This is sounding more and more like a bad movie. In fact, if someone wrote this script, I'd bet it would get rejected as being way too implausible. Not only has Diebold been shown to have incredibly insecure technology on their electronic voting machines (universal password: 1111), had their (very partisan) CEO say that he was going to help his party win the election, been trying to sue every whistle-blower who calls them on this, admitted that they're going to try to jack up prices for anyone who tries to force them to add a paper trail and been caught using uncertified software in a recent election (breathe...), now it also turns out that they've employed at least five convicted felons in management roles at their voting machine subsidiary, according to Bev Harris, who has been leading the charge against Diebold. In fact, a senior VP of the group, who was responsible for writing and maintaining the code used in their voting systems, served time in prison for "stealing money and tampering with computer files". Diebold says that the guy left at the time they acquired his company to become their e-voting subsidiary, but they're still using this guy's code.

The latest in the Diebold saga in California is that Attorney General Bill Lockyer has decided to sue the company, saying they made false claims about their product. Amusingly, Diebold continues to mislead in their response to the lawsuit by noting that they are: "pleased Lockyer dropped the probe." When the only reason the probe has been dropped is because there's enough info to sue, it seems like there's not much to be "pleased" about.

As Diebold continues to send out cease-and-desist letters to shut down whistle-blower sites that show just how insecure Diebold's electronic voting software is, the EFF and Stanford Law Clinic are representing two Swarthmore students (and an ISP) to sue Diebold to get them to stop issuing cease-and-desist letters, saying that they are specious legal threats. In the case of the ISP, Diebold sent a DMCA cease-and-desist takedown letter because someone on their sites simply linked to the documents. There are any number of problems with what Diebold is doing. They're trying to force down sites that simply link to information, which goes too far. They're trying to stifle whistleblowing activity that exposes their voting software's flaws (something that is important to be made public, as Diebold has a large share of the electronic voting machine market). Finally, they're using the DMCA for all of this, in a way that it was clearly not intended to be used. The idea behind the DMCA (as flawed as the thinking may be) was to stop someone from taking content and reselling (or giving it away) it as their own - undercutting the market. No one is trying to do that in this case. The information being brought out isn't designed to compete with Diebold, but to expose them for having notoriously weak security on a product that clearly needs to be very secure.

Cory Doctorow: Diebold's voting machines have a stunning security defect:
Manipulation technique found in the Diebold central tabulator -- 1,000 of these systems are in place, and they count up to two million votes at a time.

By entering a 2-digit code in a hidden location, a second set of votes is created. This set of votes can be changed, so that it no longer matches the correct votes. The voting system will then read the totals from the bogus vote set. It takes only seconds to change the votes, and to date not a single location in the U.S. has implemented security measures to fully mitigate the risks.

This program is not "stupidity" or sloppiness. It was designed and tested over a series of a dozen version adjustments.

The full story is over on Corante.On April 20th, the Oakland Tribune published a story regarding Diebold's alleged use of uncertified voting software in violation of California state law (Diebold knew of legal risks). The article cited and focused on internal legal memos from the Jones Day law firm showing that Diebold's own lawyers had warned of some of the possible illegalities. Online, the Oakland Tribune posted the documents in addition to the article. That afternoon, the Trib's parent company and the reporter were sued by Jones Day to have the documents returned. The judge ordered the documents returned, except for those already published on the internet (Judge: Tribune must turn over legal memos):Hmm, "already published on the Internet", eh? Every time I read another article about Diebold, you wonder what's really going on at the company. They clearly seem to be living in their own little reality where they simply ignore the very important questions people are starting to ask about their voting machines. I wonder how anyone in their right mind could use a Diebold voting machine after these fiascoes. Despite plenty of questions concerning their voting machines over the past few months, Diebold didn't do anything differently and knowingly broke their contract (and the law) with Alameda county by using uncertified software. Diebold's lawyers tried to get them around this by suggesting they claim that the software was "experimental" rather than "uncertified." Despite being clearly told not to do this, Diebold went ahead and used the uncertified and barely tested software which was rushed onto machines for the primary elections in California last month. Even worse, when an employee spoke up to point out that there was poor quality control and an aspect of the voting system was likely to fail, he was quickly fired. When you put together all of the information compiled over the last year concerning Diebold's voting machines, their inability to comprehend why people are upset, and what looks like their outright violation of the law, why would anyone agree to use such a machine during an election?
