community liasion officer for the Louisiana Attorney General's office.
Antioch New England Graduate School, whose students were photographing the refinery, has announced that it "is working with Marylee Orr, Executive Director of the Louisiana Environmental Action Network (LEAN), to create a fund to help Mr. Fontenot make up his lost salary and continue to work for environmental justice in Louisiana through a nonprofit organization of his choice." The Louisiana environmental community is also looking into what else it can to defend the right to stand on a sidewalk and talk to students. How sad.

While most of the Supreme Court attention yesterday went to the Grokster case, the Justices also heard the Brand X case, which was an appeal on a rulin g from a few years back, saying that the FCC was wrong in classifying cable broadband services as "information services" instead of "telecom services" -- and, thus, opening up the cable companies to forced line sharing rules. While it might not mean anything, the initial reports suggest that the Justices were skeptical of the cable companies claims, and seemed to wonder why cable broadband and telco broadband were being treated differently. Unfortunately, the case isn't quite as straightforward as it might appear. The reason the telcos have line sharing rules in the first place is because they came by their copper lines through the breakup of a government granted monopoly. These were systems built with government backing (though, as some have pointed out, the cost of those lines should be next to nothing by now). Most of the cable systems were built by private companies. That's a big distinction, and really is at the heart of this case. While both sides claim that competition will be stifled if the other side wins, that seems unlikely (either way). With the FCC leaning again st line sharing, even if cable offerings are classified as telecom services, they might not be required to share lines. However the court decides, though, it is likely to influence many other FCC rulings that impact a variety of different services, such as VoIP -- since it will set up the regulatory framework by which the FCC can rule across both cable and DSL. If both are aligned, it should also play into how they regulate wireless broadband technologies as well. In other words, the specific decision may not have a direct impact right away, but the eventual consequences may be far reaching.

Kuro5hin is in danger of losing its relevance. What makes a website like this worth visiting is if there are many users contributing to it and currently there are not enough contributions to this site to keep it interesting. Whilst in its heydey in 2001 it clocked up approximately 100 million page views per day and had almost half a billion regular users, the current statistics are less exciting. Only six comments have been posted in the past year and usually there is only one page view per week, from the monkeys in Berlin zoo who have internet in their cage. The site needs to be much more dynamic. We need to think up ways to get more users contributing. Below are a few ideas which I think may help: Pay people to contribute. Disguise Kuro5hin as a more popular website and trick people into contributing. Employ bots which will mimic real users, posting randomly-generated comments and stories. Make Kuro5hin ultra-hip and then use viral marketing to promote it. Cause the passage of time to be accelerated so that the site seems to be more busy. Promote Kuro5hin in establishments such as mental hospitals, nursing homes and prisons, where people don't have much to do but have interesting opinions. Inside I will discuss these ideas and ask for additional ones.
