Leading Web search engine Google is exploring a new feature: searching print materials . This beta test allows publishers to submit text content, which would available for users' keyword searching (and purchase), then flagged as being offline print.

This idea is reminiscent of Amazon's recent full-text search .

Last month, in discussing how publisher s were angry at Google for its book scanning project, we noted that Google had decided to scan some books without the publisher's permission, citing fair use rights. It turns out the situation is a bit more complex. What really appears to have happened is the collis ion of two different book scanning projects. The first, Google Print, was where Google partnered with publishers and promised them that the scanned books would (a) help sell more books and (b) more importantly, allow them to get ad revenue associated with contextual ads alongside any pages that people viewed. However, soon afterwards, Google tied this project with their Google Library project, where they were partnering with libraries to scan all of their books. In those cases, there was no revenue sharing argument. The benefit for the libraries is that Google pays the expense of digitizing their entire collection, which the library then gets to use. Of course, there's a potential conflict here, as Google can scan a library book, even though the publisher of the book refused to take part in Google Print -- or, even if they agreed to take part, but now they won't get the revenue share from the ads. In some sense, again, it comes down to a question of "ownership." The publishers view ownership from the intellectual property point of view, saying that they own the words, and no one can do anything with them without permission. The libraries, on the other hand, are viewing ownership in the more tangible sense, along with the right of first sale -- saying that, if they own the physical books, they should have the rights to do what they want with them. It's a fine line, of course, but given the way the courts have been acting lately, it would seem likely that they would side with the publishers -- and claim that the libraries were violating the publishers' rights in digitizing the books in the first place.

I'm so tired of these single feature supposed products - without social networks, personal publishing - just sitting there, all by themselves. Do they think that by including RSS - they're hip and tuned in?

Without friends - this product is absurd.

Who better to discuss the legality of Amazon's new full text search feature, than a copyright lawyer who is also an author? Over at News.com, Doug Isenberg points out that if you happen to do a search on the system of "fair use" and "internet", you'll actually get the passage from his book describing how one of the determinants of whether or not something is fair use is how it impacts the sales of the book. So, while he's was a bit surprised, as an author, to find out his entire book was online via Amazon, it's probably perfectly legal. In fact, he says that the publishers probably do have the right to make that call (no matter what the Authors Guild says), though he admits that almost no one probably thought about this potential use of their work when they signed their publishing deal.

Ok.  Here's a cool (well I think its cool at least -- let me know if its useless) new thing.  What I've done is added metadata to search results so you can look at a search result and see visually whether that post has:

  • Multiple Links
  • Any images
  • Any mailto links

Why?  What Was I Thinking?

We all surf the net a lot and while we might not be able to remember an exact posting, we tend to be able to remember some of its characteristics -- WHEN they deviate from the norm AND if they're visual in nature.  When I think about cool cell phones for example, I'd naturally think of Russell.  But Russell has written so much on cell phones that if the search result can tell me "Has 5 pictures" then I can get a rough feel if this might be the posting.  Similarly if I'm looking for a post where I remember that it had a mailto link then I can now tell from the search results.  Now both mailtos and pictures are still somewhat uncommon in blog posts so I start the count on those from 1 (i.e. I'll display their count if there is at least 1).  But we assume that blog posts have at least 1 url always so I only show urls when there are more than 1 (which might not be the right thresh hold / is 5 better).

Sound silly?  Here are some examples:

I sent the following to Google’s Suggestions Box:Google should provide access to their website thru HTTPS, the encrypted version of HTTP. This will allow people to search for things on Google without other people on their network or at their ISP being able to see what they search for. Because so many people search for so many things on Google, it’s important that it lives up to the highest privacy standards. Supporting HTTPS would be a large step in the right direction. Doing it would only take a little work on your part (you could just set up a proxy that decrypted connections and passed them on; software and hardware to do this is very readily available), but would do great things to protect the privacy of your users. I hope you’ll consider it. Please let me know if you have any questions....
