Earlier today we reported how the US has now legal ized spam, and now the debate continues. Ray Everett-Church has an opinion piece explaining that the law is called "Can Spam" because it teaches spammers how they can spam. He points out that it's basically an outline of all the loopholes that will make it possible for our in-boxes to become even more crowded with junk than usual. Meanwhile, the sponsors of the bill have fired back against all the critics, saying that it's a good first step. They pretty much ignore the point about legalized spam from direct marketers, insisting (against popular perception) that spam is only spam if it's somehow fraudulent. They also leave themselves a nice loophole if it doesn't turn out to work - saying that it will only work "with proper enforcement." So, now, when we end up with more spam than ever, they'll just say the government needs more money to go after spammers. How about the spammers themselves? Well, they're not saying much, but they are still spamming. It turns out that last month they took a break from all that porn spam to focus on "health care" spam (at least, that's what they call bogus diet pills, bogus Viagra and bogus... enhancement pills).

Let's have a ban on the phrase "Linux on the desktop" and replace it with "Linux on the corporate desktop" and "Linux on the home desktop". Once we've done this we can firmly say that Linux is ready for the corporate desktop and Linux is not ready for the home desktop without contradiction. It also helps us know what to pay attention to and what to ignore; e.g. UserLinux has admitted that it will be focusing on the corporate desktop and thus home users shouldn't expect to get any benefit from it.

In the original UserLinux white paper, I made it clear that the project would play favorites among the software choices available to it, and that the resulting process would be painful. You can't say that you weren't warned. But it turns out not to be particularly painful, except for one issue: the selection of the GUI used in the system. The selection of GNOME as the GUI of the UserLinux project has raised a good deal of opposition from KDE supporters.

Bruce Perens updated the UserLinux manifesto; now it's even worse than it appears. "It is not an attempt to produce a 'Linux for Grandma', but is usable by the millions of people with the technical skill to run GNU/Linux systems at home, many of whom do so to facilitate their business or employment. Of course we'll take advantage of improvements in user friendliness as they are developed, however it's not our intent to lead their development." As far as I can tell, they're not planning to develop anything.

E-Data, emboldened by their success against Microsoft and not waiting around to see how their case against Corbis and Getty Images goes is now suing a bunch of other online companies including Amazon.com, the NY Times, American Greetings and Hallmark. E-Data, of course, claims all of these companies are violating its patent on downloading media. Even worse, the patent actually expired last year, but E-Data is suing them for violations while the patent was still valid. This is a perfect example of just how stupid patents work. The point of getting a patent is to encourage the inventor to come up with the idea in the first place and then to publish the idea so others can make use of it -- while licensing it from the inventor. Patent violations should be for companies that actually do "violate" the patent -- and take what they learned from the patent and make use of that "non-obvious" idea without compensating the inventor. Does anyone really think that Amazon decided to get into the business of offering downloadable media after first reading this patent? Meanwhile, E-Data has done nothing themselves to further innovation with this patent other than to make plenty of other companies waste money. How does this encourage innovation in any way? The patent system is broken.

bd_rom.jpg imageAs the DVD format gets older more and more people are talking about what is going to take its place. I personally don't think DVD as a media will be getting "old" anytime soon - but since when did my opinion matter? [Excellent point. -ed.]

Most people involved in the argument feel that one of two next-generation optical media types will replace DVD - either HD DVD (for "High Definition DVD," or Blu-Ray (which somehow ends up being a "BD-ROM"). Since Sony (among others) has already quietly released Blu-Ray devices to the public, and announced that the Playstation 3 will utilize Blu-Ray, we can easily see that Sony is pioneering the format, and likely the one with the most proverbial ass on the line. I could go into the specifications of each format more, but that's what Google is for, slack.

All this is to say, when you hear an announcement about Blu-Ray, don't expect an announcement about HD DVD to be far behind. In fact, today saw both announcements.

Installing Kazaa wasn't the only insane thing I did,

I also enabled Windows Update, allowing it to install updates from Microsoft every night at 3AM. This was not a good idea for at least one reason -- it reboots my machine every time there's an update. I'd rather decide when my machine is rebooted.

Now I'm trying to figure out how to turn it off. There used to be a Windows Update icon in the tray, but now it's gone. I guess once they have you hooked there's no need to configure it? I've pored over the site, to no avail. If you know how to turn it off, please let me know. Thanks!

Two very good things that came out of the dot com era are Slate and Salon. One has deep pockets, and the other has, well, a knack for finding last-minute funding, and both seems to have survived the dot com crash.
Or have they?
Well, reports are out that Microsoft is looking to sell Slate. Looks like the recent cost-cutting measures at Microsoft has now trickled down to this particular product. I wish all the best to the people behind Slate, and hope that the online magazine will not suck after being bought over.

He gives the example of MoveOn.org which started as a movement to "move on" from the Clinton impeachment, then broadened its mission to counter the selling of the Iraq war, and now is purchasing ads to get Americans to think. Obviously, Jim and everyone at DFA is still hoping for a Howard Dean victory, but Jim also muses about the idea of DFA continuing to gain momentum and power.
