12/22/2003 04:09 PMWhile lots of people were celebrating on Friday when the Appeals Court
overturned the rulings against Verizon and said that
the RIAA
had to file lawsuits before they could get subpoenas for customer
info from ISPs, many people were realizing that this wasn't that
big a victory. Lots of us expect that the RIAA will just get its
friends in Congress to amend the DMCA to change the law to include
these types of subpoenas (though, I still think opening up the DMCA
for amending is a risky thing for them to do, as it could backfire on
the RIAA). Others point out that all this really means is that
the RIAA will now
file John Doe lawsuits first, which will compel the ISPs to reveal
the names anyway. The difference here, though, is that the RIAA can
get in a lot more trouble if it comes to light that they're filing a
number of frivolous lawsuits, rather than just filing bad subpoenas.

have the authority under U.S. law to subpoena the names of alleged
peer-to-peer file traders from ISPs (Internet service providers), a
federal appellate court ruled Friday. The U.S. Court of Appeals for
the District of Columbia overturned a lower court's decision allowing
the RIAA to file subpoenas asking Verizon Internet Services Inc. to
turn over the names of suspected copyright infringers without the RIAA
having to file lawsuits against the alleged file traders. But the
RIAA's argument that the subpoenas allowed in the 1998 Digital
Millennium Copyright Act (DMCA) apply to material transmitted through
an ISP as well as content stored by an ISP "borders upon the silly,"
the court wrote.

06/29/2004 08:29 PMA group calling themselves the Personal Technology Freedom Coalition
is holding a press conference today to show their support for a repeal
of a portion of The Digital Millennium Copyright Act. The current
rules that the DMCA outline are quite forceful in stating that no one
shall “sell or distribute any product that is primarily designed
or produced for the purpose of circumventing a technological
measure.” While this is frustrating to those of us that wish to
make legitimate back-ups of software, music and games, the DMCA is
quite clear that this can not be done.
Help may be on the way though with the up coming review of a bill
referred to as The Digital Media Consumers’ Rights Act. While
allowing circumventing of many of the rules outlined by the DMCA, it
will not allow for any tolerance for piracy however.
