[This is an edited version of the talk I gave last fall at the
State of Play
conference.]
I'm sort of odd-man-out in a Games and Law conference, in that my
primary area of inquiry isn't games but social software. Not only am I
not a lawyer, I don't even spend most of my time thinking about game
problems. I spend my time thinking about software that supports group
interaction across a fairly wide range of social patterns.
So, instead of working from case law out, which has been a theme here
(and here's where I insert the "I am not a lawyer" disclaimer) I'm
going to propose a thought experiment looking from the outside in.
And I want to pick up on something that Julian [Dibbell] said earlier
about game worlds: 'users are the state.' The thought experiment I
want to propose is to agree with that sentiment, and to ask "How far
can we go in that direction?"
Instead of looking for the places where game users are currently suing
or fighting one another, forcing the owners of various virtual worlds
to deal with these things one crisis at a time, I want to ask the
question "What would happen if we wanted to build a world where we
maximized the amount of user control? What would that look like?"
I'm going to make that argument in three pieces. First, I'm going to
do a little background on group structure and the tension between the
individual and the group. Then I want to contrast briefly governance
in real and virtual worlds. Finally I want to propose a thought
experiment on placing control of online spaces in the hands of the
users.

06/15/2004 10:07 AMThree years ago, I was working at a small company as the unofficial IT
director / all-purpose computer bitch. I was laid off in early 2003,
but to this day, the job presents me with difficulties; namely, that
of telling prospective employers what I did, and for that matter, what
the company itself did. I have virtually no idea what this company's
function was, despite working there for over a year and a half,
although I did learn how to spew an amazing amount of marketing jargon
without thinking. As for my role there, it was essentially vast
tracts of doing absolutely nothing, punctuated erratically by moments
of panicking and crisis-defusion, usually involving something truly
earth-shattering like the CEO not being able to print her email. When
asked by interviewers "What did your company do?" I am forced to
mumble vaguaries about consulting and hope they leave the issue alone.

MP3 player market with at least two new units, the Rave-MP ARC
[pictured] and the Rave-MP AMP, the former a hard disk-based player
available in 2.5GB and 5GB versions, with the latter a
less-interesting but still decent flash-based player. I had a chance
to sit down with some of the folks from Rave-MP the other night and
play around with both units, and they seem nice enough as far as that
goes -- and the price is right, at $229 for the 5GB version -- but I
can't really get past the fact that the ARC looks sort of lifeless. It
looks a little better in person, but not by much.
Still, I think Go Video has some commitment to getting back into
the game, so it will be interesting to see where they go from here. If
they could release an ARC 2 with the same specs and a more stylish
form factor, I think they'd take a nice bite of the market (especially
if retails drop the price a little. $230 is a little too close to the
iPod mini's $250.)

has an interesting post on the discrepancy in congress over ClearPlay DVD players. The players
automatically remove scenes that would be offensive to sensitive
viewers, but do so in the comfort of one's own home while playing
standard movies on DVD. Some politicians oppose it because individuals
are creating derivative works and they also see it as opening the door
to "recipe hacking", which would be like producing the Grey Album by
purchasing two legal records (the original Beatles' White Album and
Jay-Z's Black Album) and combining them at home to produce a
derivative work (if DJ Dangermouse produced software that could create
his mixes).
On top of all that, since the motivation behind ClearPlay
technology is largely religious, it turns the argument on its ear to
many participants and observers. It's not hard to find folks that
loved the Grey Album but see ClearPlay technology as something to be
frowned upon, but the underlying technology and law is largely the
same. It's an interesting case and hopefully does open the doors to
all sorts of creative uses of derivative works.

add-on for MP3 players called RangeScan that'll let you wirelessly
transmit audio to a stereo. The only problem is that right now all it
does is take the analog audio signal from the players headphones jack,
convert into a digital stream, and then decode them back into an
analog signal at the receiver, which makes something like this only
slightly more useful than an FM transmitter add-on like the iTrip.
There are definitely some practical uses for having wireless
networking built-into an MP3 player -- like swapping files with
friends or wirelessly synching with a computer -- but Bluetooth is too
